Linda Yu who runs Fabulous Rocks and two other businesses on Etsy.com, fabricates her listings to deceive buyers into thinking they are buying something they are not. This is the worst seller I have ever come across in all my years buying on Etsy.com. I purchased a product she described as being bigger than it actually was, she also stated it was something it was not "a precious stone" it was actually just a common stone. After I left her "neutral" feedback, I received an e-mail from her stating that she was leaving me "negative" feedback, in retaliation.

She actually stated it was to affect the sales in my shop. She then went on a rampage of nasty e-mails to me, calling me "self absorbed" telling me I was a "nobody" and that she would have my shop kicked of Etsy if I reported her. The jewelry community is aware of her and I was told after the fact to steer clear of her. So i'm warning any other unsuspecting buyers, take your business elsewhere, because if you end up unhappy with your purchase, Linda will come after you and try to ruin your business or reputation on Etsy. Buyer Beware- Do not buy from Fabulous Rocks!!

Rebuttal to Libelous Claim by Buyer

AUTHOR: FabulousRocks - (United States of America)

POSTED: Monday, January 21, 2013

This will be my final clarification re: the libel claims spread about our company as we are now engaged in LEGAL ACTION against her with attorneys and the courts.

Per recommendations by our legal team, we will not be doing any additional updates on this site or any other sites for which we have posted rebuttals until this has gone through the legal action and judgments have been made re: this matter.

We informed buyer she is harassing us via her internet attempts to defile our company on multiple internet sites (possibly up to 4 or more) since January 8th. We have told her to stop to NO AVAIL and have told her all future correspondence with her will be through attorneys and court orders.

We certainly did not anticipate the scope or intensity of lies she has been verified responsible for and other sites' content that she may be responsible for.

Fabrications we have encountered on these internet sites include calling us scam artists, claiming our products are cheap and break (when she never bought these items), declaring she took us to court re: items we don't even sell (genuine diamond rings), and defamation of our personal character and business reputation.

She has CLEARLY identified herself on this site based on the content and gave out her last name HERSELF to confirm (and thus incriminate herself) on a second site.  Furthermore, on a third site due to content, she has again identified herself.

Even if the other sites (Facebook.com and ReviewsTalk.com .. see below for the contents on those sites) can't be identified due to inability to trace the IP address, the proximity/intensity/nature of libel/circumstances around the postings on these 2 other sites IMMEDIATELY following her threats of daily harrassment, along with two CONFIRMED sites where she cyberharassed us leads anyone, through circumstantial and preponderance of evidence, to consider her as a possible perpetrator. This is NOT an assumption but a stated fact that any attorney or individual can conclude.

Our evidence and paper trail and electronic trail of evidence is very substantial.

The second site's exchanges can be seen here: http://etsycallout.wordpress.com/2011/03/31/fabulousrocks-riverofromansk/

In her last entries she brags about her family's legal connections and her lack of concern with our legal actions. This only makes it worst that someone who should know better is engaged in such criminal internet activities and is not concerned.

As for her allegations of lies and accusations here are rebuttals

1) RE: ROUGH DIAMONDS

All our rough diamond "drusy" (term used to clarify the surface appearance of these items) are genuine DIAMOND PRECIOUS GEMSTONES in the form of nuggets and/or chips.  We have all receipts from vendors to prove these are genuine diamonds.

We give a rough range of what these could be, "2-3 mm.. tad under or over" as inventory from vendors can change over time.

Diamonds are strung graduated in size on strands.  We fulfill orders as they come in, so we could send out all smaller or all larger diamonds depending on where we are on the strand.

Unless buyers specifically requested a certain range, which this buyer DID NOT, they get what is next to be cut on the strand. Buyer had every right to ask BEFORE she purchased as she wrote me to ask other questions regarding these diamonds.

Buyer herself has verified, (albeit has changed her story on what she actually received several times now) on sites she is posting on, that the diamonds all fell in the range of just shy of 2 mm to barely over 2 mm, which as I understand or anyone else can affirm, matches our listing description 100%, "2-3 mm.. tad under or over".

