From 9/21/2004 until 10/15/04 Fifth Third Bank has STOLE $892 from my checking account! Unbelievable! I had 35 dollars in the bank, the next day husband and myself used out ATM/Debit card 4 times. It caused our account to be overdrawn. Did they stop letting us use the ATM/DEBIT????? NO NO NO NO NO. And the next day, when we made a deposit, did it cover the amounts of the ATM charges plus the $126 in fees?? ( $120 for the fees, $6 for the daily fee) NO NO NO NO.

So what happened the next day, we went for groceries and paid the gas bill, also stopped for gas, and lunch. Guess what happened the next day, more overdraft fees for the prior days transactions, that we had no idea were not covered. Did I know this when I paid the electric bill, went to the ATM for $20 in cash and the cable bill and water bill cleared??? NO NO NO NO. Next day more overdraft fees and daily overdraft fees. It's adding up fast now. Any mail on this problem??? NO NO NO NO. Just happened to check online this day and found that we were $823 OVERDRAWN and get this, the ATM machine let me have $50 out today!!! More charges on Monday!!!

This is the 21st Century, and they have scanned copies of your checks online. If there is NO money in the ACCOUNT I have only one question??? Why do you let me get the money I don't have out of the checking account that is in the red over $800? I know why, more fees to add to the account on MONDAY!

Next question, how many BILLIONS of dollars a year do YOU Fifth Third Bank make this way each year???????

This is pure and simply LOAN SHARKING under the guise of FIFTH THIRD BANK.

I would like to know what agency I (we all) need to contact to bring legal litigation?

Taking money from an unfunded account is theft. You continued to withdraw knowing the money was not there. How can you blame the bank? You should thank them for not filing criminal charges against you. Grow up.

I have read all the posts to this column and there appears to be a consensus among some that people who pay overdraft fees are too stupid to maintain their own accounts. As a former customer service representative for BB&T, I can ensure you that is not true.

I have had to deal with some very intelligent people who were subjected to overdraft fees who could easily see right through the schemes that banks use to take their customers' money. Another person also stated that only people between 17 and 22 were naive enough to overdraw their accounts. That is also a myth.

I had to deal frequently with hundreds of elderly people whose only income was their social security check who also saw their savings wiped out by NSF charges.

Someone also stated that if one keeps track of their account and never spends more than they have in the account, they will never get an overdraft charge. That is also a myth. Banks deliberately set traps for people to fall into in order to get those NSF fees.

Personally, I don't keep my money in a bank. I use a credit union. The difference between a bank and a credit union is that a bank is owned by its stockholders.

A credit union is owned by its member depositors. Generally, a bank serves its stockholders, not its accountholders. There are however a few smaller banks that are more inclined to look after their customers, but unfortunately, those banks are not as solvent as those bigger banks that profit from excessive fees. The number of smaller customer-friendly banks is dwindling as they are being bought out by bigger banks.

If you have your money in a bank, that bank's primary interest is to make money off of you, plain and simple. Don't expect the bank to look out for you. They are in it for themselves and their stockholders, not for you.

In these times of low interest rates, banks have had to come up with more creative ways to get that non-interest income they need to remain solvent and avoid getting bought out by bigger banks. So the only real solution if you want to keep your money is to either get your money in a credit union (if you qualify), otherwise, you have to be smarter than the bank and avoid the traps they set.

Based on the situations I have seen among the customers I served while I was providing customer service, I can make a few suggestions.

If you use a debit card, be careful where you use it. Never use a debit card to sign up for an online service such as AOL. AOL usually promises that the first month of service is free, but what a lot of people don't realize is that AOL places a hold on the debit card in the amount of one month's service from the moment the online service is requested.

So even though AOL doesn't take the money out right away, the hold is still there and it stays there for three to five days before it drops off. But during that time, if that hold causes your account to have a negative available balance, you are going to pay NSF fees.

All too often, customers would call me asking why their account was overdrawn and the first thing I would do is look for a charge of $23.90 or $28.90. If I found one, I would ask the customer if he/she was aware that AOL had a hold on their account.

Most of the time, the customer would be unaware that AOL had placed a hold on their account, thinking that they didn't have to worry about accounting for that charge until a month later.

I would also recommend avoiding using the debit card at a merchant if there is any chance that the merchant might accidently key in a wrong amount.

Many people think that when a merchant makes an error and then corrects it they have nothing to worry about. But if a merchant accidently rings up a 10 dollar purchase as 100 dollars, even if the merchant cancels the 100 dollar transaction and then processes a 10 dollar transaction, there is a good chance that there will be a 110 dollar hold placed on the debit card.

Most of the time, the 10 dollar debit will process before the 100 dollar debit hold drops off. This causes problems for the customer who thinks he/she has 100 dollars more available than the bank says he/she has. Of course this situation is profitable for the bank since it gives them an excuse to charge NSF fees.

I would also recommend that accountholders never let their accounts go below $100, because when they do, that is asking for trouble. Banks profit off of people who walk close to the edge between positive and negative balances.

