Frank A. Rizzo, formerly of 4679 Ossabaw Way, Naples, Florida; but now in Queensland, Australia signed a Deed in Lieu of Foreclosure on April 28, 2014 in Queensland, Australia on a Condo 301 Estero Sands in Ft. Myers Florida.  Frank A. Rizzo had entered a rental agreement on the property for the week of July 5 through July 12, 2014 in January 2014.  Full payment for the rental of the condo was paid to Frank A. Rizzo on May 2, 2014.

The renter was notified by VRBO on June 6, 2014 to make no further payments because the property listing that Mr. Frank A. Rizzo had placed on the VRBO website was no longer active.  The renter contacted VRBO to secure reimbursement for the full cost of the rental, of which VRBO denied.  VRBO directed the renter to contact the owner, Mr. Frank A. Rizzo and attempt to secure a refund. VRBO would only supply the renter with two contact numbers, which the renter already had, but the numbers were no longer valid. The renter had communicated through secure email through VRBO with the owner, Mr. Frank A. Rizzo, however, the listing was deactivated on June 6, 2014; so the renter did not have an email address to contact the owner. VRBO denied the renter additonal contact information due to a confidentiality clause meant to protect the owner.

The renter contacted McCormick 105 LLC of Maryland, whom the deed was transfered to on May 16.  Representatives from McCormick 105 LLC(Beltway Capital) claimed that the company's hands were tied and and directed the renter to contact the previous owner, Mr. Frank A. Rizzo, in order to attempt to gain a refund of the full payment of the cost of the rental. The renter has secured assistance of a resident of Queensland, Australia in an attempt to contact Mr. Frank A. Rizzo.  The attorney who notarized the document on April 28, 2014 was Mr. Warren Elbridge Boston whose office is located at Level 6 RSL Centre, 9 Beach Road Surfers Paradise, Queensland, Australia.

As Mr. Frank A. Rizzo is last known to be in Queensland Australia(as of April 28, 2014); the renter has not been able to secure any contact with the owner, Mr. Frank A. Rizzo.  The renter at this time is out the full payment/cost of the rental unit 301 Estero Sands Ft. Myers, Florida and searching for any assistance in resolving this issue. Additionally, the renter is not the only person who had reserved this condo.  Additional weks had been reserved for the the same unit during different weeks after the signing of the Deed in Lieu of Foreclosure on April 28, 2014

If anyone knows how to contact Mr. Frank A. Rizzo, please reply to this report. If anyone knows how to get a refund or actions to take to secure full refund of the cost of the rental , please respond to this report.

Rizzo Makes It Right...Thank You Frank

I would like to commend Mr. Frank A. Rizzo for fully refunding the money paid for the vaction rental. Mr. Rizzo promptly contacted me via email and within 12 hours of our conversation fully refunded our rental fee.  However, a word of caution to travelers who use VRBO, be sure you clarify the conditions of use and fully understand the gaurantees. AGAIN THANK YOU MR. FRANK A. RIZZO.