In reaction to her obvious inability to comprehend what we clearly stated in our first rebuttal, we have since then changed ALL listings to have the term "druzy"/"drusy" REMOVED OFF ALL LISTING, so now they are supremely clear that these ROUGH DIAMONDS nugget/chips can't be construed as anything else. No seller in their right mind would do the above if they were in fact not selling diamonds especially when engaging in legal action.

We do not lie about our products. In the event "diamonds" is used in the title and the item is not actually a diamond, as in our Herkimer diamonds (common name these clear crystals are called), we very clearly state in the description, "First things first.. these are NOT diamonds.. but were given these names b/c these beauties mimic diamonds in their sparkle and appearance.." so no one can be confused or allege we lied.

Also, as stated but clearly missed by this buyer in our first rebuttal, we ALSO sell geode agates and stalactites in our shop and these also use the phrase "drusy" for the ones that actually have drusy crystals on their surface. So we are VERY familiar with geode drusy products.

Most if not all the above has been explained to the buyer on multiple occasions via multiple exchanges that now total over 15-20 from her to us. However, despite our attempts, she cannot help herself from spreading internet libel about our company over her own misunderstanding and dissatisfaction with her order. We have offered her to send the order back for a refund.

2) RE: ACCUSING HER

- If buyer had CAREFULLY read what I wrote, I merely stated what has since happened to us since our first email from her, which had the promised daily threat:

I will spend every day ALL day spreading this message outside of Etsy to warn people about the kind of person you are and how you do business!!!!!!  Fortunately, I have an endless amount of free time to devote to this NASTY e-mail from you. I am contacting Etsy right now and then I have many other sources outside of Etsy to contact-..

A second similar threat followed in her second email to us:

I will be HAPPY to spend ALL day spreading your nasty e-mail outside of Etsy.google your shop in a few days..hahahahaha!

We have had three confirmed sites  where she made libelous and damaging comments about our company, both here on RipOffReports.com, EtsyCallOut.wordpress.com, and ReviewsTalk.com.  The proof speaks for itself.

3) RE: HARASSING HER & PAYPAL

- We are the ones she is harassing with threats and actual cyberharassment on multiple internet sites

- Regarding her claims that we are harassing her via Paypal by using her email address, we contacted Paypal on 1/10 and had entries MADE by a Paypal Manager of our account re: this buyer.

Our findings as follows:

a) As paypal does not get involved with "he said, she said" disputes when products are professed to not be as described, they awarded the money back to the buyer. That is their standard policy as they can't prove anything and don't get into verifying veracity of statements for either side. However, they did say BASED ON OUR EXCELLENT TRACK RECORD, they also did not removed the funds from us. So the real loser is Paypal, who must swallow this senseless claim and lose money.

b) Paypal verified I had EVERY RIGHT to use the public information she provided (address, email, name) to contact her and well as ship her order. Paypal in fact always encourages buyer/seller to work out their disputes before resorting to file a Paypal dispute. This is a KNOWN fact and contrary to what she states.

c) Paypal verified we were NOT HARASSING HER in any manner by sending her information we were aware of, that Paypal TOLD US TO TELL HER such information, and in no way did we violate their Terms of Use agreement

d) Paypal verified she did NOT file a complaint, there is NO WAY to file a complaint direct to their "legal department" as she claimed on another site, and her "complaint" would not even be taken considering we were doing everything we had the right to do in contacting her using her Etsy and Paypal email accounts to update her and work with her.

e) we had Paypal document all the above in their notes for the conversation we had with them on 1/10 at about 9:45 am PST.

f) we tried to work with her on BOTH Etsy and Paypal. Etsy ruled in our favor

g) the above proves Paypal in NO WAY is holding us responsible for harassing this buyer nor engaging in any unpermissible actions.

4) RE: FINANCIAL REPURCUSSIONS

Someone who commits criminal acts of libel that damage a reputation, business, and future growth opportunities should be held responsible. Damage has been done to our reputation and business and we take steps to make sure such individual(s) is/are stopped and made accountable for their actions.

If we ever engage in a vendor to do business and they read this false claim and even suspect validity of statements or question our ethics, we could risk the partnership. Her actions may not have immediate damages but we will be certain to make sure we do not incur any financial damages over the next year.