If you get too close, the banks have ways of pushing you over the edge. The debit card is a primary tool that banks use to accomplish that. An even better safety precaution is to always maintain a balance larger than any of the checks you deposit.

If you have $50 dollars in your account and then deposit a $100 dollar check, it would be best not to touch that account again until that $100 dollar check has cleared. Banks customarily place holds on some checks either until the check clears or until the bank decides to take that hold off.

The customer may think he/she has $150 in the account, but according to some banks, that customer has a negative balance of -$50 until the bank takes the hold off of that $100 check.

I could make many more suggestions but I am afraid I may be running out of space. The bottom line is that you have to look out for yourself and be smarter than the bank, because the bank is not going to look out for you as long as they can make more money by not looking out for you.

they will let you use the atm

Every time you use your atm/debit card the information goes to a card reader. The card reader only updates once a day at midnight---so if you had a balance at midnight last night of $300, but you have pending transactions from today, to that card reader you have enough in your account to cover that transaction. I know this doesn't help your situation but the only way to protect yourself is TO CHECK YOUR ACCOUNT BALANCE BEFORE YOU MAKE A TRANSACTION. check your available balance as often as possible. It is not the banks responsibility to inform you of your balance before you initiate transactions. Your account disclosures state that if you overdraw, there will be a fee. Enough said.

5/3rd=No Customer Service the worst, hands down

I just want to interject my thoughts on 5/3rd, for what's worth.

We had our mortgage thru a bank called Citizen's Federal in Ohio. Cit-Fed was the actual mortgage company. We never had any problems with them for the first 3 years of our loan. Well, 5/3rd bought out Cit-Fed. At first, we were concerned. We didn't know this company, but since the first 6 months were smooth sailing, we thought we didn't have to be concerned. Wrong!

The problems started when they told us to mail our payments to Cincinnati, versus paying them at the Dayton branch. We were always a payment ahead, just in case something happened and we needed more time. We were never late. Once we began mailing our payments to Cincinnati, things got crazy. We made the May payment around April 20. We made the June payment on May 10. You see the pattern. All our payments had the payment coupon that THEY provided, with the date clearly marked as to what it was for. We marked on our checks, in the memo section, what month and year they were for along with the account number. We received a letter in July asking us where our payment for June was. I called customer service, explained we had made the payment May 10, it was processed from our account on May 16, so I didn't understand what was up. They apologized, told me it was a mistake and not to worry. I took the cancelled check to work and copied it and sent the copy to the same address we mailed our payments to, along with a letter saying here was the copy, please let us know in writing all was ok. We received a phone call from the Cincinnati office a week later, telling us they got our letter, all was fine, and not to worry, but never ever got a letter. I was worried by July, so I went to the local branch to get a copy of our payments. Of course, they were so nice to me, took me into an office that looked like no one ever used, and brought in a printout. They showed me four months worth of double payments on our account and that we were four months behind!!! I thought I was going to be sick. I called my husband and told him to get over to the branch right away, and to bring the reciepts. I told them I would be back, and went two blocks down to our bank where our checking/savings were to get printouts from them. I met him at the branch at 4:30pm, and it was listed on the door as the lobby being open until 5pm.

The doors were locked but people were in the bank. I walked around to the drive thru and asked them to let us in, as we needed to speak to them about our account. The teller said the lobby was closed. Of course, I was about to go nuts, but decided we would just go at 9am the next day. We went home, went over everything to make sure we were right, and were confident that we would have this taken care of the next day. We show up at 9am, no one wants to help us, but we finally get the Assistant Manager to help.

We go over everything, and she sits and nods, never makes notes, never logs on the computer, and tells us that we need to go to Cincinnati mortgage office. That was it. We went home, called some friends and family, and found another mortgage lender to go with. We were not going to drive to Cincinnati to straighten our THEIR mistake.

Needless to say, we found a great company, but the day of our closing, we were having trouble with the pay-off balance. 5/3rd couldn't make up their mind as to what was owed, what was paid, etc. We had to cancel the closing. Why?

Because we owned 2 lots of property and we found out, at closing, that only one had taxes paid on it! Sickening isn't it? We had to call an attorney to get all of this straightened out, and when we finally went to closing the second time, we had to sit for almost 3 hours as once again, 5/3rd had the pay-off wrong. We were owed almost $5000 from them in the end, and they had 30 days to pay us. Guess when we got our check? On the 35th day, after we had our attorney call and threaten legal action. I know this story is long, and there is so much more to it, but I can't put it all in. Alot is phone calls I made to the Cincinnati office in which I was treated very rudely, hung up on, calls were refused, all because THEY made a mistake.

My suggestion is to call an attorney, like the local bar association in your area, and ask questions on what your legal rights are. We did alot ourselves, but since we had to get the deed,taxes, and all straightened out, we had to get an attorney. You can usually get questions answered for free from the bar association and work on it yourself. We wrote our own letters to the credit bureaus to make sure our report was correct when it came to 5/3rd due to their mistakes.

