I am filing a law suit for ot worked, and not paid over a 6 month period with this ridiculous company. I was wrongfully terminated, although they have yet to tell me, they are telling the remaining employees. They have me on suspension (indefinitely), and will not return my phone calls about it. The DM is a coward, who is afraid to face me, because he KNOWS things went down wrong. He is gender biased, and discriminating. I am going to persue a defamation of character suit, and back ot in the amount of approximately $10,000.00. Does anyone care to join this? I know there is one person on here who posted on 11/6, but don't know how to get ahold of them.

Loss Prevention was involved, and there were accusations that were simply not true. Check this out; 6 days after they "suspend" me, my apartment building was broken into, and I was robbed. Is this coincidence, or are they angry because I am fighting this?

Do not shop at Family Dollar. Let's work together to end these games. They are using their managers to clean up the stores, and then trumping up reasons to get rid of them. What reasons, and I mean legitamate reasons could they have when someone like myself getsd sales up 20-25%, in 3 months, gets customers back who swore they would never return, fires all of the employees who were stealing from the store previously, and gets the store to #1 in the district after taking over when it was #22 out of 22?

Let's get as many managers together as possible, and get them for all of the overtime we can. Count me in.

Let's sue

AUTHOR: willie - (United States of America)

I worked for Family Dollar as a store manager for almost 10 years and am well aware of their unjust policies. I stand with you 100%. I have 10 years of wrongful doing by this company under my belt. It is time for the public to made aware of the practices that have help make Family Dollar a billion dollar industry at their employees expense.

Is there a such thing as Salary Managers??? LOL

AUTHOR: Golddustwoman - (U.S.A.)

I have read this over and over, and it just comes to show you that htese companies are really a five and dime place. They even treat and pay the employees this way. What has gotten them in this lawsuit, because they were salaried, they would not get overtime, BUT, you can tell your lawyer that The Company MAKES ALL store managers clock in and out on a register for a time sheet, that they HAVE to sign inorder to get their check, """"they state it is because of worker comp reasons"""""""""", they even have to clock out for breaks etc.. when you read on what (is in their Handbook, strand books) that ONLY HOURLY PEOPLE ARE CLASSIFIED to clock in and out. Something about being an exempt, or non exempt, they found the loop hole in this and yes it does take a long time, all f this does, BUT I ahve seen real major companies make ton more than family dollar have to pay all that is owed.... Yes, there are some good managers and asst. managers in all companies, BUT so many are blind folded to who and what bad a comapny can do.I am so glad to be out of that slave camp, and the old store i had, has been a major disaster since me ans some of my crew have left, they had corp visit, not long ago, and they demanded(not just seeing my old store but 11 other stores) the regional to fly in and terminate the DM,I know this for a FACT, when you do people wrong and bre4ak the law, sooner or later it will be exposed.. I hope all that have been burned by this immature company will DO BETTER!

#4 UPDATE Employee

It's the same...................

AUTHOR: Julia - (U.S.A.)

I have been a manager for almost six years and my district is right near charlotte headquarters. We have visits constantly. When I started with this company our check stubs stated 96 hours. Now they just say salary. Our vacations are based on 48 hours and we work more than that. Not fair I say.

I know of 2 complaints that are being investigated by the EEOC and it has been over a year since this was filed. Not only will Family Dollar drag it out, it could take years. They have the money not to mention the lawyers. As far as the lawsuit which was ended or so you think for 30 million. It is in appeals. No one has received a dime as of yet.

The staff scheduler is not fair. It has managers clocking out for breaks and they are the only members of management on duty and by policy can not leave the store. I don't mean to babble but this is what this sight is for.

The lawsuit is basically this...We as managers are paid salary because we ultimately are responsible for the success of our stores. We can hire and fire, make decisions, and control our buildings.(per FD)but the reality is we have no control.........they stated in a pr release that we managers accasionally stock and run the register that we basically do office duties. That is not so right now in my district we are not allowed to hire or fire anyone without paper trail and the permission of the DM.

According to the lawsuit that was filed this should make it so we are not classified as salary managers. Assistants that get paid hourly do the exact same job as managers. I think there should be a cap on how many hours we pull. Every year more task get put on us with no more payroll.