Irresponsible people who take their anger out via cyberharassment are now being prosecuted DAILY and we will make sure we don't let anyone defile our company's reputation.

5) re: FACEBOOK .. NOT YET PROVEN TO BE HER, BUT WE WILL SUBMIT SUBPOENA TO FACEBOOK TO REQUEST IDENTITY

As for Facebook, 10 posts went up IN ONE DAY from a "Dan Jones" alias

Content included

- we are "professional scam artists", stating items are cheap, break, crappy, terrible, not genuine (sterling) silver.

- libelous comments over our business practices and calling us scam artists

- racially insensitive and inappropriate content

- content pertaining to Linda's abilities as a wife and our marriage relationship, which is a personal matter no one has right to comment on

The above and below comments, whomever they are made from, crosses many lines and types of harassment, including disparaging comments wrt Asians and someone's personal life. No matter how bad the product, not one of those comments are appropriate nor intent on solving anything, but done completely out of malice with intent to financially harm us and is a defamation of our character and business reputation.

For those of you who use Facebook (which is everybody almost), you are well aware comments arrive in your mailbox to inform you of Facebook postings.  These can't be deleted since they are now in MY personal emails. The comments came in a wave of 6 first, then 4 more.

After we shot this buyer an email telling her we are now going to sue her for this Facebook content from "Dan Jones" and we believed came from her, the entire "Dan Jones" profile was erased within a matter of 2 hours. A court subpoena is all that is needed to get hard copies of these to a court or lawyer for a lawsuit to prove they existed at one time and the responsible party. Nothing is EVER completely off the Internet or a company's records!

Here are the 10 libelous postings:

- Dan Jones posted on Fabulous Rocks's timeline

"Never buy anything from this shop, this person is certified "crazy" and her products are cheap and break easily!! Professional Scam Artist!

- This one is in reference of a picture of our Cavalier King Charles Spaniel

Dan wrote: "She resembles her owner!"

- Dan Jones commented on Fabulous Rocks & One Dolce Vida's New artisan charms.. album.

Dan wrote: "Ugh! cheap cheap cheap, crap....do not take your chances on

this shop, you will get burned!!"

- Dan Jones commented on Fabulous Rocks & One Dolce Vida's Untitled Album album.

Dan wrote: "Terrible products...terrible shop, horrible business practices!  buyer save yourself the trouble and steer clear of this shop!

- Dan Jones posted on Fabulous Rocks & One Dolce Vida's timeline

"This shop is a scam...buyer beware....all elements are cheap and break easily, and wire is not genuine silver!!! scam artist working off Etsy, taking advantage of unsuspecting buyers! read her feedback and you will see how horrible mean she is to people that buy from her-"

- Dan Jones commented on Fabulous Rocks & One Dolce Vida's photo.

Dan wrote: "Try to use these and see how fast they break on you...dont

make the same mistake I did, buy from a reputable seller!"

- Dan Jones commented on Fabulous Rocks's Wall post.

Dan wrote: "Well lookie here, looks like Ms Yu has done so many people wrong, she's spouting off about yet ANOTHER unsatisfied buyer...hmmm? why am I not surprised? I feel sorry for this lady who bought from you...or anyone who comes across your shady shop for that matter.....cheap mass produced trinkets that break as soon as you try to use them!!!"

- Dan Jones commented on Fabulous Rocks & One Dolce Vida's Wall post.

Dan wrote: "Wow, I feel sorry for your husband lady! airing your businessout for your customers to see? you must be a nightmare to deal with as a spouse! Good thing my woman is a "real" lady, with class!"

- Dan Jones commented on Fabulous Rocks & One Dolce Vida's Untitled Album album.

Dan wrote: "You've done so many customers wrong your airing out your private business for all of your potential customers to see? how about you rearn how to speak Engrish....oops I mean English."

- Dan Jones commented on Fabulous Rocks & One Dolce Vida's photo.

Dan wrote: "Wow, you are one paranoid individual....you must have madealot of people very unhappy- As for reporting me to facebook, lady you go right ahead, im only telling it like it is, I bought your crappy products and people need to know they aren't worth a dime! BUYER BEWARE!"

