I was contacted by a 'collection agency' in regards to a Home Depot account. The representative stated pay in full over the phone or 50% over two monthly payments.
I stated no, he then got all hot and bothered and threatened me with an attorney. I stated, 'If I do not have the money today, why would an attorney waste his time?'.

I then found out from my mother (who lives across town) that she was recieving phone calls from a David in San Diego. He would not give her info as to who he was and continues to ask about me.

He stated that her phone number was the last one I gave him. Well, I will not give my mother's phone number out as my contact number. I don't know what kind of gestapo phone nazi game this is, but until I hear from Home depot- no money goes anywhere!

not a representative

AUTHOR: Youwantedtoknow - (U.S.A.)

I am not, nor do I represent GC Services. I am speaking as a consumer about individuals responsibility to repay their debts. There are laws in place to govern the agencies behavior.

some people

AUTHOR: Youwantedtoknow - (U.S.A.)

no one said that a debt collector could contact a nearby about your debt, what was said is that your neighbor may be contacted in order to get you a message, same with anyone else who may or may not know you, that is until they have verified that they have all location information....that is called skiptracing(check your FDCPA book again, it is in there). obviously there are just some people out there that don't know how to pay back money that they borrow. I am not condoning an agency calling a person multiple times or disclosing someones personal information to another individual. the point here is that the people in question aren't saying they don't owe the money, they just don't want to pay it. Get your check books out people, when you borrow money or recieve money for a service....you ARE responsible to pay it back. so before any of you go listening to someone telling you to avoid your bills, think about voluntary repayment. If you do request a cease communication from the collection agency, how could they EVER offer you a repayment option? Just some food for thought, rather then saying to avoid your bills, there are ways to resolve them voluntarily. Some advise, ask for the name of the collector you are talking to. They are required to provide you their name as well as their manager's name. The majority of these complaints on here are simply people not understanding that they owe a debt & they are responsible to pay it back.....hey another solution, if you don't like GC Services you can always remit the full balance of whatever you owe to the original creditor, but don't try to make a payment arrangement with them, because they will refer you back to GC Services....

GC Services doesnt not know the law as being stated!

AUTHOR: Heather - (U.S.A.)

Bored today! I fell on these reports and then researched this GC Services company and found that not only are ppl reporting them on this website but also on (((Redacted))) and (((Redacted))) AND, seeing GC Services has someone logging on now and writing lies and still being MEAN you being stated on all 3 of these types of boards; i feel obligated to educate THEM on the Fair Debt laws out there and where all of you w/ evidence may sue GC Services for harrassing you and those they are contacting and harrassing ILLEGALLY more then one time:

I HOPE THIS ENLIGHTENS GC SERVICES PERSON THAT IS LOGGING ON AND STILL HARRASSING ALL OF YOU! GOD BLESS! READ ALL OF IT CLOSELY!

Can you stop a debt collector from contacting you?

You can stop a debt collector from contacting you by writing a debt dispute letter to the collector telling them to stop. Once the collector receives your letter, they may not contact you again except to say there will be no further contact or to notify you that the debt collector or the creditor intends to take some specific action. Please note, however, that sending such a letter to a collector does not make the debt go away if you actually owe it. You could still be sued by the debt collector or your original creditor.

May a debt collector contact anyone else about your debt?

If you have an attorney, the debt collector must contact the attorney, rather than you. If you do not have an attorney, a collector may contact other people, but only to find out where you live, what your phone number is, and where you work. Collectors usually are prohibited from contacting such third parties more than once. In most cases, the collector may not tell anyone other than you and your attorney that you owe money.

What must the debt collector tell you about the debt?

Within five days after you are first contacted, the collector must send you a written notice telling you the amount of money you owe; the name of the creditor to whom you owe the money; and what action to take if you believe you do not owe the money.

May a debt collector continue to contact you if you believe you do not owe money?

A collector may not contact you if, within 30 days after you receive the written notice, you send the collection agency a letter stating you do not owe money. However, a collector can renew collection activities if you are sent proof of the debt, such as a copy of a bill for the amount owed.

What types of debt collection practices are prohibited?

Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact.

For example, debt collectors may not:

use threats of violence or harm; publish a list of consumers who refuse to pay their debts (except to a credit bureau); use obscene or profane language; or repeatedly use the telephone to annoy someone.

False statements. Debt collectors may not use any false or misleading statements when collecting a debt. For example, debt collectors may not:

falsely imply that they are attorneys or government representatives; falsely imply that you have committed a crime; falsely represent that they operate or work for a credit bureau; misrepresent the amount of your debt; indicate that papers being sent to you are legal forms when they are not; or indicate that papers being sent to you are not legal forms when they are.

