F M A Alliance, Bank Of America, FIA Card Services Debt Collection At Its Worst Houston Texas

This is Jenni. I successfully resolved this matter by requesting a letter from BOA confirming that the debt had been paid off in full, without further obligation to BOA or FMA. I insisted BOA email or fax the letter immediately, and I waited on the phone until I received it... which I did. I then faxed a copy of the letter to FMA Alliance, and they stopped harassing me. I should have followed through with a lawyer and sued them for harassment, but I just wanted to be done! Thanks for following up!

Obviously The Negotiator is another lowlife scumbag bottom feeder collector who feels he can lecture and abuse people.  Guess what,you douchebag?  YOU ARE WRONG!!!!!

If you actually read the OPs report, and I can see by your officious and snotty tone that you didn't, SHE ALREADY PAID THE DEBT!  She has letters from both Bank of America and FIA, which are only released to the debtor when the debt is paid in full.  She has faxed over said proof more than once, yet the jagoffs of FMA insist that she owes it when the OPs proof is exactly the type ofproof that would stand up in court.  That was very smart of her for keeping the proof- especially with douchebags like you out there preying on people who don't know better.

Even if she did still owe the debt, which the OP clearly DOES NOT, you, as a collector still have to operate within the confines of the FDCPA.  You cannot do certain things that thie company has tried to collect on a debt that has already been paid.  Among those are...

1. Calling before 8 am or after 9 pm  (FDCPA violation #1)

2. Not ceasing communication when the OP has communicated that (FDCPA violation #2)

3. Harassed the OP (FDCPA violation #3)

4. Discussing the debt with a 3rd party when they already have her location information (FDCPA violation

    #4 and a huge no-no because it violates many privacy laws as well as decency.)

What the OP needs to due is sue the scumsuckers at FMA- each violation of the FDCPA is $1,000 per violation.  Not only that, those bastards will also have to pay her attorney's fees.

I woke up with a robo call from FMA Alliance on my answering machine this morning for someone I'd never heard of before.

It stated "if you continue to listen to this call, you acknowledge that you are ...Brian ...Slater". It then talked about some kind of settlement.Of course it was my answering machine that continued listening, not me or anyone else.

Apparently, this is how they want to claim they've fulfilled their legal obligation to contact someone, via a robo-call that leaves messages on other people's answering machines.

COLLECTION CALLS CAN BE QUIET ANNOYING. THEY CALL YOUR HOUSE AND DEMAND MONEY IN TODAY'S ECONOMY. THE NERVE OF THESE PEOPLE, EXPECTING PEOPLE TO PAY THEIR DEBTS WITH GASOLINE PRICES THIS HIGH AND THESE ADJUSTIBLE RATE MORTGAGES. THAT IS INSANE. ON THE CONTRARY IT IS NOT INSANE, IT IS THE RIGHT OF CREDITORS AND LENDERS TO HAVE THESE DEBTS PAID. FMA COLLECTS EVERYTHING FRON MEDICAL BIILS TO STUDENTS LOANS TO RETAIL ACCOUNTS AND CREDIT CARDS. THE VAST MAJORITY OF COLLECTIONS IN FMA IS RETAIL ACCOUNTS AND CREDIT CARDS. MY QUESTION IS THIS, WHY TAKE OUT THESE TYPE OF LINES OF CREDIT IF WE CANT SUSTAIN THEM. THE ANSWER IS, WE ARE SO SHALLOW AND DESIRE INSTANT GRATIFICATION THAT WE WANT TO LOOK GOOD AND FEEL GOOD AND DRIVE GOOD NOW, EVEN IF WE CANT AFFORD IT. BILL COLLECTORS HAVE BEEN MADE TO BE THE DECAY OF SOCIETY. THEY HAVE BEEN PAINTED AS RUDE, EVIL, AND HEARTLESS PEOPLE. ALL BILL COLLECTORS ARE NOT EVIL AND HEARTLESS PEOPLE WHO DONT CARE ABOUT PEOPLE, ON THE CONTRARY THEY EVERY DAY PEOPLE. WHEN A COLLECTOR CALLS YOU AND YOU TELL THEN YOU CANT PAY BUT HAVE THE HIGHEST CABLE PACKAGE ON THE HD PLASMA TV THAT YOU BOUGHT FROM BEST BUY WEARING THE DIAMOND EARRING THAT YOU BOUGHT FROM WHITEHALL IN THE TRENDY OUTFIT FROM THE GAP, THAT LEAVES THEM SLIGHTLY CONFUSED. SOME COLLECTORS ARE VERY AGGRESSIVE AND ACT AS IF YOU OWE THEM THE MONEY, BUT THAT IS NOT THE CASE WITH ALL. MOST PEOPLE IN COLLECTIONS ARE AWARE THAT THERE BILLS ARENT PAID BUT HAVE THIS RIGHTEOUS INDIGNATION AS IF THE GREATEST COMMANDMENT WAS BROKEN WHEN CALLED TO PAY THE BILLS THEY RIGHTFULLY OWE. NOW THERE ARE CASES WHEN PEOPLE HAVE PAID DEBTS BUT ARE STILL BEING COLLECTED ON, SYSTEMS ARE PERFECT BUT PEOPLE ARENT AND MISTAKES ARE MADE, BUT THAT IS NOT TYPICALLY THE CASE. COLLECTORS HAVE OFTEN TIMES BEEN GIVEN THE BLAME FOR THE FINANCIAL WOES OF THOSE IN COLLECTIONS. COLLECTORS ARE NOT THE CAUSE THEY ARE THE COMFRONTERS AND ARE MERELY REPRESENTING THE PEOPLE THAT THEY COULD HAVE PAID IN A MORE AMICIBLE ENVIRONMENT ON A VOLUNTARY BASIS. I WILL NOT EXCUSE THE POOR TREATMENT AND LACK OF PROFESSIONALISM OF SOME COLLECTORS NO MORE THAN I WILL THE RUDE TELLER AT THE BANK OR THE UNPROFESSIONAL CASHIER AT THE LOCAL WALMART. THERE IS NEVER A LEGITIMATE REASON TO TREAT SOMEONE WITH DISREGARD AND DISRESPECT. BUT I DO KNOW THAT THERE ARE SECURITY MEASURES AND SAFEGUARDS IN PLACE THAT RPEVENT CALLS FROM BEING MADE PRIOR TO OR LATER THAN THE TIME ALLOWED BY THE FDCPA. IN THIS CASE THE WOMAN SAYS SHE SENT PROOF, IN THESE CASES THE INFO IS REVIEWED AND THE ONLY REASON SHE WOULD STILL BE GETTING CALLED IS THAT THE INFO RECEIVED BY FMA DIDNT SUPPORT HER CLAIM OF PAYMENT. COLLECTORS CANT USE CANCELLED CHECKS, THEY NEED PAID LETTERS THAT CLEARLY STATE EITHER THAT THE ACCOUNT HAS BEEN SETTLED OR PAID IN FULL. I HAVE A SIMPLE WORD OF ADVICE, IF YOU DONT WANT COLLECTION CALLS