RE: REVIEWSTALK

This content appeared on January 8th:

Linda Yu

Buyer, beware and better avoid this seller! Linda Yu scams people with fake offers and cheap product - she sold me fake diamond ring and refused in a refund so I had to take her to court! Such people have o be in a jail, be careful!

Given the content of "diamonds" we highly suspect her involvement andare looking to get the IP address from the site administrator, whether voluntarily or with court subpoena.

She added a further comment under another alias claiming our feedback was done to ruin her shop's reputation.  Again, content on this "complaint" confirms her as responsible party.

Linda Yu Fabulous Rocks will NOT stop harassing me!

AUTHOR: Destiny - (United States of America)

POSTED: Wednesday, January 09, 2013

Linda Yu, has already broken the terms of "ripoff report" 1) No false statements 2) No accusations, So this was her first mistake with her rebuttal. As for her "legal" action against me? My first response is I AM telling the truth. I never purchased "diamonds" as she keeps claiming they were... Here is the original listing that I purchased.....
"5% Off Shop Sale.. ROUGH DIAMOND Raw Drusy Nuggets, Luxe AAA, Set of 10, 2-3 mm, Sparkly Druzy Chips.. black. april birthstone..ddb"

Just so everyone is aware she is claiming they are "diamonds" when in reality they are "druzy chips" which come from the inside of geodes" She needs to do more research on her products before she falsely misrepresents what she is selling!!!! and I used a caliper to determine 9 out of the 10 chips were UNDER 2mm in size and that NONE of them were even CLOSE to 3mm, so she should NOT have put 3mm in size in her listing at all!! and I still only left her "neutral feedback" something that did NOT affect her shop rating at all, and was NOT my intention, my intention was to let her know her listing and what I actually received were very different. She decided to retaliate with the feedback system and left my shop a big NEGATIVE...knowing it would bring my feedback score down. Oh yes, she plays DIRTY!!!

She has a long history of unhappy buyers and of abusing the Etsy "feedback" system, giving her OWN buyers "negative" feedback to intentionally affect the sales of their independent Etsy shops! Even when her buyers only left her "NEUTRAL" feedback, this angers her so much that she goes into a full blown tirade against anyone who leaves her anything other than positive feedback! And she makes no qualms about how much MONEY she makes on Etsy....here is one of her harassing e-mails to me, after I told her I was reporting her to Etsy...
Linda Yu..Fabulous Rocks on Etsy writes....

Feel free to do so.. we have had this "threat" so many times. here is nothing that goes against us being able to leave you negative feedback in response as we view this transaction negatively.  we view VERY negatively people who buy without reviewing our shipping timelines and then complain about it. pls take responsibility for your own oversight
more so, we don't appreciate buyers who don't understand what they are buying size wise and then rather than go about things the courteous way.. and telling us in a convo decide to leave feedback that is inaccurate and inappropriate.
so feel free to waste ALL DAY EVERYDAY doing whatever you need to do..
we have heart that threat as well.. and with almost 80000 sales to date  and heading towards a million in sales per year I am "sure" you can kill ur business. ls grow up and use your time more constructively.. but if you choose to waste your life away.. feel free!