Debt collectors also may not state that:

you will be arrested if you do not pay your debt; they will seize, garnish, attach, or sell your property or wages, unless the collection agency or creditor intends to do so, and it is legal to do so; or actions, such as a lawsuit, will be taken against you, when such action legally may not be taken, or when they do not intend to take such action.

Debt collectors may not:

give false credit information about you to anyone, including a credit bureau; send you anything that looks like an official document from a court or government agency when it is not; or use a false name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, collectors may not:

collect any amount greater than your debt, unless your state law permits such a charge; deposit a post-dated check prematurely; use deception to make you accept collect calls or pay for telegrams; take or threaten to take your property unless this can be done legally; or contact you by postcard. Keep a log of all phone calls and communications from the debt collector(s) so you have documentation to support your claim of harassment or abuse of the FDCPA. If you can record and save the message or communication, that is even better. We have prepared a log that you can print and use. You want the most accurate records of specifically what the collector said and the time of their phone call.

RESEARCH ONLINE YOUR RIGHTS! IT SOUNDS TO ME THAT LAWSUITS MAY BE FILED UNDER THE STATED CONDITIONS YOU ALL HAVE MENTIONED!

paying back what you owe

AUTHOR: Youwantedtoknow - (U.S.A.)

The advise that Chuck in Seneca gives is invalid. You must request a cease communication in writing to the company. But the best suggestion of all would be to simply pay back the money that you owe. Calling neighbors is a legal and respected practice in the collection industry. There are governing bodies of collectors & the agencies they work for & calling someones neighbor is legal.

Thankx, first of all this is a new forum for me, and I really like hearing that I am not the only one

AUTHOR: Kim - (U.S.A.)

Hello, and thank you!

First of all this is a new forum for me, and I really like hearing that I am not the only one receiving these notices. The one I am "semi concerned" is CS Services Limited Partnership.

They are telling me I owe money to the Superior Court. This happened to me last year, they were wrong and stopped sending me these notices, until now. First thing I did was to check on the internet to see if they had a Web Site, and they do, so they are "some what" legit?

Well, I saw this wonderful new site (Just for GC Services, I had thought),which is the one I am responding to now. My story isn't so difficult however. I feel if the Superior Court and I have/had anything to do with money I allegedly OWE The Superior Court of Los Angeles County, they would not send this to an obscure "Collection Agency". My next step will be for me to CONTACT the Court and get their feedback on this notice.

I feel that if I do this, the "Collection Service" will think twice next time they send me a threating notice. Attach wages, filing a lien, etc. I think the Courts will think it "amusing" to say the least, especially since I am acquainted with several Judges and Lawyers from the Court. Maybe GC Services will get the hint, plus since we have this forum, we can help to rid ourselves of these "Enterprising" Companies.

Now that I know about this forum. I wish to report two others, but I think that PayPal, Ebay and Amazon have these two "under control by now". Sheesh, what people will do to make a buck.

Thank you for the chance to vent.

Good Luck to us!

Kim

Calling Neighbors

AUTHOR: Chuck21 - (U.S.A.)

Hey folks! Just got a call from some guy asking for some unknown name(a woman's first name). I told him that he must have the wrong number. He then asks if he's reached a certain address. I said no, but that I lived across the street. He then says that he lost her number (Yeah, right) and she was expecting his call. Asked if I could get a msg to her.

Well, I didn't know who he represented, but took his name and number (with a reference number), and at the very end I asked who he was with and he said just "GC".

I then did a serach online and figured it was GC Collection Services. I also did a reverse number lookup on the caller ID and found this:

Operations Division
4777 Hilton Corporate Dr
Columbus, OH 43232

which points to GC Collection services (suspicions confirmed).

Sadly, I did not tell him not to call back again (I guess I'll have to next time). However, you now see another tactic on their part to get in contact with people. How inconsiderate!

GC SERVICES Limited Partnership Aka. GC Limited Partnership

AUTHOR: Woodya - (U.S.A.)

Sadly, when a person is contacted by a collection agency such as the aforementioned, all to often the response is one of anger, frustration and aggravation...BUT!...That is where mistake number one is made, allowing these telephone warriors to actually get up under your skin.

First, listen to what they have to say, so as you may identify the reason for the telephone call, such as name of the creditor that turned you over to the collection agency in the first place, in this case, Home Depot.

Next, get busy, google all information about the telephone call that you can, that is after you make certain to get the name of the firm or collection agency they are working for, followed by a facsimile number and a telephone number.

End the conversation by requesting that they give you their proper mailing address, as you do not share sensitive and personal information over the telephone, and that you are requesting that they no longer contact you by telephone but mail instead.

