The contract with the ERAP is a separate contract from the Eagle contract, usually happens with TWO DIFFERENT COMPANIES (I actually picked up the phone and researched the two, something you are too empty upstairs to do). The civil circuit judges, sure they are pro-plaintiff; you drips' vote for them! County and state judges are more about law than poor little stupid who doesn't know how to read his contract, you will lose on appeal. Sean:The factual Information is: 1) Call Detail Printout of time-dated cellphone calls to request towing dispatch - proving beyond a shadow of a doubt of extreme tardiness of Eagle response; and 2) Paid Towing Receipt proving beyond a shadow of a doubt that they actually wanted cash rather than honoring their towing warranty terms. Also: 3) Paid Receipt for the transmission repair that Eagle did NOT pay; and 4) Fax Receipt requesting mileage report on replacement Transmission that Eagle ignored. The " precedent " ( Sean: you mispelled it as: " president " ) case(s) also include: Power One Warranty Co, who the Attorney General did in fact chase in their truck trailer all the way to Iowa, as the owner was reported as actually living in this 18-wheeler as he fled Pennsylvania to avoid criminal consequences... He didn't have the $ 800 to defend ANYTHING, because of the overwhelming merit and factual information in this class action suit against him... Trust me: Pennsylavania judges respect and rule in favor for pro-se plaintiffs who have enough guts to speak out against fraudulent warranty co's, and their open-court comments have included: " Oh boy - ANOTHER raudulent warranty Co ! Sounds like the ERAP you mention is a third party towing service. There is no joint and several liability with this Eagle company. The attorney for Eagle will not suggest settlement in this case because it will be dismissed against them and it would only cost the company about $800.00 to defend; it is not the money they care about but the president they set by upholding their position. In appeals, you will not stand a chance pro se, trust me! The attorney general would not act on this complaint because there is no merit, no factual information that consumer protection laws are being broken.