So now you see how she was asking me to "feel free to waste all day everyday doing whatever I need to do" And that they are heading towards a million dollars in sales per year....Does this sound like someone who needs to threaten legal abuse against a "little person like me"??  So to give everyone a better understanding about how Linda Yu practices business, I opened up a claim in Paypal, to get a refund for my purchase, since she was NOT willing to work it out over Etsy....she then proceeded to harass me using the Paypal e-mail address I have on file, WHILE my claim is under review...I had to call Paypal and let them know she was harassing me with over 4 e-mails to my "personal" e-mail, they told me that Linda was NOT suppose to be contacting me, that this is the ENTIRE reason why Paypal handles disputes. I had to send an email to their "complaint" department because Linda Yu is causing me a great deal of personal anguish with her harassing e-mails.  Here is a copy of an e-mail she sent to my personal e-mail she took off Paypal and proceeded to harass me....
Linda Yu says....
i have every right to pass on the information that Paypal told us to pass onto you .. if you even READ THAT FAR before launching into a tirade.
per my message:
we contacted paypal this morning. they said YOU need to send the diamonds
back.. with TRACKING information .. and once tracking confirms the
items are received, you will be refunded.
btw.. YOUR shipping is NOT compensated.. :)
YOU re the one who opened a case against us re: these diamonds.  Paypal
says if you did not send it with TRACKING information you WILL NOT BE
REFUNDED in the event the items don't make it back to us.  As you are so
eager to get back your money, we don't want to be held responsible for
your lack of information.we will certainly contact FB so we can
sue the individual(s) behind the slander.  as you are the ONLY person
who has repeatedly threatened us with spending all day telling
EEEEEEEVERYONE how horrid we are and the next day 10 comments go up on
Facebook, it does not take a genius to conclude who is behind it.  not
one buyer out of thousands of buyers has been so flagrant in stating their threats.
it is reasonable that YOU ARE RESPONSIBLE.  so yes..
go contact a lawyer.... we will see who is harasssing and slandering
whom. :)
there is so much evidence it is ridiculous.. who is wacked enough to need to leave TEN messages on facebook?
and please come up with more original things.. WE ARE THE ONES WHO TOLD YOU WE WILL BE SUING.. don't repeat things like a parrot
FabulousRocks

She is also on a rampage ACCUSING me of leaving comments on her Facebook page!! I have NO idea what she is talking about, but I REFUSE to let someone accuse me of things I DID NOT do!! She has yet to provide any proof of this, everything she says is "hearsay" since she will not provide a print out of the "so called" comments left on Facebook! No link no nothing to back up her claims!! She on the other hand has a LONG history of very unhappy buyers and she leaves them NASTY feedback in which she calls them names, degrades their knowledge of technique in jewelry making, the list goes on and on... here is a link to her feedback for her buyers........

http://www.etsy.com/people/FabulousRocks/feedback?type=for_others

That is all the proof you need to conclude this seller is not professional in any way, and that she has MANY unhappy buyers who have had the same experience I have. My goal is just to warn people that she is not a "reputable" seller and abuses the feedback system on Etsy strictly for retaliation purposes! talk about adding "insult to injury"- Buyer Beware-

#1 REBUTTAL Owner of company

FabulousRocks rebuttal to Libel Claim

AUTHOR: FabulousRocks - (United States of America)

POSTED: Wednesday, January 09, 2013

I am the co-owner of FabulousRocks.etsy.com and am responding to the egregious lies one of our buyers is spreading on the internet.

She is committing libel against our company (which is against the law) and we are seeking legal action via court orders and cease and desist demand against her at the moment as well as financial compensation for any current and future losses in our business due to her libelous claims.

We have had over 80,000 orders and a 100% feedback review for over 40,000 items sold from thousands of buyers.  We have sold hundreds in thousands of these rough diamond nuggets over the last few years, and have received very favorable feedback to this product.  Only buyers who are not aware how small 2-3 mm can be nor know what appropriate wire to use this product with have been dissatisfied about this product.

We always try to work out issues with orders with customers.  However, rude, lying, threatening, harassing, or foul mouth individuals do not get our attention.  This buyer proved to be all of them.

The buyer, bought some rough diamonds from our shop during the Christmas season.

She was not happy with the size she got, which were clearly in the size range we described for the item, 2-3 mm.. some a tad smaller, some a tad larger.  Never did we state they would be in the full range of 2-3.  If she had questions, she could've easily asked us prior to ordering or if dissatisfied with her purchase, she could've returned it for a full refund.

The buyer in her feedback even verified the diamonds were within the range stated.

She however chose to leave damaging feedback.  We in kind left her feedback as a means of rebuttal .. similar as I am doing now and have every right to do so.  We did send her an email informing her:

"sorry to have to leave you negative feedback.

i am sure you would appreciate a buyer working with you before leaving you feedback.. and we never take kindly to buyers who neglect to do so.. ESPECIALLY those who also sell here on etsy

unfortunately it has impacted your rating"

This email plainly apologized for what we had regretfully did, why we did it (she did not bother to contact us to see what we could do to help her) and told her unfortunately the impact to her feedback rating.