5/3rd is the worst, hands down. They don't care about their customers one bit. We were never late with a mortgage payment in 4 years, but they treated us like crap. To those who say, check your balance, check your statement, they make mistakes...yes you are right, however, they don't ever fess up when they make a mistake!! I know I make mistakes, and was willing to have THEM help us to see what was up at the branch...but did they offer to help? Nope. They didn't care.

Plain and simple, 5/3rd equals No customer service.

Good luck to you getting this fixed. I feel your pain and know that you can do this. We did it and you can too!!!!

I have to say... I'm frustrated with people that don't take responsibility for their mistakes.

For example...Debbie says,"If there is NO money in the ACCOUNT I have only one question??? Why do you let me get the money I don't have out of the checking account that is in the red over $800?"

The bank anticipates, in good faith, that you will make a deposit. I agree that the fees can snowball and can get expensive, but you need to be responsible with your account and not blame the bank for "letting you take the money". There are many ways to check your account status, as opposed to just assuming the account status, especially if you can't or don't accurately keep track of it.

And why is it that people always immediately turn to "legal litigation" or a "class action suit"? It is all legal, believe it or not. The clearing of the largest items first, the charging $30 per item against an overdrawn account, etc.

Banks are in a business. The fees you pay, the interest you pay on loans, along with all the negatives (such as a charged-off checking account, fraud,interest payable, etc.) all result to one thing: Is the Bank profitable? These things all effect the bottom line, which the Bank's executives strive so hardly to make a positive number. There is nothing that will change that fact. The only thing you can do is protect yourself: Balance your checkbook, don't use the debit card if you have a problem tracking the transactions, get overdraft protection... it all saves you a lot of money, time and frustration!

Another Irresponsible or Deliberate Act of Fifth Third Bank.

Yesterday I was notified again by another person who had a check returned from our Business Account. This time it was the check was Stamped "FRAUD Dual Sig Reg".

Today I went to pick up the check and took into Fifth Third Bank here in Owensboro, Kentucky.

As I walked in the front counter was busy, a young man walking from behind the counter into the lobby, crossed the lobby and entered a corner and extremely sparse office.

Two other glass front offices were empty. A third had an older couple speaking with a gentleman. The sign beside the door said Securities. I guess the couple was purchasing a CD.

I stepped in the door of the young man's office and asked who the manager would be, he said, "That would be me". I stepped inside and sat in the chair across the desk from him.

I looked around at his office, his desk was clean. No work in progress, nothing. On the cradenza behind his desk were 2 framed photos. One of him and his young wife, the other of a newborn. He looked to be in his early to mid 20's.

I handed him the check and told him this account has never required 2 signatures. He just looked at it for what seemed to be an unusually long time. As if he were waiting for it to speak to him.

He then got up and said he was going to check on this. I thought he would at least pull up the account on his computer screen and check the account but he did not.

He went behind the counter and into a room just off to the right. I saw his business card holder and took two of his cards. They read, "David Tipmore, Banking Center Manager".

A minute or two passed and he and a lady emerged from the room. I recognized her as the lady who handled new accounts. She was now holding the check and went to a computer screen then made a call. I could hardly hear but I was able to hear her tell Daivd that she remembered opening this account and it NEVER had two signatures required.

I couldn't tell what was being said on the phone so I got up and went into the lobby. She was just hanging up the phone and then went to the copy machine to copy the check.

David had long turned the matter over to the lady. After she made the copy, she stepped into the lobby to speak with me. I told her about the incident a few weeks ago when this had happened before. She was intrigued when I told her that. She asked when this started. That is when I told her it was just a few weeks after the dispute with the other branch started. She seemed to know that there was a problem. Again she stated to me that she clearly remembered that the account NEVER required two signatures.

She assured me she would clear this up. She thought is was VERY strange that this had happened once, let alone twice. She also thought that is was odd, that our company had not recieved any communication from the bank if they thought someone from our company was trying to pass checks that would require two signatures.

I told her I thought someone was messing with the account, just to cause us hassles. Or as the bank would put it if I were complaining about them paying a check that would put me into overdraft "embarrassment". She did not disagree with that theory.

As I write this I do believe that is exactly what they are doing, trying to cause embarrassment to our company, but it's back firing. Our city is too small, people know us and our business and know that if something is wrong it's on the banks side, not ours. Plus it is just adding to my file of all the irresponsible, unethical and deceptive practices of Fifth Third Bank.

I asked who would put that stamp on the check. I was told that the checks were sent from Owensboro, Kentucky to Evansville, In where they encoded the amount of the checks, then they went on the Cincinnati for processing and that is where they would get stamped and returned etc.

Cincinnati, yes, the headquarters of Fifth Third Bankcorp. The presidents headquarters where I have complained. The state where the Office of Banking Institutes sent a letter to Fifth Third asking for a quick resolution to this matter. The state where I filed a complaint with the Federal Reserve in Cleveland.

