GMAC Financial Illegally took my car and didn't file a notice of Repossession with the Orange County's Sheriffs department and after reviewing everything with the Sheriffs department and having no record of it, the Sheriffs department referred me to the Orange County court house to double check after the Sheriffs didn't have any record of Crown Recovery Services located in Arcadia, CA. So I contacted Sandy Miller @ GMAC Customer Relations 800-441-9234 to let her know what happened and the issues I was having so lied to me and faxed me a form from Crown dated the day I called her. Sandy also refused to give me her email address. The report was dated almost 2 months later than when Crown took my car. I originally contacted Laurie @ Phenix collection a devision of GMAC to let them know that I was having a problem with my employer was not paying me and that we took money out of a Money Market account and it would take 7-10 days until the funds would post to our account. Thinking everything was fine before going to NY to see the family, we received a call from our daughter with an 800 credit score and she tried paying the 2 payments that were behind because in confidence she knew we had the funds coming from our market account. The 3rd party "Crown" would not except the payments and told her "Its not a big deal, I do this all the time and by law you have 10 days legally to pay whats owed plus the extra charges" So I emailed GMAC FINANCIAL 4-5 times without any replies. So when we returned, the next day I contacted both GMAC Phenix and GMAC to let them know we had the funds to make things right and were ready to either wire or Fed-X what was owed and they would not except payment.
So I went into the Orange County Sheriffs in person and showed everything to the officer and he also said go to the court house, check there records because he said that the collectors at Phenix didn't care about excepting the money because it was like sales and the more they do, the more money they get paid and if everything your telling me is true you need to file a civil lawsuit & complaint. I spoke to the supervisors @ GMAC - Phenix, emailed (All my emails are time stamped and I have good records)
Then I contacted the state of CA (attached my emails) and they sent me a Record of Complaint Form to complete and send it back to the DMV to research.

Basically GMAC ran all over me, ruined my credit, didn't except payment and then sold my Escalade and then sent me a demand letter to pay the difference of the lease even though we tried paying it multiply times. I then contacted the dealer I bought the Escalade from Allen Cadillac - GMC and spoke to everyone from the salesman -Sales Director - Finance Director to the owner "Cliff Allen" 949-582-0800 and as of now no one has helped me and my credit is ruined even though I tried multiply times to pay & make things right.

Can you refer me to the right legal counsel and since GMAC Financial was already here on your site, is there something we can file against them and is there more cases like this ?

The OP said they made several attempts to pay and they were rejected.

What part of the NO ONE WOULD ACCEPT a PAYMENT do you not understand??

You signed a contract saying you would pay GMAC repo's cars over 60 and mostly 90 late not like you didnt know you were late. Lets see here if you paid your bills this woulnt happen how is your not paying the bills now GMAC fault you signed. They shoulnt care if somthing happens get a better job pay your bills be a conrtributing member of socity not a hag on the system
