My son s pickup was repoed after filing bankrupcty. his picku[p was not listed on the sheet of items. HE CONTINUED PAYING MORE THAN THE PAYMENTS Were for almost six months. nothing was said, then on 11/19/07 they came and got it, we got the notice in the mail on 11/26/07. How can they do this by law and no notification. It was taken to Wichita, kansas and that is where we had to go mto get it back. We had to pay the full am,ount due, paper work, wrecker fee and he was not even licsened in oklahoma with the DOT.We now have the pick up but I would like to know if there is any thing I can do to get this kind of crap stopped. Looks like a good law suite would help to stop it . Any lawyers out there like to make 50% of what you can get out of these ##@$&&*people. Don, Guymon, Oklahoma

Well first off if your son filed for bankruptcy and did not list the vehicle he is very lucky that the entire bankruptcy was not thrown out. By regulation he is required to list ALL creditors and assets. So I hope that when you mean it was "not even listed on the sheet of items", you ment it was listed in the bankruptcy but he re-afirmed the debt. Now, if he did not list the vehicle, it might be wise not to tip off anyone and have the possibility of the bankruptcy re-opened and possibly dismissed.
There is not enough information here to know why they repoed the vehicle. But, even if they did repo the vehicle and should not have, you may be limited to the damages of all of the fees you had to pay. Anything that went toward the principal of the loan you probably would not get back, since that would eventually have to be paid.