I don't know, because I've been told I'm stupid and nothing but dumb, uneducated trailer trash but you think our business account is red flagged up there in Cincinnati?

I also would guess they would love for us to move that account, or try to. Since they think we could not open one anywhere else since the other branch issue and headquarters putting us on chexsystem list. I think we will just stay where we are, and keep adding to the file.

Oh did I forget to mention that when we were notified from the vendor yesterday about the check we called the bank and the girl who took care of the problem before was shocked to think this had happened again because she changed it in the computer herself. It was late yesterday and she said she would see to it today, well suddenly she is "no longer works there".

I just wanted to add that I had a situation with some overdrafts over the holiday weekend due to the atm machines being down for 2 days. Well my husband could not deposit his checks as usual on payday. He finally was able to use the machine on Friday but it was after 7 so the stupid deposit didnt clear till Monday afternoon.

Anyways 116 in fee's was assessed on my account.

I went into the bank furious as to the machines being down and not being able to deposit the funds. the lady said she would call and said no the machines were never down. SO basically she called my husband a liar and she would not recredit our fees because it was not a bank error. For all I know she was lying so she could get a bonus for stealing more money from poor middle class people. I was so Mad!! It took all I had t not chew her out, I just walked up and stated I will be closing my account as soon as I switch my ACH transactions over...

May I add that I do balance my checkbook every other day but this was atm failure.

Anyways, I just checked my statement as I did not notice how they pull things from your account. Here is the order they cleared exactly from largest to smallest 4 items. If it would have cleared the other way I would have only of had one charge!!! No I had 4 because of this. THis is plain BS... Here is the charges..

If they would have let the check clear last and the debits first there technically would have been one charge as my balance was 149.09 before these hit. Plus the deposit was in the atm at 7:30 on Dec 24 but they didnt post my deposit till Monday afternoon. THIS is CRAP and bad Business.

Well I took my money to another bank (local one) and I will not give them any more business or money, or our new mortgage we our getting.

By the way the Bank is KEY BANK and they are also known for excessive fees.

Wrong. I was a short term customer with 5th 3rd at one time, and when (yes I'm guilty of it too, but by check not debit card) I bounced a check, I recieved notice in the mail 2 days later.

I HAVE A LETTER AND THE POST MARK SHOWING IT WAS 14 DAYS BETWEEN THE TIME IT WAS DATED AND THE TIME IT WAS MAILED!

May I ask why you never called the bank to find out what was going on in the first place and to find out your current balance BEFORE making more withdraws?

WHY WOULD I? I WAS NOT NOTIFIED ABOUT ANY PROBLEM SINCE MY LAST STATEMENT!

I mean it's obvious (to most people now) that you will still get money from using your debit card even though the money's not in the bank...so why keep using it if you don't know if it's in there or not?

NOW I KNOW THEY KEEP GIVING YOU MONEY NO MATTER WHAT, GUESS HOW I FOUND THIS OUT?

Cause guess what? Keep using it, keep getting those overdraft fees.

NO SHIT! AND HOW DID YOU FIND THIS, WERE YOU SEARCHING FOR WHAT? 5/3 COMPLIMENTS? WHAT WERE YOU LOOKING FOR TO BRING YOU HERE? NOW THAT IS SOMETHING THAT SOUNDS FISHY TO ME.

I understand your situation totally. I was in the same boat (different bank) years ago, but as many have said above, if you don't keep a CURRENT record of what your account balance is, don't WHINE about when you're overdrawn. It's YOUR responsibility to know what's in your account, NOT the bank.

It just sounds kind of fishy to me. I mean, I guess you just assumed that the deposit would cover it? We're talking about US dollars here, not monopoly money. I don't know about many others, but if I found out my account was overdrawn, I'd be on the phone ASAP to the bank finding out why, so it won't happen again. When you made your deposit the next day, did you NOT get a reciept? I know for a fact that everytime you make a deposit, beit via ATM or whatever, it will show your balance.

I mean it's obvious (to most people now) that you will still get money from using your debit card even though the money's not in the bank...so why keep using it if you don't know if it's in there or not? Cause guess what? Keep using it, keep getting those overdraft fees.

Hindsight is 20/20, but I'm sorry, you should have had enough common sense in the beginning to STOP USING THAT ACCOUNT AND cut your losses to a minimum. You say you used the ATM right outside the bank...why did you not go inside and check the balance first? Heck, EVERY atm has it where you can check the balance right there without making a deposit/withdraw.

You kept using the card...even though you thought the money was in there when you made those additional purchases the following day, YOU NEVER WENT INTO OR CALLED THE BANK to make sure it was. Let this be a lesson learned. NEVER ASSUME ANYTHING, ESPECIALLY WHEN IT COMES TO YOUR MONEY.


I really hope you're between 17-22. I'd hate to think someone older than that is this naive when it comes to banking. Either way, as others have said, you've learned a very valuable (and expensive) lesson. Good luck.

Should have Real Time Banking!

