My wife and I started having problems with EMC from the very first day they took over our mortgage from another failed Mortgage Co.
Four years ago when EMC took over our mortgage their first screw-up was when we received a check in the mail for $3500.00 and change. EMC called it an overage in escrow. Over the next 6 weeks my wife called EMC asking IF this was correct. Each time she called, EMC assured us that it was indeed and overage in escrow.
Finally, after 6 weeks and several phone calls later we cashed the check. We used this OVERAGE to buy some much needed things for our new home.
About a week later we received a letter in the mail from EMC stating that we owed them (EMC) $3500.00. What a shock.
My wife called EMC and asked them how this is happened. No one at EMC could give us a straight answer. Not even a Supervisor (so he said). Who promptly told my wife that it was no fault of ours and no fault of theirs (EMC).
Well I'll tell you what. My wife and I sure the hell didn't write ourselves a check for $3500.00 and called it an overage in escrow. This was CLEARLY EMC's fault.
Living on a shoestring budget (like I am sure a LOT of us are) we did not have $3500.00 to pay back EMC. So their solution was to increase our monthly payments over a 2 tear period to pay them back, including the original escrow. Needless to say, this agreement increased our house payment from approximately $900.00 to 1280.00 a month.
Over this 2 year period there were several month that we were late with our payment. I am sure everyone who reads this knows about EMC's late fees.
Now let me jump ahead to June of 2008. In June we were again behind in our mortgage payment. We were behind in or escrow as well. Not to mention the hundreds we now owed in late fees. My wife and I were to the point where we were seriously thinking about selling our home and moving to Tennessee.
My wife called EMC and spoke to 3 different individuals. Each time she was told different amounts were owed that did not correspond to our most recent bill. Finally she spoke to someone that seems to have both oars in the water. After about 30 minutes on the phone with this EMC representative an agreement was reach.
There was $700.00+ in what EMC calls a suspense account. This amount plus $2400.00 we had to borrow was supposed to be used ONLY for P/I to get us current through the month of July. Our next payment being due in August. Once this was done my wife was told they (EMC) would re-examine the escrow.
So along comes July and our next bill. Can you imagine our surprise when we opened the letter to see that we owe for July and yet another late fee. What EMC had done with our $3100.00 was applied part of it to escrow and part to late fees. This was NOT what was agreed upon buy an EMC Representative.
Sitting here now looking at my most current bill dated 09/08/08 it shows a Past Due amount of $1791.26. Another Late Fee now showing a total due of $445.00+. Other miscellaneous fees that give me a total amount due of $3132.00+. This even after making two payments in August which should have made us current through September.
How in God's name is this possible? In June EMC dispersed $3100.00+ across my account. Now here it is September and EMC's most recent bill shows this household owing over $3100.00, including Late Fees and Escrow to get current AGAIN.
Now it doesn't take a brain surgeon to see that over the past 3 months EMC is saying we owe them over $6200.00. That calculates to over $2000.00 a month.
WHERE is my money going too?
Which leads me to yet another issue with EMC. In June each time my wife called EMC to work out some type of payment plan she specifically asked for an itemized billing statement from the time EMC took over this loan. To date she has YET to receive it which puts EMC in violation of a Federal Enacted Law called the Freedom of Information Act.
Since day one 4 years ago when EMC took over this mortgage they have put an Undo Financial Burden on this household. Can you imagine the day-to-day stress you go through not knowing if you will have a place to live when you return home from work each day.
Not know if the mailman standing at your front door has a Certified letter you need to sign for from EMC foreclosing on your home. The half-dozen or more calls a day 7 days a week.
I hope that this post does not fall on deaf ears. IF there is anyone out there that is reading this (and others posts) about EMC that can help US, please do.
Also, for anyone who is interested I found this web sight last night and filed a complaint against EMC.
