Fulfillment International Corporation ripoff vacation prize holidays Coldwater Michigan
Foolishly i agreed to pay $900 on my credit card for two 10 day holidays and a three day cruise and came off the phone, feeling i had got a great deal, i told my daughter immediatly and she got straight on the net, and the phone back to them as she didnt feel the actual benefits for the money were good enough. after looking into it , she discovered 1000's of reports of being ripped off by this company.
It seems they offer greatly overpriced trips to stay in places like best western , comfort inn and still when you get to america u have to buy flights to and from orlando to mexico as well as uk to orlando , and then also pay 269 dollars per person to board the ship. I called the company on the customer service line and was told by automatic message they only take emails.
I was then told via email that depsite my requests to cancel, my details had not been put in the system as yet and to speak with them after getting a return email from the accounts department in next 24 hours.
Of course i was worried sick , as i had no way of getting through to them by phone and had to wait for the email response.Eventually they came back to me after 7 emails from myself , demanding a refund, with an email telling me it was totally non-refundable and that there was no way i could have my money back as i agreed on the phone.
they even sent me a link by which i could listen to the tape of my call , so we called it and checked , the man did in fact say it was non-refundable but not till after he had authorised payment, the last thing he said on the taped message was it was non refundable, I spent the entire day emailing them back and forth , firstly asking for there understanding in the matter that i would like to cancel and then i found through another report on this site that they are in direct violation of the Distance Selling Regulations and the agreement was signed between department of trade and industry , tading standards and the american federal trade commision .IT GIVES YOU YOUR RIGHTS AS A CONSUMER TO HAVE A 7 DAY COOLING OFF PERIOD SO U MUST QUOTE THIS,
HERES WHAT WE WROTE AND AFTER 24 HOURS IT WORKED , ALTHOUGH THEY DIDNT ADMIT IT , ALSO MAKE SURE U CALL THE AMERICAN FEDERAL TRADE COMMISION AND REPORT IT , SO THEY CAN LOG THE VIOLATIONS.
THE COMPANY KEPT INSISITING I SHOULD GIVE AWY THE TRIP IF I DIDNT WANT IT,SO DONT TAKE NO FOR AN ANSWER AND KEEP AT IT ,EVERY HOUR
HERES WHAT WE WROTE
thanks again for your suggestions telling us we can sell on or pass on this trip and thanks for your offer to extend the holiday taking period but as consumers and customers that you should surely want to keep for the future, we are clearly stating that we are contacting you within 24 hours and that we expect a refund and you are directly breaking the Distance Selling Regulations from 2000 which clearly states through an Mutual Enforcement Assistance Agreement signed by Robert Pitofsky of the American Federal Trade Commission with the Director General of Fair trading and Her Majesty's Secretary of State for Trade and Industry signed on the 31st October 2000 that the following conditions are in place to protect consumers and have the right to apply these laws, the fact that you are in America is irrelevant and that is why these laws are in place.
A cooling off period of seven working days in which the consumer can withdraw from the contract
The right to receive clear information about goods and services before deciding to buy;
The Consumer Protection (Distance Selling) Regulations 2000 (SI 2000 No. 2334) implement Directive 97/7/EC of 20 May 1997 on the protection of consumers in respect of distance contracts (known as the Distance Selling Directive).
A seven day cooling off period is standard and has to be applied and the Trading Standards in LONDON have advised us that 1967 misrepresentation act applies here.
I look forward to receiving your prompt reply money being refunded as promptly as it was taken.
All this aside I should not have to argue these irrelevant matters with yourselves , through the recipricol agreement made via the Mutual Enforcement Assistance Agreement we are entitled to a cooling off period and so we are choosing to apply that with immediate affect.
Please issue an immediate refund