If you take the managers salary out of stores you will find that you are running stores on 3 and 4% which is not fair I say again. I have not had a raise in three years not because I have not earned it but because we have been through 4 DM's during that time and everytime I find myself having to prove myself once again.

I'm not perfect but I do run a good honest store. We strive my crew and I to do our best. Then when I think I will get a raise we get a new DM. If a DM tells you something get it in writing cause if you don't, when they leave so does any promises they may have made.

I stay because I like people. I have a family to support and that allows me to suck it up. I wish you the best of luck to you and yours. By the way not that this matters I have had about 5-6 stores since coming on board with FD.

#5 UPDATE EX-employee responds

you can count me in

AUTHOR: Doris - (U.S.A.)

I worked for FD for 4 years, three of those as store manager. I never received the managers training, other then the strands completed. I had to get most of my training over the phone. I worked an average of 65-70 hours a week. I next to never failed to do my weekly reports on time. Showed a steady sales increase, without killing the payroll they give us.

I scored better then most of the other stores in the district on anytime 5's. Last but not least , I took a diverted truck, from New Orleans and additional 2300 boxes of freight. I received no extra payroll to work this out, nor any extra pay for the time put in to control it. I do have pictures of this. Do I feel I am owed some additional compensation, yes. I also would like to include FD stole a vocation day from me, and still owes me severance pay, when my father passed on. Instead of severence pay they used my vocation pay.

Well the bottom line is , I would be willing to talk to your lawyer on behalf of past and current salaried managers everywhere. I am not sure how to get in touch with you. Other than note your lawyer has my consent to notify ripoffreport for the apprioate contact information.

#6 Consumer Suggestion

Good Luck & Godspeed

AUTHOR: Russ - (U.S.A.)

Joseph-I empathize with your plight. I spent 6 weeks with FD a couple of years ago. The store was located in a poor section of town, and the challenges were vast. However, while the staff and management (me and two others) made huge progress in a short time, we were constantly berated by the DM because we weren't meeting the "anytime 5" standards.

I knew there were going to be huge problems when I refused to come in on my day off. Th last two weeks of my short tenure were filled with dread and loathing for a company that used slogans like "Hooked on Fun" and "Team-Friendly Environment".

When I left, I felt pounds lighter. I didn't wish to pursue any legal action, I simply wanted out. Sad to say, many others have come into FD, and many more will follow.

Good luck in whatever litigation you may pursue. But the best solution, I see, is get a better job, live a better life, and if you do get a settlement from FD, call it good fortune and spend the money freely and frivously.

Thank you for your reply...

AUTHOR: Joseph - (U.S.A.)

Thank you for your reply. I have all of my paystubs, and have an attorney already looking into the issue. I know there are alot of managers with this company who are very over worked, and mistreated. As a experienced manager, you DO go into a job with a positive mental attitude, and excitement. You do not expect things that happen that are out of your control. I have still not been notified of my termination. I am on a "indefinite " suspension. The DM has not called me, nor his assistant. The DM has infact talked to the people in the store. I feel that he knows he has made a huge mistake. I have gotten sales up, and brouoght business back to this drug riddled, prostitue infested neighborhood. I gave the customers a sene of security to come back.

Anyway, all of my ducks are in a row, and I know that there was a lawsuit with them not too many years ago and they had to pay 30-some million in overtime to the managers. It's not about millions. Trust me, i would have no idea how to handle that. Way too much money. We are looking at about 7400.00 Nothing earthshattering. I am not a sue-happy person.

I have been in court once in my life, and was so nervous it wasn't funny. It is the principal. Money was an issue for this relationship from the beginning. I figured if I took my chances, and did good by the guy, the money would come. It didn't, and things happened.

I appreciate your advise, and will make sure I take it to heart. I have already begun contacting the proper departments. Thanks Again,

Joe

Some Questions

AUTHOR: Russ - (U.S.A.)

Were you hourly or management? In general, salaried employees are not paid OT, and that is made clear when people are hired as managers.

What is your proof? Do you have paystubs?

Have you spoken to Wage and Hour, or the state Department of Labor?

If you sue, are you prepared to wait anywhere from six months to five years? Litigation takes a lot of time.

Finally, can you prove your allegations?
