I had included the LDP details in one of the updates of our case on the ripoffreport and on www.hadd.com as well.
Apparently Fuller Homes told these people, DURING the LDP period, that they were doing FHA loans. I verifed this myself and reported it to HUD. Recently another person sent me correspondence they recieved from Fuller Homes where they denied any knowledge of the LDP ever existing. I also submitted this evidence to HUD.
HUD is doing NOTHING, has let the LDP run out, and has not enforced their own regulations. The origninal agent on our case at HUD, who got the LDP thru, mysteriously "retired" while still in her 40's right after the LDP was issued. She does not respond to attempts to contact her. HUD has told us many untruths since this agent "retired," and her replacements have been making decisions about our case without having read our file.
A HUD agent also told me that they do not have time to review the details of cases. Remember that if you file anything with HUD, that they don't have time to read your file, but will make decisions about it anyway.
I strongly suspect that Fuller has been in violation of the LDP all along, and that HUD did not enforce it. If HUD had enforced its own regulations maybe Fuller would not have lost interst in negotiating with us or our attorneys, and we could have resolved this by now.
Speaking of attorneys, anyone that tells you people are suing builders easily and for profit is either very stupid or is a paid shill of the construction industry. Builders are trying to whip up fear about "affordable housing" and how all the nasty people sue the builders for paint drips and drive up the cost for everyone.
We have FOUNDATION FAILURE and OMISSIONS OF CRITICAL CODE REQUIRED MATERIAL, all verified in writing by engineers and other experts, and I can assure you from our experience and that of many other home owners that our legal recourse is virtually NILL. We have consulted with well over 25 lawyers in Oklahoma, hired and fired two, one of which violated several ethics standards listed by the state bar. The state does not allow the kind of award builders claim people are getting.
People are losing thousands of dollars and not getting resolution, nor are they getting what they're paying for.
In addition to avoiding this builder and all bad builders, to go to http://www.lsb.state.ok.us/ click on text of measures and then introduced bills under House and go to HB 1334.
This is a builder sponsored bill to limit our rights even more. Please write and call your senators and representatives and demand they vote NO on this bill. We don't need to protect bad builders from consumers! We already have too little protection from builders as it is.
