A young student came to my door selling magazines, claiming that it is a competition whereby they earn a certain number of points towards each purchase, and I believe I was told that they could win a trip if they are the top sales rep.
An alternate website they provided to me was www.travelworkplay.com , and from that website I got the following phone #: 1-888-741-2190. When trying to call that number, I get a message that states all reps are busy and my only option is to leave a voice message, I have never been in direct contact with a person at that number. This website claims to be a direct marketing company which "...enhances the public speaking skills of each sales rep., helps them to become more confident in their ability to engage in conversation, and strengthens their communication skills that can be implemented into any business situation. [continued below]....
....." I personally think it actually teaches these kids to participate in fraudulent business transactions.
Their cancellation policy requires a three day post-marked cancellation notice in writing. I fully complied with their terms of cancellation, and of course I sent my cancellation request via certified mail as documented proof. Their return policy indicates that if my cancellation request is received prior to their depositing my payment, they will return my original check to me. This did not happen, and I have documented proof of my deposited payment, my cancellation request sent via certified mail, etc. in addition to other correspondence sent via certified mail requesting the status of my refund request.
I have a documented proof from my bank of the cleared payment, evidently deposited AFTER my cancelation notice was received. I signed the contract on 7-14-09. I mailed my cancellation request postmarked 7-15-09, FTFT signed for it on 7-17-09. I have made numerous calls to them at the number on the contract (area code 303), only to be given the run around. The explanations given are that they are still looking for my information, there was a hold up, they are behind with returning payments, etc., etc. As recent as 11-09-09 I was told they are putting my request through as a priority, and as of today 12-04-09, I was told once again that they are looking for "confirmation of deposit" which in fact I mailed to them back in July.
At that point, I threatened to file a report with my bank regarding an unauthorized deduction from my bank account, which technically is TRUE given that I followed their cancellation policy in accordance with their terms, they should not have deposited my check after they received my cancellation notice.
I asked to speak with a manager today, and a person by the name of Donna got on the line, was very rude to me, cut me off mid-sentence when I told her I would proceed to file a complaint with the Federal Trade Commission and The Better Business Bureau, along with filing a report with my bank regarding the unauthorized deduction. She then proceeded to tell me that a check was cut on 11-13-09 for the amount of my refund, check # 2470, and that it would be mailed to me today, and then she told me to have a great day and hung up on me. I won't hold my breath awaiting my refund, and I WILL proceed with my complaints to third parties as specified.
Keep in mind these are long distance phone calls which I am paying for, not to mention the money I have put forth for the certified mail correspondence. Today, when I asked to speak to a manager, I was put on hold in excess of five minutes.
Their cancellation policy is as follows, verbatim:
"You may cancel this transaction without penalty, providing your cancellation form is returned with a postmark of no later than three days from the original date of sale, including Saturdays"
"If you cancel, any negotiable instrument executed by you will be returned within ten business days following the receipt of your valid cancellation if it has not previously been deposited. Otherwise, please allow 4-6 weeks for refund after proof of payment has been provided. Proof of payment must be provided within 6 weeks of the original date of sale; if not provided, allow 150 days for delivery of your subscription. To cancel this transaction, mail a signed and dated copy of this cancellation notice to: Face to Face Technologies, Inc., PO Box 1060, Kittredge, CO 80457. This must be postmarked no later than three days from your original date of sale, including Saturday. .... I understand that if this order is canceled for any reason, the solicitor will not receive any trip or contest points. Verbal agreements not recognized. No refunds shall be made after the cancellation period expires." An email address was also provided along with a long distance phone number.
Interestingly, in small print on the front of the contract it states, "*IMPORTANT NOTICE* No verbal agreements recognized. No post-dated checks; CHECKS DEPOSITED IMMEDIATELY ." Why is this interesting? Because this is their disclaimer that they will not be returning your original payment, in spite of what the "cancellation policy" states above. They further proceed to indicate that, "All returned, canceled, insufficient fund or account closed checks will be subject to a minimum service fee of $20.00."
The cost for three magazine subscriptions was $183.00. Not worth it, and not even high end periodicals at that.
I am willing to participate in any class action lawsuit or legal action against this organization, if that should occur.