In an effort to provide real-time information and payments processing, banks are examining if legacy systems are standing in the way of true straight-through processing. But, the obstacles to providing information on accounts and processing payment transactions in real time may have little to do with legacy systems, analysts say.

In a session at the October Sibos conference in Atlanta, bankers discussed the possibility that excess data contained in legacy systems could be preventing the realization of real-time payment transactions and information. But Susan Feinberg, senior analyst, wholesale banking, at TowerGroup (Needham, Mass.) thinks differently. The lack of real-time or straight-through processing of transactions has more to do with banks not wanting to deliver more timely information, she tells BS&T.

"It's not the systems, it's the bankers," Feinberg asserts. "It is the attitude toward real-time information. The fact that there was a debate is amazing to me in this day and age because we are talking about payment transactions that increasingly are - or should be - processed in a straight-through manner. Those payment transactions and that information should be available to customers when they need it, on demand - not when the bank might want to provide it."

Importance of Real Time

During the Sibos session, global bankers agreed that real-time processing is more important now than ever before. The extension of the settlement day is one industrywide change that has increased consumer demand for real-time information, said Richard Pattinson, senior director, settlement strategy and systemic risk, Barclays Bank (London).

The Clearing House Interbank Payment System (CHIPS) extended the hours during which transactions can be settled globally. In May, CHIPS began processing transactions at 9 p.m. for payments valued the next business day.

"CHIPS and the Fed have extended hours so that transactions are being processed in hours that overlap with other geographical markets, and clearly the reason for that is because of the increasing" demand for real-time processing, TowerGroup's Feinberg says.

Not Now, Right Now!

The transactions need to be processed and available for customers who are waiting for funds when the customers want them - not when the bank is ready to provide the funds, according to Feinberg. "These transactions are increasingly processed by the most successful organizations in real time," Feinberg says. "They need to be processed in fractions of seconds, not every 10 minutes or half-hour. Customers have to make decisions about liquidity, credit and the delivery of goods and services - half an hour ago or this morning isn't good enough."

There is some truth to the notion that some legacy technologies do not support the final posting of transactions in real time, Feinberg concedes. But banks can - and should - invest in technologies that can streamline the transaction process and eliminate the excess data often found in legacy systems, she says.

Banks should not be intimidated by the information that is stored on legacy systems, and they should indeed make progress in processing, storing and transmitting data, according to Till Guldimann, vice chairman, SunGard. Guldimann warned attendees not to "get distracted by information simply because it's there."

If an organization outside the financial industry, like Federal Express, can allow customers to see every step of the delivery process, banks should provide the same service regarding payment transactions, TowerGroup's Feinberg says. "Banks that are doing their job should be able to provide that information to customers and not be afraid to show it," she says. "That view of how long it has taken for a transaction to get from one point to the next - if they aren't doing that, they may be embarrassed to show a customer how it really has gone through the system."

UPdate: No Resolution

I've not heard one word back from this theiving bank. I filed complaints all over the place. I received a letter on 10-23 from the office of the president of Fifth Third Bank say I would be contacted within 5 business days, haven't heard one word. I've contact the State Department of Financial Services, they have sent a letter to Fifth Third requesting a resolution in 30 days.

I guess they figure if they don't deal with this, I will go away. NOT! All I have reqested was my account to be restored to the corrrect balance. Nope, they are still charging me $6.00 a day in interest/fees whatever they want to call it.

I did get a letter from the BBB asking if the issue was resolved, I had to tell them no. Fifth Third wasn't even putting forth any effort.

Debit cards will be declined

If you use your debit card and you do not have the funds in the account your card will be declined. at least my bank will decline the card. so for the comment that said the card will not be declined is not true I tried to use my card one day it was declined because i did not have enough money in my account to cover so I know for a fact that it will be declined if the funds are not there.

Fifth Third Bank as BB&T are Ripping off our nation!

In the Rules and Regulations it states on page 3 Item 12 paragraph 1 If multiple items are presented to the Bank for payment and there are not sufficient funds to pay all of those item, Bank (not customer) has the right to decide the order of the items that will be paid and which items will be returned, if any. Bank may select order at any time, which my include paying the largest items first such as your mortgage, rent or car payment.

If you look at your statement, it is outlined as if the losts amounts were taken our first. This pure deception, no other way to look at it.

If some of you don't think this type of deceptive behavior is going on, and it's only a few of US IDIOTS who don't understand banking are get into financial trouble, then you need to do a search on this site on BB&T and other Banks. Be careful, you may be the next victim.

After researching complaints from consumers about Fifth Third Bankcorp I discovered there were hundreds if not thousand of Fifth Third Bankcorp extremely dissatisfied with this banking institution. On Planetfeedback.com (www.plantefeedback.com) there are a total of 77 registered complaints dating back as far a February 2001. Most are on the subject matter of excessive fees, incompetent customer service and lack of follow through on problem solving. At thecomplaintstation.com (www.thecomplaintstation.com) there are another 36 horror stories and warning to stay away from Fifth Third Bank.