We got back multiple emails threatening harassment via the internet:

" I will spend every day ALL day spreading this message outside of Etsy to warn people about the kind of person you are and how you do business!!!!!! Fortunately, I have an endless amount of free time to devote to this NASTY e-mail from you. I am contacting Etsy right now and then I have many other sources outside of Etsy to contact- " and

"I will be HAPPY to spend ALL day spreading your nasty e-mail outside of Etsy....google your shop in a few days..hahahahaha! "

This report is one of the her internet libelous reports.  In this report she lies over and over:

1) claiming I described the item as "being bigger than it actually was" rebuttal: not true, as you yourself confirmed in your feedback it was within the RANGE we listed the item

2) is is not "a precious stone".. "just a common stone".

rebuttal: she has NOT PROVIDED a gemologist report to verify anything.  rough diamonds are PRECIOUS gemstones and DIAMONDS that are organic, uncut diamonds.  often very included and not able to be sold as a fine diamonds they have a "drusy" surface appearance that is much like you see in agate or quartz geodes.  they are DIAMONDS.  we also sell drusy AGATE gems on our site.  the two are NOT THE SAME.

3) claims we "went on a rampage of nasty e-mails", stating we called her a "nobody", "self absorbed", that we threatened to get her "shop kicked off Etsy" if she reported me.  I would like to see where I stated these and not out of context either.

rebuttal: what I wrote was:

- "negative feedback from NASTY, bitter, "all about me" self centered types don't bother us.. as we have only had about 50 or so such customers who make up those negative feedbacks.. so welcome to that club!!"

in her case, she was nasty, lied, and threatening daily harrasment.

- "and yes.. your threats now put in writing will certainly give us the ability to report you to Etsy and get you kicked off.. as their policy clearly does not allow that."

per Etsy policy, members are not allowed to threaten other members.  Etsy has the discretion to remove a shop, which we have requested they consider in light of this matter.

- "but trust me.. I don't worry about a petty little person like you.. unless you think you influence the world.. get some perspective on who you think you are.. too funny!"as well as "if it mattered at all we would not be the 26th LARGEST ETSY SELLER in so short a time, so go spend your time so wastefully.  i feel sorry for someone who has nothing more important to do with their life :)

go volunteer, help a child, do something productive with your life.. what a bitter nasty attitude to have.. but you control how you waste your life.. so again.. DO WHAT YOU NEED TO DO LADY!"

in response to her repeated threats to spread us all over the internet.

as for the supposed rampage, I answered her every threatening email, many of which I have quoted above.  i told her several times to use her time more wisely rather than rage so uncontrollably and informed her honestly of consequences to her actions.

she has also in other settings claim we are "harassing her" when in fact I think her threats beginning with her first email to us is proof of her harassing us, with us responding to her as politely and truthfully as we could.

4) "if you end up unhappy with your purchase, Linda will come after you and try to ruin your business or reputation on Etsy.  Buyer Beware.. "

rebuttal: matter of fact, I think it goes the other way.  I never once took this to the Etsy community except on sites to where she has posted that I now need to put in rebuttals, as here on ripoffreports and also on http://etsycallout.wordpress.com/2011/03/31/fabulousrocks-riverofromansk/#comments

she however:

- threatened to spread news about our shop on the internet (there were over 10 libelous claims on the internet the day after her threats)

- did in fact followed through with commiting her internet threats to damage our reputation and affect our business

We are now pursuing legal and financial action against her with:

- Etsy

- Paypal

- Arizona libel attorneys with lawsuit on renumeration on current and future financial losses

- court orders to all the websites to which we suspect all 10+ libelous postings occured (Facebook, here, reviewstalk) to get identity of member who created postings.. as all were done under fake names.

Unfortunately this individual has overstepped all SANE, RATIONAL and LEGAL methods in resolving something that involved a $12 order and feels the need to damage a business that we have built up with so much sweat, hard work, and financial sacrifice.

If anyone needs additional information re: this matter, please contact us via email at:
