This Company has tore the heart out of my whole family's life. I bought my house for 107 thou back in 1998. They as of this date have added 50 thousand more. They can't give me any reason why this charges were added.Even when I tried to get a refinance from other companies everbody saw my credit report and backed away after seeing the forcloser.

Everybody would think that I was lying about how I shouldn't be that much behind, Fairbanks saids that I am 2 years behind in payments. I have sent them 8 thousands dollors at once in a banker check. I have also sent them 5 thousand dollors another time in a bankers check and they told me that was only going to my interest. I couldn't believe all the stories that I read on this site it the same stories that I have.

How to Stop the Foreclosure Sale ..ONCE A COMPLAINT IS FILED FURTHER FORCLOSURE ACTION ON YOUR PROPERTY IS ILLEGAL. Beware though, as usual, they are lax on follow up.

AUTHOR: Amanda - (U.S.A.)

Walt, I'm sorry to hear you also have been victimized by Fairbanks.

Here is how to stop the sale, be diligent...

per the Real Estate Settlement Procedures Act (RESPA), you must file a "qualified letter of dispute" regarding the erroneous fee's & resulting foreclosure actions. The URL below will bring you to HUD's info on filing RESPA complaints.

Fax your complaint to:
Mr. Greg Harmer, Fairbanks Capital General Counsel
Fax# (801) 293-2555,
his phone # for follow up is (801) 313-2173, you may want to send him an email to let him know it's there (GregH@FairbanksCaptial.com).

BE SURE TO PRINT YOUR FAX CONFIRMATION REPORT, be sure to include your supporting documentation.

Below the HUD/RESPA info I have included possible text for you to consider.

http://www.hud.gov/offices/hsg/sfh/res/resp2605.cfm

ONCE A COMPLAINT IS FILED FURTHER FORCLOSURE ACTION ON YOUR PROPERTY IS ILLEGAL. Beware though, as usual, they are lax on follow up. Call your county clerk of courts & assure the sale has been cancelled.

Request immediately a Payment History going back to the origination of their servicing of your account. Have your checks out & match up dates that the checks cleared as opposed to when they were posted by Fairbanks. Prove that they have snowballed the fee's due to their processing delays & protest with all your might.

ALSO... be sure to register a complaint w/ your state Attorney General, with HUD (hotline@hudoig.gov) AND with the Federal Trade Commission (LMorris@FTC.GOV). Send copies of your complaints & a plea for help to all your local TV stations, Newspapers & radio stations.

From here it's all in how you handle it. BE CERTAIN to address PROPER & TIMELY restoration of your credit reporting as Fairbanks is infamous for not following through on that either.

AVOID PHONE CONVERSATIONS WITH THEM. GET EVERYTHING IN WRITING. & let us know how it goes.

RE: RESPA QUALIFIED WRITTEN REQUEST, COMPLAINT, DISPUTE OF DEBT & VALIDATION OF DEBT LETTER & TILA REQUEST

Dear Madam or Sir:

I am writing to you to complain about the accounting and servicing of my mortgage and my need for understanding and clarification of various charges, credits, debits, transactions, reversals, actions, payments, analyses and
records related to the servicing of my loan from its origination to the present date.
To date, the documents and information I have, that you have sent me and the conversations with your service representatives cannot answer my many questions.

It is my understanding that your company has been accused as engaging in one or more predatory lending and servicing schemes. As a citizen, I am extremely concerned about such practices by anyone, let alone my own mortgage company
or anyone who has held a beneficial interest in my loan. I am concerned that such abuses are targeting the uneducated and uninformed consumer and disadvantaged, poor, elderly and minority Americans.

Needless to say, I am more concerned as a borrower. I am worried that potential fraudulent and deceptive practices by unscrupulous mortgage brokers; sales and transfers of mortgage servicing rights; deceptive and fraudulent
servicing practices to enhance balance sheets; deceptive, abusive and fraudulent accounting tricks and practices may have negatively affected my credit rating, mortgage account and/or the debt or payments I am legally obligated to.

Because of this, and other reasons that leave me to believe that I may be a victim of predatory loan servicing, I am disputing the validity of the current debt you claim I owe. By debt I am referring to the principal balance claimed owed;
my calculated monthly payment, calculated escrow payment and any fees claimed to be owed by you or any trust or entity you may represent.

To independently validate my debt, I need to conduct a complete exam, audit, review and accounting of my mortgage loan from its inception through the present date. Upon receipt of this letter, please refrain from reporting any
negative credit information [if any] to any credit reporting agency until you respond to my requests.

I also request that you kindly conduct your own investigation and audit of my account since its inception to validate the debt you currently claim I owe. I would like you to validate this debt so that it is accurate to the penny!
Please do not rely on previous servicer or originator records, assurances or indemnity agreements and refuse to conduct a full audit and investigation of my account.

I understand that potential abuses by you or a previous servicer could have deceptively, wrongfully, unlawfully and/or illegally:

Increased the amounts of my monthly payments
Increased the principal balance I owe;
Increased my escrow payments;
Increased the amounts applied and attributed toward interest on my account;
Decreased the proper amounts applied and attributed toward principal on my
account; and/or Assessed, charged and/or collected fees, expenses and misc. charges I am
not legally obligated to pay under my mortgage, note and/or deed of trust.

I want to insure that I have not been the victim of such predatory practices.

To insure this, I have authorized a thorough review, examination, accounting and audit of my mortgage loan #XXXXXX by mortgage auditing and predatory lending experts. This exam and audit will review my mortgage loan file from the date of my initial contact, application and the origination of my loan to the present date written above.

As such, please treat this letter as a Qualified Written Request under the Real Estate Settlement Procedures Act, codified as Title 12
2605 (e)(1)(B)

(e) and Reg. X 3500.21(f)2 of the United States Code as well as a request under Truth In Lending Act [TILA] 15 U.S.C. 1601, et seq. RESPA provides substantial penalties and fines for non-compliance or failure to answer my questions provided in this letter within sixty [60] days of its receipt!

In order to conduct the examination and audit of my loan, I need to have full and immediate disclosure including copies of all pertinent information regarding my loan. The documents requested and answers to my questions are
needed by my self and my experts to insure that my loan:

Was originated in lawful compliance with all federal and state laws, regulations including, but not limited to RESPA, TILA, Fair Debt Collection Act, HOEPA and other laws;

That any sale or transfer of my loan was conducted in accordance with proper laws and was a true sale of my note;

That the claimed holder in due course of my promissory note and deed of trust is holding such note in compliance with State and Federal laws and is entitled to the benefits of my payments;

That all appropriate disclosures of terms, costs, commissions, rebates, kickbacks, fees etc. were properly disclosed to me at the inception of my loan;

That each servicer and/or sub-servicer of my mortgage has serviced my
mortgage in accordance with the terms of my mortgage, promissory note and/or deed of trust;

That each servicer and sub-servicer of my mortgage has serviced my mortgage in compliance with local, state and federal statutes, laws and regulations;

That my mortgage loan has properly been credited, debited, adjusted,
amortized and charged correctly;

That interest and principal have been properly calculated and applied to my
loan;

That my principal balance has been properly calculated, amortized and
accounted for;

That no charges, fees or expenses, not obligated by me in any agreement,
have been charged, assessed or collected from my account;

In order to validate my debt and audit my account, I need copies of pertinent documents to be provided to me. I also need answers, in writing, to various servicing questions.
