In June 2002 I had contacted Gibson Trust Incorporated to inquire about consolidation of my unsecured debt. After speaking with a Mike K. he explained to me that this was a not for profit organization and that they make no money of off clients by commission. I agreed to enter into the program he explain that I would be debt free in 48 months and my first payment of 700.00 was due on the 22 July 2002. My first payment was sent on 17 July 2002 for 700.00.
In August I started to get phone calls from my creditors, I explained to them that I had enrolled in Consumer Debt counseling and the payments are going to Gibson Trust to be dispersed to my creditors. My creditors told me that they had not received any proposal agreement or a payment. I contacted Gibson Trust only to find that the 700.00 that was paid to them was not going to be dispersed to my creditors that it was an enrollment fee and that completion on the program I would be refunded that $700.00 and that the August payments would be going to my creditors.
I told Mike that I was unaware of the enrollment fee and I thought that the $700.00 was my first payment. He said that the enrollment fee was a processing fee. I asked him what am I to do now that my payments aren't going to be made until the end of August he told me not to worry that after 6 months of being with the program that the accounts would re-age and become current.
On 07 September 2002 I sent a payment of $530.00 by postal money order at the end of September my creditors still never received any payment even though I was being told by Gibson Trust that the payments were mailed to my creditors on 10 September 2002.
In October Gibson Trust was mailed another payment of $680.00 and my creditors continued to call. Once again I contacted Gibson Trust to inquire why my creditors were not getting paid. Once again I was told the payments were mailed off to my creditors.
I told Jim that even though his computers are telling them that the payments are being made, my statements are showing non-payment and my creditors are telling my that they have not been paid and now 90 to 120 delinquent on my payments. He said he didn't understand what was going on and that he would personally contact my creditors and get to the bottom of it.
I let him know that the delinquent credit is affecting my business and my credit rating and could inflict my husband job for financial irresponsibility. He assured me he would get to the bottom of it.
I contacted my creditors again to let them know that the matter was being looked into and they informed me that a proposal was never received from Gibson Trust and no payments were ever met and the only information that they had about the company is what I had informed them of and when Gibson Trust was contacted to verify that I was going through Debt Management. The creditors also told me that they would not honor an agreement by Gibson Trust due to the delinquency and non-payment
I have made repeated calls to Gibson Trust and have got the runaround, I have left numerous phone messages to try and resolve this matter, I have been placed on their call back list, I have sent e-mails and faxes and still no one is lifting a finger. Even if they pay the creditors now they are still late with the disbursement and I now owe 1300.00 more than when I started the program.
I will also be forwarding a copy of my contract agreement, bank statements, and canceled checks, credit card Statements all faxes and emails to the BBB, Federal Trade Commission, Commisioner of Consumer Services and Office of the Attorney General Economic Crimes Division to seek action against Gibson Trust.
I will also be sending copies of statements from other individuals at that are having the same problems as I am and they will also be taking action through the Economic Crime Division AG office. I will, with the help of others, take this story to 60 Minutes or 48hrs and expose Gibson Trust and it Fraudulent Business practices and praying on the financial desperation of others.
Just a heads up I received 4 phone calls from a company called First National Credit (I have the number) saying that they have intercepted several thousand e-mails from people complaining about Gibson Trust and the reason they called me is that they could possible help me out with my debt.
This company maybe legit I am still checking. I just don't see how a company can intercept legeally an e-mail sent from me directly to another person. What comes to mind after reading another posting of Gibson Going under, is maybe they assumed a new name and address and our now trying a different approach to get even more money out of the people who have already been financially raped.