On July 22, 2004, Laura Bruce wrote an article listing 10 things your banker won't tell you. This is number 6: "If you sign your receipt when you use your check card for purchases, we'll make more money than if you use a PIN."
Retailers pay a processing fee to the bank anytime a customer uses a check card. If you press "debit" and use a PIN, the transaction is done electronically and the retailer is charged less for the transaction. If you press "credit" and sign for your purchase, the transaction is routed through the credit card networks and the retailer pays a higher fee.

My problem started when I got online on 10/15/04 and saw that my account was $800+ over drawn. I called 5/3 customer service today and spoke to a lady named Rebecca. As we worked through my last statement I kept asking her if I were overdrawn why did they not decline my debit card. She didn't know. She put me on hold. Ten minutes later she came back and said that is was a courtesy that was initiated by my local branch (Manager: Ms Hemmingway) since we were such good customers. It was to save us the embarrassment of having our card declined! (I value myself and my name, but not that much!) I responded with, how did she figure it was a courtesy to me or helped me in anyway. Of course this was only after she tried to scold me for not checking my account everyday! She actually said, Don't you check your account daily?

We went through one day's charges and 3 should have cleared with only one going into over draft. However since they take the largest to the smallest after the first one was processed the others all were assessed a $30 fee the next day! I asked why they did that and her response was that they figure people wanted their house payments, rent, etc., to be paid first. When I asked what difference did it make, at the end of the day the overdraft was going to be the same, especially since I had this wonderful courtesy overdraft protection, she had no answer. It does not take a brain surgeon to figure it is so the bank can charge more fees the next day.

She also confirmed that a $6 per day overdraft fee was assessed for Saturday, Sunday and Holidays, even though consumers are unable to bank on those days.

I asked if they were basically loaning me the money until I made a deposit, since I was such a good loyal customer and she refused to use the word loan, she just said, "We paid it for you." Calling it a loan would make it fall under Truth In Lending laws, and the banks don't want that to happen.

I went back through the year from April until today they have charged my account a grand total of $2352.00!! This figure is based as if the balance in April was even correct in the light of Fifth Third Bank's practices I find it doubtful.

All of this started back in April when I may or may not have made a mistake and my account became overdrawn the next day, less than $100.00, with 3 different transactions, one check and 2 ATM/Debits. Of course the check was the largest so they took that out first cause my charges the next day to be $90 instead of $30. I have gone from there until now and if that one incident had not happened I should have right at $2000.00 in the bank!

If I refuse to pay these charges, I will be reported to ChexSystem and will not be able to open a bank account, credit destroyed, etc. However if I do pay them I am likely not to ever get them back or only a fraction back in any judgment.

On September 15 there were Congressional Hearings on this matter with the Banking and Finance Committee. There has been testimony and requests for comments on this subject since May 2004. From my research I have found that banks last year made 14 BILLION dollars with these fees last year. (how much was that tax cut Bush gave to help stimulate the economy)? Talk about the Fleecing of America, I would say this rates way up on the list.

This is not just hurting me personally, it's hurting our entire nation! Less money to spend, loss of jobs, loss of income taxes, Federal, State and local. Not counting the unemployment from our government for those out of a job. I know this sounds like I'm really carrying it to the limit, but just think about it.

I feel that this is the worse kind of scam that is going right now and it's hurting everyone!
I wrote a letter to our Mayor and he too had the same problem with one of the banks here in town.

I did not enroll in this Courtesy Overdraft Protection, (Bounce Loan, Trakker, OverDraftHonor, etc.) or any other courtesy protection with or through Fifth Third Bank. I was not informed about it from my bank in any way. I have banked with Fifth Third for several years and there was no such thing as Courtesy Overdraft Protection. No one called and asked if I wanted it included on any of my accounts, no mail advertising it as a new service, nothing.

I have researched this enough the last few days that there are l class-action suits pending on this Non-Interest INCOME for banks, helping to recoup loss income from interest rates.

I have researched all the companies who market these concepts. All that is mentioned is how their computer programs and training on techniques can greatly increase your Non-Interest Income, Pennicle, BSG Financial, John Floyd Associates etc.


I have also researched and found that many Banking Institutions have already conformed to the awaiting Interagency Compliance on Overdraft Fee Directive from the Office of the Comptroller of the Currency by explaining that this service is not standard regular overdraft protection (that very few use or quality for) and is subject to regular bounce check fees. (ranging from $16-$40 per transaction) The only thing the bank is not doing is returning the check or denying the ATM/Debit card.

However, Fifth Third Bank has failed to do so. Fifth Third Bank rates in the top 5 of banking institutes to profit the most in the deceptive business practice. The number one on the list is Washington Mutual at 1 Billion in fee income.

It is very clear that these programs target low-medium income people who are more likely to have overdrafts. Some of the companies who have marketed these programs to banking institutions have it plainly on the front page of their websites.

Also, many Board members think the program attracts the "wrong" type of account holder. In reality, it's ODP account holders who are making the financial institution money.

