I have had my own checking account with Fifth Third for many years. So when my own son was getting sent of to Iraq for a year of overseas duty. I become a signer on my son's account so I could handle his affairs while serving our country. When my son returned from Iraq he continued his relationship with Fifth and left me on his account. Since his return he was laid off from his construction job and filed for unemployment which was being automatically deposited in his account with Fifth Third. Apprently, my son made a depost that was not credited to his account right away and used his debit card after making the deposit. Which resulted in the usual outrageous service fees. Since he is unemployed the service fees continued to pile up while he struggles to once again get his head above water financially. Since I'm also on his account I got a call from Fifth Third advising me over his overdrawn status. I told the representive that my son was working on the problem and asked her if there was something that could be done about $469.00 fees they have charged him. I was told that they had given him some credits and were not going to give him any more. I was also told my personal account was going to be frozen. I advised the representative I did not want my account touched. Needless to say they took $442.25 out of my account that day and left me with a zero balance to pay for some of the fees they have charged my son. While my son was away I was hit with some of Fifth Third outrageous fees and decided I wanted to go to another bank. I left my Fifth Third account open to pay a couple of bills and make cashing my own payroll checks easier for me. I have instructed Fifth Third to close my account. I will never put another dime in their bank. Meanwhile they are sending my son and I to collections for the remaining fees. Haven't they got all the blood they can from us???
I recently moved from Northern Kentucky to Ohio and went into my branch to change my account address. Fifth Third changed the address on my sons account instead of my account. So my son did not get statements as my mail does get stolen from my mail box occasionally. When I asked the representative at Fifth Third about the mix up I was told "Yeah, sometimes that happens when your name is on muliple accounts" Shouldn't they be more carefull with banking information than that!!!

Your son had overdrafts because he did not wait for the money to become available. If he did not know about the availability or didn't keep track of his balance that is his fault. Per the terms of the account he overdrafted and was charged the fees accordingly. If you or he thinks they are outragous then you need to find another bank that has lower fees. Or better yet make sure you understand how items are posted and funds made available to avoid them all together.

Your second issue is because you are on the account they have the legal right, actually called the "Right of Offset" to take money from a positive account to pay for a delinquent account that you are also on. Which they did, and is no different than any other bank would have done. Your actually lucky that 5/3 contacted you first, most banks won't. They will either let you figure it out on your own after the fact, or send you a letter in 7-10 days if you haven't figured it out by then.

Whether you think it is fair or not, the fees are what you agreed to when you opened the account. So you are not going to be able to get out of them. Putting any more money into the account is not the wisest thing either. Because until your son's account is positive, they will continue to use the Offset to take money from your account to your son's.

I would highly recommend that you either pay the fees before they turn you over to collections, or open another account at another bank ASAP. Because once they do you will also be put into ChexSystems which will make it impossible to open an account at any other major bank.
