I found another reason this tree should never have been planted in the right of way..

It grows to a height of 130 feet and has foliage only at the top...not really possible to trim.
There's a photo of one attached.

Sorry the outcome couldn't have been better.
Why does your mother no longer feel safe? They didn't break and enter her home did they?
If you REALLY talked to a lawyer, he would be remiss if he didn't tell you about the rights of the right of way owner (the electric company).
Law enforcement took no action, because NO laws were broken.
No, I don't work for the electric company, but have personal experience with rights of way.
