We were looking for help and contacted "Keep Your Home california" and "A State Modification Program". When we were looking for help these were inquiries ONLY. We followed through with "Keep Your Home California" program. We told the State Modification program we were NOT interested.
My huband became imployed July 2012, at this time we started the process of re-financing our home to a 15yr fixed rate(pulling no cash out). We contacted Network Capital Funding "(949)486-5135 Marvine Jones" in September 2012 to complete the loan process.
The credit reports came back clean with no remarks, and our credit scores above 720's score. But, there was an attachment that needed to be requested, per the credit agency's. This attachment showed GMAC Mortgage had our mortgage account flagged "account in forbearance". The forbearance begain July 24, 2012 and ended September 18, 2012 per GMAC's Letter dated 12/05/12.
We have worked our way up the chain of command through managment to get this resolved through GMAC. We still can NOT get a clear answer as to why there was a forbearance applied to our account. Management has flip floped between Keep Your Home California Program (we did this program) and the State Modification Program we looked into, (But never proceded with) as the reason for appling forbearance to our account.
Can you believe the manager admitted this forbearance was "hidden" in our file/account. Thats why every time we called and talked to a customer service rep they never found the forbearance allegations and told us that our account was in good standing. For the inforamtion to finally come out we had to have the guy were trying to re-finance through call GMAC...talk to upper managment and tell them he has the credit report stating they DID file a forbearance. Then and only then did they admit to it. This is some BS!
I am very unhappy with GMAC and feel they are commiting fraud and posted false allegations on our credit report with the credit agencies. Now we have a "history" of forbearance on our credit reports that GMAC is refusing to have removed. This forbearance is effecting all our hard work and great credit standing. We are UNABLE to re-finance due to GMAC...NOT because WE hurt our credit...but because we trusted GMAC to handle an important job and they failed, lied and then tried to cover it up by lying to it's customers and Marvine Jones with Network Capital Funding.
GMAC never sent us a letter in regards to the forbearance being applied to our account, the only reason we found out was due to the re-financing process. I want this fixed and our credit restored. I want NO negative marks on our history...as it should be. If it takes a lawyer to get this handled then thats what we need to do, then so be it. I want to bring a lawsuit against GMAC Mortgage.