Now once you have made this very crucial statement that you wish to have all correspondence done via US mail, then should they call again, simply record the conversation, and once more instruct the caller that you are requesting that they contact you not by telephone, but regular, first class mail, then simply hang up the telephone, but make certain if they ask for your mailing address, give them a valid one, a P.O. Box is usually the best way to go here.

Now, if the collection agency calls you again, here is where it gets tricky, contact your states attorney general office, consumer protection division, file a formal complaint that you have continued to receive harassing telephone calls despite your spoken, faxed and written request that all contact be done via Regular First Class Mail, now the first round they will simply get a slap on the hand, but the second time, and third it get worse.

But lets say that your local OAG is corrupt, now it is time to get in the trenches, go to the creditor and threaten via letter to sue them if they do not take better control to safeguard you their consumer, one-time or not.

Home Depot paid a nice tighty little sum over this collection agency recently, and they will once again from what I understand, and if you need an attorney to assist you with this, there are numerous ones to be had, as you see, if you document the events as aforementioned, it is almost and open and shut case in small claims court which usually results in some minor punative damages along with erasure of the debt.

Just try it!...You might be surprised, GC knows me personally, and I am certain that one of the management monkeys or corporate gorillas in the mist will come out to rebut this...bet that.

But when they do, we will be posting some physical addresses here for those with troubles with GC Services to follow up on, as when you take the fight to their front door, it changes the playing field significantly.

They have worked with me all year

AUTHOR: Maureen - (U.S.A.)

although the comments about GC Services on the ripoffreport.com site are complaints about GC Services I must file a rebuttal.

Last January they too called me and I was scared and did not call back until I came up with a solution for payment which would be beneficial to me and them

They have worked with me all year and now Nov 2004 I have made my last installment which by the way even though it goes to GC Services they have in turn turned it over to the creditor in a timely fashion.

I started out hating and despising GC Services but now almost a year later I have a 0 balance owed and am very satisfied with their customer service.

I just wish all of you had the same great experience I had with GC Services

GC Service... not very well versed in the laws of Texas

AUTHOR: Walter - (U.S.A.)

Sounds like this Collection Agency is not very well versed in the laws of Texas. The Sad part is I own a business Named GCR Services. Too close a match! This lawsuit is very winnable just for the simple fact they called your mother more than once. Paying your bills on time is very important, unfortunateley bad things happen to good people. Sounds to me though, that he should have contacted Home Depot before they called a collection agency.

Make no mistake, the name of my Credit repair Company is GCR Services, not GC Service LLC.
Just wanted to make that clear.

I, too, have had problems with the same agency

AUTHOR: Kay - (U.S.A.)

I have had terrible problems with these people. They harrass me at all hours of the day and night for a bill that I had paid two years prior. I sent GC Services Illinois office proof of payment and that the overdue was erroneously sent. The bedor agreed, and even called them, however, the harassment still continues. They did not clear my account for 45 days after wards. In the meantime, they harrassed me over the phone in the middle of the night, in violation of the law. They threatened my good friend, who had recorded the phone calls. Calls would come in at 2am, 3 am, 4 am.

I have hired an attorney and have files charges against these GC Services LTD.

By the way, my daughter in Oklahoma received numerous calls from a David in Houston, hounding her day and night. Especially, when the vendor appologizes that it was a computer hick-up and was not caught, the vendor called GC, and I sent them proof of payment.

Well, I will soon have my day in court and my attorney says it is very winnable. This is why they continue to harrass me. I even got a threat from their attornies warning me not to file my law suit.

In response to the rebuttal I received, I am asking that you have home depot contact me by mail. They have not been able to work with me since I am not working, yet. I am in the process of getting on a government contract. So until I make money, there is no money. I am being proactive here, not reactive. Stop reacting like a child and take the complaint, your inaction shows me the responsibilty you have taken.

wow... no money goes anywhere!

AUTHOR: Matt - (U.S.A.)

David,

I love the way you ended your post, "Unitl I hear from Home Depot no money goes anywhere!" David the reason a collection agency is calling you is becuase when you were hearing from Home Depot no money was going there. This company is a third party collection agency which means thta you have not paid on your Home Depot account for AT LEAST 6 months!
It is amazing that you would go on a consumer website that is to report bad business and complain about a collection agency that is calling you becuase YOU are a bad customer! Don't you think that GC Services should file a ripoff report on YOU. I mean you are the one who took goods from Home Depot and stiffed them! At what point are you planning on manning up and paying for what you supposedly borrowed in good faith instead of stiffing your creditors and then complaining when they have to hire someone to make you pay.

The phone call that your mother received is probably from ANOTHER of your creditors who is looking for you. Nice, let your Mom deal with your collection calls so you can avoid your bills. Very adult of you. I have an idea why don't you sell the computer you used to post this complaint and pay your bill and call back whoever it is who is calling your mother and take care of your responsibilities.
