I have a friend that it is real estate agent in the State of Arizona and the name of the broker that my friend used to work is John Hoyt.

John Hoyt has not paid the commission owed to this agent. John Hoyt has told others including the Association of Arizona Realtors under oath that he did pay. 

Therefore I am documenting John Hoyt's actions by using this rip off report to educate other Realtors that are thinking to joing his company "Focus Point Properties LLC".

 PLEASE PROVIDE THE CANCEL CHECKS THAT YOU PAID COMMISSION. PLEASE SHOW THE MINUTE ENTRIES IN ALL THREE COURTS.

Supporting Documents would help, Juan...

For the record, I do not know John, nor have I used his firm in any RE transactions.  That said, Juan,  if your so-called friend was cheated out of a commission, let's see his/her supporting evidence e.g., contract, listing, letter from buyer/seller, etc.  I do NOT have a dog in this fight--happened across this complaint by accident--but I find it difficult to stomach people like Juan, who, it seems can commit liable without being held accountable.  If three separate courts failed to find Focus Point in breach of contract, then I suspect they have fulfilled their obligation.  Why this site allows second and third hand complaints is beyond outrageous. And why they allow anyone to file a complaint without supporting documentation is, as I previously mentioned, liable.  “Juan,” or whatever your real name is, give your full name and place of employment if you stand behind your allegations.

 IF JOHN HOYT PAYS HIS AGENT THE COMMISSION AS AGREED UPON, I WILL BE GLAD TO REMOVE THIS COMPLAINT. UNTIL TODAY HE HAS NOT PAID THIS AGENT!!!! IT DOES NOT MATTER WHAT AWARDS HIS COMPANY RECEIVES IF JOHN IS NOT ETHICAL.

I was recently made aware of this posting by a voice mail from Ripoff Report.  I think they foment this type of scenario so they can charge you money to "clean your reputation"

 

This is the one and only time I will address this slander upon me and my company.  Let it be known that  Focus Point Properties was awarded the 2013 Arizona Excellence Award for Real Estate.  We wouldn't consistently win awards for excellence if we comported ourselves in the manner depicted in this complaint.  And while I'm sure that the "accuser" will follow this up with more accusations and double talk, rest assured that our company comports itself with the highest regard for our clients and Agents.  While we do provide superior customer service to our clients, we unfortunately can't control individuals who make unfounded claims to the contrary.  A quick visit to the Arizona Department of Real Estate website will confirm that the reputation of my company and its agents remains untarnished.

Erroneous Claim

 Mr. John Hoyt used my name and information to write this rebuttal. I NEVER WROTE THAT IT WAS AN ERRONEOUS CLAIM! Mr. Hoyt never paid the commission to his agent, he fired her to be able to keep her commission, when she tried to take him to court 3 times he always found the way to manipulate the court system. He lied to a Superior Judge that he was traveling to Peru when he was in Scottsdale's bars every day with his friends (He posted his pictures in Facebook) to have time to dissolve his company and avoid paying the commission. If Mr. Hoyt doesn't have a problem lying to a Judge, and lying to the Arizona Realtor's Board. Who can trust Mr. Hoyt?

 To Rip Off Report: To clarify things, Mr. John Hoyt has failed to provide the truth in reference to this complaint. I ask if John Hoyt did in fact pay the commission, simply provide a copy of the returned check. Mr. Hoyt is unable to since this evidence does not exist. Mr. Hoyt is an expert manipulator in Court and now trying to manipulate the readers of this site, Rip Off Report.

Erroneous Claim

Im Sorry, I was misled and therefore mistaken.  Mr. Hoyt did not defraud my former friend of her commission

I apologize for any confusion or ill will this may have caused.

I want to rescind my complaint and would like everyone to know that Mr. Hoyt nor his company are at fault regarding this matter.
