I have received calls back from state reps who, it turns our, ARE interested in litigation! Please contact your state re NOW!. Contact your attorney general. The state of NY is suing them for selling electricity above "competitive rates."
These satanists said they had competitive rates. I told them I'm not stupid; double rates are NOT competitive, I knew what they were doing and I would spend every waking moment of my life to shut them down. I have closed physician offices and large companies for fraud. This is my next target; they ripped off the wrong person!
Why do we sheeple sit back and take this? Call a rep, attorney general and complain. DEMAND your money back. THey gave me $350 but that's NOTHING compared to what they stole (that accounts for the money they took on that $638 bill I received. I'm the only one supporting 3 kids and a wife. I'm it and I can't make any more money or get any more money than I bring in.
In this economy, now you see why the billionaires are getting richer while people work harder to make ends meet. Record numbers of profits for these companies. MAKE THEM PAY! Please don't accept the unacceptable any more! Post signs, put it on your FB page and tell EVERYONE about Energy Plus Holdings, LLC and how they rip off the citizens of our state!

Here's an example- Energy Plus rips you off for $8,000 and your settlement is $30. The stinking liars get the rest. By the way, there's nothing wrong with socialism; capitalism has gone way too far to the point we don't have freedom of speech or freedom to protest without paying for new teeth. Too bad we can't follow examples of the countries who have retirements, full health care and can afford vacations (Swedes, Norway, all those Viking countries). Go abroad and you see few American's vacationing, but you see a better representation of the more successful countries. We just got hit by massive tax hikes to reimburse private businesses three times over. Capitalism sucks almost as bad as lawyers do!

The rates you mentioned are total rates and the original posting was supply rates only. Not quite apples and oranges, but Macintosh and Delicious :-)
Energy Plus is a supplier only and their rates are not regulated, nor fixed. They offer a promotion rate that is lower that others and then appear to raise it afterwards. I for one am staying away.

Second, the situations where the class members get ridiculously small amounts of compensation, are where the injury to each class member is very small, such as where companies have overcharged each member between $2 and $100. In this situation where, in my opinion, thousands of customers have been overcharged by thousands of dollars each, I believe even the class members will receive a significant award should I be victorious. (to take my personal story as an example, in the space of two years, Energy Plus charged me approximately $3000 more than I would have been charged had I stayed with ConEd.)
Yes there are sleazy attorneys, but there are sleazy doctors and sleazy teachers and sleazy politicians and sleazy people in almost any occupation. As a whole, attorneys are good people and a very high percentage of attorneys spnd a portion of their time providing free services to the poor. How many other professions do you find that concept so prevalent? very few.
Bottom line, I am a decent guy, who like you is trying to make an honest living, and this is not a random lawsuit- this is a cause I caree about, because I truly believe that Energy Plus's business model is illegal and I personally got stung by it.

My dis-taste for "lawyers" is also based along the same lines...nothing personal.

actually Ken, lead plaintiffs are usually awarded manythousands of dollars by the courts. it is true that in some class actions, the general members of a class get short changed, which is why it is important to act as a lead plaintiff, which you can do by contacting me.

Also, the class actions I've been aware of seem to USUALLY favor fat fees to the attorneys and nothing of much value to the class.
Someone filed a class action suit (unbeknownst to me) against E-Bay. (Yingling vs E-Bay) and I got a check dated 11/21/2011 indicating not good unless cashed by 12/22/2011. The amount of the check?....Nine CENTS. I kept it, uncashed just for the laughs.
Bet the attorneys did a LITTLE better, don't you think.

We have far too many litigators now and they have to scratch to find things to litigate and keep themselves solvent.
This is a TOTALLY self-serving lawsuit on the lawyers part. Then they wonder why people think they're bottom feeders as a group.

According to a 2011 report, there are approx. 400 billionaires in the U.S.
To join them, get a higher education, hock your house, wife and kids and go out on a limb in a business venture to make you rich too.

Sorry for your financial difficulties, but how is that Energy Plus's fault?
Please provide a link to your source for the "going rate" of 7.6 cents/kwh, I'm wondering where the rates in Pennsylvania are that are so much higher as to average 12.79 cents/kwh.
I had to put in an 8KW solar system to get my power bill down, I have medical equipment powered 24/7.