How is the "wrong" type of account holder actually the "right" type?
Many financial institutions don't realize that a account holder who writes an average of only one NSF check per month has the equivalent earnings value of a account holder who maintains a $12,000 average collected demand balance. And because there are so many more account holders who are likely to take advantage of ODP than there are "affluent" account holders, financial institutions should take good care of these account holders.

Every banker will tell you they want rich account holders, but there's just too much competition to get their business. So instead community financial institutions should do a better job of meeting the needs of their broader (I'm sure they meant to say poorer) account holder base.

Account holders benefit by no longer being humiliated about having a "bad check" and by not paying double fees (to the retailer and the financial institution). At the same time, the financial institution is increasing its NSF income anywhere from 50 to 300 percent.

.By increasing the number of accounts with free checking and increasing your NSF activity, you'll be generating more transactions, using more of your financial institution's capacity, and producing more revenue per account holder.

What do Regulators think of Overdraft Privilege?
IMPACT has sought the advice and counsel of federal and state regulators for several years, and their input has shaped the unique design of the IMPACT Overdraft Privilege. Because there are some overdraft privilege designs lacking in sufficient consumer protection and appreciation for the regulatory environment, regulators have become concerned with certain practices. These concerns fall into four categories: 1) increased costs for account holders, 2) encouraging account holders to overspend and thus overdraft so the institution can generate fee income, 3) misleading, deceptive, or unfair practices, and 4) lack of compliance with regulations. Balancing the needs of account holders; the financial, reputational, and regulatory risks of financial institutions; and the concerns of regulators in designing an Overdraft Privilege service is very complex.

There is no way that a banking institution could possibly have the mind set of thinking in the best interest of the consumer with sales pitches exampled above. As they say, the proof is in the pudding.

I will be expecting to hear from you immediately on this issue but most importantly I expect to see the balance in my checking account (0063711981) setting at $2352.00. If I have to carry this further, I will be going back through all me checks since I've had an account with you, and beginning the moment you started this Largest deducted First procedure and enrolled me in your courtesy check coverage, which I am sure will increase the amount of money you have stolen from this account tremendously. Regulators are frowning on this type of deceptive practice.

In Europe, they are calling on the financial community to STOP this behavior. We have sat here and taken it long enough. Doing exactly what "rebuttals" on this subject have suggested, which is basically "Suck It Up", "The Banks are right in doing this", "we are the stupid ones for not being able to balance a checkbook"

I have a question, why do we take our money, put it in the bank? Fot save keeping??? LMAO To be stolen in fee upon fee. In all honestly, why do we feel we need to take our check to the bank, then come home and write checks on it, are we saying that we are to stupid to keep track of the cash in the jar buried out back, and the banks are much better at tracking our cash?? Hell, maybe we who use a bank are just stupid.

I have a love hate relationship with banks.

We have an account becaue of the buisness. And to have a deposit point for credit card transactions.

As most complailts have come from consumers I asked one the bank reprentives about the fees on over drafts due to use of depet cards.

What I was told, using a check card is the same is writing a check thus the same charges apply.

Second fact: I was told was banks loose money on low balance accounts but must offer them due to thier charter and the O.D. fees were part of the banking regs. to offset the loss on the low balance accounts.

To get to the bottom line there is no 'float' on a check as we used to know it. Ten years ago I would write a check two days before payday at the grocery store and it would take 3 to 5 days to clear the bank after I put in my paycheck. Now some grocery stores do an EFT when you present the check. Which means the funds come out of your account at the time of purchase. Inreal time as if in NOW.

How to prevent getting hit with the situation Debbie has? Simple: Do not use debit cards/checks when there is not the availabe funds in the account to cover all transactions at the present time. Do not count on float.

Not to stick up for any bank but to offer consumer info. what I do is make a deposit. Then let it sit for a week and check the account balance on line and write checks to pay bills or use the debit card or do online bill pay.

Please do not hit me with the "rich reply" because I am not.

But after reading how things work on the Ripoffreport I have yet to pay a nickle on my low balance bank accounts due to O.D. fees.

Banks really should put an end to overdraft protection and overdraft fees

The idea of overdraft was to put an end to bounced checks. That's how it all started.

But, look at how angry the customers get when they are forced to pay overdraft fees.

It doesn't improve the banking relationship with the customer, that's for sure.

Plus, the people who have no control over the situation, the customer service individuals, are the ones always getting yelled at by angry customers. That causes them a lot of stress.

High overdraft fees are a prime example of why customers feel they have an adversarial relationship with their bank.

In the end, banks lose more than they gain.

I applaud the banks for trying to find a solution to bounced checks. But, this is an idiot solution.

I suggest they find a solution that is more accepted by the customers, one that fosters a good relationship with their customers, instead of erodes it.

Mis-management leads to Overdraft fees

Overdraft fees are never convenient, and its hard to understand how a bank can allow your account to get in the red. Well, first off banks are in the business of making money and fees generate income so they are not going to go out of their way to stop you from misusing your account.

