Frederick Hanna & Assoc I am now under WRIT OF GARNISHMENT at 25% weekly of my GROSS wages, they never agreed to make payment arrangements, told me the entire debt was to be paid in full and NOW I have a continuing WRIT unt Marietta, Georgia

How can these people get away with this? I thought that as a debt collector your interest was to obtain payment? I never had any issues with any debtors agreeing to payments or postponing further action especially when they knew I was laid off. I am a single mom and am raising my grandson with no outside income, I was receiving unemployment of which I had no taxes taken out just to be able to survive on a week to week basis. Now that I am gainfully employed again( not even 60 days) they have Garnished my wages to where I am barely bringing home 180.00 a week and my rent alone is 300.00 a month.

If there is some help out there PLEASE advise me, I am at my wits end! They dont even tell you that the court date is past once your served, the paper is hidden well within the mass documents they hand you when served and the court is in thier county and passed. How can this be fair???

The word it out on Hanna and Thugs and as much as it blew my mind the Governors Office of Consumer affairs has actually taken them to court for some of their illegal collection tactics.  Write letters of complaint to that office.

I had a case with them and they placed false evidence in my file and tried ex-parte communications with the Judge as well.

There are lawyers who know how to stop garnishments. There is a good lawyer named CXXXXX JXXXX in Winder who has fought them for people in the past.

Please go to the Governors site and write a letter of complaint against Hanna's Firm. Good Luck in everything.

This company specializes in what is termed "sewer service" summons delivered, which is improperly serving you so that you will be a no show on the court date. Being a no show is exactly what they want, as they get a max. judgment and wage garnishment if you don't bother to show up in court.

If what you write is correct, then this is illegal...they can't "serve" you if the court date has already past. If you can't afford an attorney, then contact your local Red Cross for a  referral to the local free legal aide society in your area. Tell them that you were deliberately and improperly served a court summons and ask for guidance.  They may be able to get the judgment and garnishment vacated.

If this does not work, contact the the court and ask for assistance petitioning them for a hardship case to get the garnishment level reduced.

If all this fails and you have a significant amount of debt, then you may want to consider filing for Chapter 7 bankruptcy. This will stop wage garnishment.
