Gallagher Bassett DENIED MY CLAIM! -accident with Embarq employee. Maryland Heights Missouri

I was in an accident with an employee of Embarq. She immediately apologized to me and stated "I'm sorry, I didn't see you" and she got a ticket for improper lane change. She didn't argue with police offer, instead she again apologized to me. The vehicle she was driving was a work truck that had a huge camper shell on the back. She changed lanes in front of me and came to an abrupt stop.

Due to the rain, I wasn't able to stop on time and there was a collision which totaled my old Dodge Neon and barely left a dent in her work vehicle. I'm sure the company isn't going to spend a dime replacing or repairing it as the damage is minimal. Here's where Gallagher Bassett comes in. They represent Embarq for their auto insurance claims. The reps name is Anne Keel who gave me and my insurance company the run around from day one.

The law states that an insurance company should handle any claim promptly and fairly yet after almost 3 weeks she was yet to give any information to my insurance rep. I had a rental car from Enterprise because I assumed that it would be payed for by Embarq's insurance company. After 10 days, Enterprise came and picked the car up while I was at work leaving me with NO RIDE HOME! They said "Gallagher Bassett is hard to deal with" and they didn't want me to have to pay when GB denied the claim.

So finally, at around 3 weeks, my insurance rep called and told me that the claim was denied because GB feels that I was SPEEDING. I WAS NOT!!! In fact, Ms Keel asked me what the speed limit was and I said 30 and I was going 30. The speed limit is actually 35. There is absolutely NO evidence that I was speeding. If fact, the airbag in my neon didn't even deploy. I wasn't hurt but this has put a huge financial burden on me due to the fact that my neon had been paid for 4 years and I now have a car payment that I really can't afford. It appears to me that Gallagher Bassett denies ALL claims ---- they don't realize that they are ruining people's lives.

I only had liability insurance on my car therefor my insurance company couldn't do much else to help me except refer me to a lawyer. All I expected to receive was less than $3,000 (the cost of my car, towing, and rental) Because it wasn't a large claim or injury, the lawyer told me that it wouldn't be worth my money to pursue a lawsuit. I'M SCREWED!!!

If there's a lawyer out there willing to take mine and the other cases listed here in a class action suit, PLEASE DON'T HESITATE! GALLAGHER BASSETT NEEDS TO BE PUT IN THEIR PLACE!!!!!
