I had a FCNB credit card with Newport News. I had a credit due to me of over $300. I was told by Newport News to contact the card processing center in Beaverton, OR.

However, my situation is a little different my most others-- FCNB owes me money and refuses to pay it. I literally called and wrote the company in Beaverton, and subsequently, Old Bethpage, NY every month for a year and a half. I followed every direction given to me by the company and people on this website. I sent my letters by certified mail. A "David Norberto" signed for all of them. At one point I received a form letter stating they were looking into my problem-- of course, I never heard from them again.

Twice, I spoke to very helpful people (meaning they didn't hang up on me). I was told that I was paid a year ago and they purged my file a few months later. This is a fradulent lie!! I told them I never received or cashed any check. Also, no company (especially a credit card company) would destroy documents little than a year old.

HERE IS WHAT I'VE LEARNED:

It doesn't matter which division anyone is having problems with-- they all fall under the PA office and, ultimately, the NY office.

Stanley Elster-- SUPERVISOR of Inbound Collections in NY
Call 1-866-503-0872 his DIRECT EXTENSION is X2687
Leave him tons of voicemail!!

1-866-504-0872-- Customer Service (NY)
1-866-210-9497-- Recovery Department (NY)
1-516-576-8706-- Customer Service (PA)
1-855-503-4969-- Recovery Department (PA)

A friend, who is a lawyer, told me the best action is Small Claims Court. It is very easy to file and doesn't cost much at all for the plaintiff but it does cause a lot of time, energy and money on the part of the defendant. In most cases it is an incentive for companies like FCNB to settle with plaintiffs. We also feel this "Mr. Elster" may be a false name with a false number to redirect persistant complaints.

MOST IMPORTANT ADVICE-- KEEP EVERY DOCUMENT (every LETTER, every BILL, document every PHONE CALL, get NAMES and PHONE NUMBERS)

Good luck!

#1 Consumer Suggestion

Here is what you do

AUTHOR: Mark - (U.S.A.)

Tell them that you researched Regulation Z of the Truth in Lending Act and are contacting the OCC (Office of the Comptroller of Currency, a Federal Agency). Regulation Z deals specifically with credit balance refunds (called CBR's in the banking industry). If the do not send you the money by the next day, contact the OCC and file a formal complaint. The penalty to a lender who violates Reg Z is quite harsh.

I was a VP at one of the 5 largest banks in the United States. We were a huge credit card issuer. We had an entire business unit dedicated to Regulation Z compliance. Stated simply, the law gives a lender a finite period of time to make the borrower whole. Any attempts to keep the CBR past that threshold is considered undue enrichment and is considered criminal in nature.

My guess is this will strike a cord and get some action. By the way, Reg Z applies to any CBR greater the $1.