Second, no matter how logical it may sound that a bank should not allow you to spend more than you have, it makes even more sense to keep records of the money you spend or deposit in your account so that you KNOW what you can or cannot spend.

Third, discontinuing overdraft protection will not force a bank to decline your purchases. Overdraft protection just makes it so you don't have to pay as high of fees and guarantees that paper checks you write will not be returned if your overdraft protection can cover it.
It can't be said that since your bank allowed you to overdraw your account and then charged you fees that they've stolen from you. They have simply charged the fees that are detailed in the disclosures provided to you when you opened your account.

Everyone makes mistakes, and there are very few who've never overdrawn their own bank account. But, you have to own the fact that the only reason why you are in so much debt with the bank is because of your unwillingness to take responsiblity for your spending habits and the management of your account.

As a merchant who takes debit cards with the Visa logo we could not get a vaid answer from our "ACH" on how they worked.

However, after reading the posts on the RippOff Report It did not take to long to figure it out.

Correct me if we are wrong but a transaction with a debit card is considered the same as a check. Thus the overdraft fees. I think this is bogus but the consumer signed the agreement with the bank, to open the account, thus agreed to the "terms and conditions" of the account.

What we have noticed is the consumer using a "debit"card to pay for services and even to make mention to" Let's see if this transaction will go through".

I have to tell them it WILL go through and we will get paid but you will get hit with NSF charges. If the account lacks funds BECAUSE the banks will not decine a debit card like they do on a real credit card.

As a merchant who is really intrested in avoiding problem like Debbie has. I ask if the funds are actually in the account. This irks people but I least explainded how things work. The average consumer could care less and blame it on the the bank.

At least we try to advise possible problems for them. Some listen, most still think no money in checking account= DECLINE

This is the second posting I've seen in two weeks where a person is trying to blame a financial institution for their own stupidity. In this case, Debbie says:

"I would like to know what agency I (we all) need to contact "

I would suggest that you try a local elementary school. That's about the level of math skills required to balance a checkbook. And while I certainly agree that bank fees can be excessive, there would have been no fees in this matter at all had you kept your account records current. So, instead, you now have learned an expensive lesson. End of story.

Overdraft protection is optional, have your bank turn it off!

If you decline overdraft protection, you will never be able to spend more money than you have.

If you're already in over your head, ask your bank manager to reduce the charges by half.

One thing is certain, if you don't pay the bank, they will close your account and put your name on a list. Then, no other banks will give you an account either.

Always keep track of your money. Banks make mistakes. Unless you write down all your deposits and withdrawals, you will have nothing but problems.

Suggestion: Keep Your Bank Balance Current

I understand that you "thought" you had money in the bank. I don't have an ATM card so I have no idea how those work if you have no money to cover in your account. I do have overdraft protection at two of my banks and I can write checks whenever I like and if I write checks for money that is not there I will get charged for each check written over my account balance. It is not the bank's responsibility to tell me I'm spending money I don't have. This has happened to me once and, fortunately, it was only one check. I paid my overdraft fee and did some research to find out why it happened. My daughter and I had both entered a deposit in the register we use. We began a different system for entering checks and deposits so that it does not happen again. I also understand that you can go over the limit on some credit cards but the same rules apply. If you go over your credit limit you are charged an over the limit fee. Again, the credit card company is not responsible for contacting you to advise you that you are over the limit. I use two different accounting software (one for business, one for personal). It is much easier to keep track of bank balances this way and avoid going over the limit. NOTE: If more than one person is using a bank account or a credit card it is imperative that they understand the importance of keeping spent amounts updated.

You missed the point. I thought I had money, I didn't know the bank was taking it faster than I could get it in there.

The first time I tried to use my ATM/Debit card that would have taken my account below $0 it should have been declined. I would have then been alerted that something was wrong. When you use your credit card it won't let you go over the Credit Limit. Banking statements are only sent out once a month. Had I not decided to sign up to see my account online, there is no telling how much overdrawn I would have been by months end.

And don't forget, the account was overdrawn. I went to my bank's ATM right outside the door and it let me get cash out!!! Where are the basic alerts to let you know something might be wrong?

It wasn't that long ago that if you tried to use your Debit card and the money was not there, it would be declined, or am I just crazy. I can assure you had I not know I had no money I would not have been spending it as if I did. Fifth Third bank let me believe I did have money.

I just don't know what to do next. My paychecks won't cover this even if I don't eat and don't make our next housepayment for 3 weeks. I'm walking the floors worrying my butt off because some big bank STOLE my money and those fat cats are home sleeping soundly.

I Don't Think I Understand

I agree that the overdraft fees that banks charge can be outrageous and I disagree with "holding deposits" while they run checks through, but if I'm reading this correctly you didn't have the money in the bank when you were spending it. Is there a valid reason you didn't know your account only had $35.00 in it before you started spending money that was not there? While I agree that overdraft fees can be highway robbery, I can't fault my bank if I am spending money that does not exist in my account.
