#1 Consumer Suggestion

Solution

AUTHOR: Steve - (United States of America)

A life insurance policy claim will always be Contested when the policy is less than 2 years old. The average consumer, and even most attorneys, are not familiar with what is required to prove a valid claim or to get a denied claim over-turned and paid. The folks at The Center for Life Insurance Disputes specialize in this work. They only represent claimants in death claim disputes and they have recovered over $35million of disputed claims. If you believe you are a victim to a wongful death claim denial you should contact The Center for Life Insurance Disputes for a free consultation.

Tough break but not uncommon

AUTHOR: voiceofreason - (United States of America)

Such a clause limiting payouts to death only after 2 years are actually fairly common. I'm no insurance expert but I figure it depends on state laws combined with price points on various policy configurations, or cause of death.

Maybe a lawyer would look over your policy contract pro bono, like an initial consultation, just to make sure the contract indeed provides the company a loophole out of paying you.
Was the probable date of actual death determined after his body was found? If not, and the date of discovery was past the 2 year cut off, I'd think that makes the company's grounds for refusal shaky, as they can't then prove the real date of death, although in civil cases they probably only have to prove at least 50.1% likelihood of it. Still, it provides a possible avenue of attacking them.

Good luck. I hope your contract indeed ends up in your favor.
