Until our home sells next month at the Bank of America Foreclosure sale we are owner occupants. However, Gayle Kern has threatened eviction by using a 3 day notice to pay or quit. We are not tenants, but she is using this type of law to force us out our home representing that as the attorney for the Meadowridge Homeowners Association she has already foreclosed due to an unpaid balance for unpaid HOA dues. How can that be? This is a lie because the 1st Mortgage Lender, B of A had scheduled a Foreclosure sale last week and at that sale the Lender cancelled it and requested a one month extension. Coincidentley the next day, Gayle Kern posted an eviction notice on the property that we are a Tenancy at Will. She never produces proof that the HOA is the owner of the property, that a foreclosure sale for HOA unpaid dues has occurred, no deed produced and continually sends bullying letters threatening eviction with a Sheriff even though the Bank of America Foreclosure Sale is re-scheduled next month. Apparently she has a record of violating Foreclosure laws. Apparently, she has already been accused of fraudulently recording false liens/foreclosures, and committed perjury in federal court.
