On October 16, 2013, we purchased, from Globe Furniture, a BeautyRest Garden City Plush mattress and box-springs.  They were delivered October 31.  November 18, we contacted Globe Furniture regarding a serious defect in the pillow top portion of the mattress.  On November 21, two delivery personnel came to view the mattress, and take a picture.  We did not hear back from Globe Furniture, so on December 16 my wife called Globe Furniture and was told that this was a comfort issue and not covered by the warranty.  In a subsequent phone call they agreed to exchange the mattress for the same model.  We do not want the same model.  We are concerned about defects with this product.  Since Globe Furniture was called 18 days from delivery of the mattress, we want the mattress returned for a full refund.  They have refused this request.  I am in procession of photographs clearly showing the defect.  These have been sent to Globe Furniture.  Our credit card company has been contacted regarding this dispute along with the Better Business Bureau.

 Most retail stores ONLY have a 30 day window in order to do returns and exchanges. By your own post you state that you made the purchase on 10/16 then on 11/18 you filed your complaint. Even though you did not recieve the mattress until 10/30, your purchase date is STILL 10/16 and that puts you two days past the time when they could LEGALLY do anything for you. You will have to take this up with the MANUFACTURER of the mattress. The retail store was already clear of legal responsability when you originally called. You should have taken the exchange because that was as far as the retail store was going to go for you.

YOU will have to PAY for the shipping of the mattress to the manufacturer. See YOU say defect, THEY say customer abuse. As they already have your money AND youre past the 30 day retail window, they do not have to budge. This is going to frustrate you. Dont let it. This LOOKS like a manufacturer defect and the manufacturer will have to replace it. If youre nice, the manufacturer may even pay for the shipping but it will be determined by YOUR actions and attitude on the phone.

The BBB is no help to you. They have no teeth OR power to force ANY company to do ANYTHING. You will have to be careful with the credit card company. If you file a dispute and it is proven that your dispute is false, you will see your CC company "pull back" from you. This one is actually quite easy to answer. Filing a false complaint normally shows the CC people that YOU are attempting to scam. They do not want a customer like that so approach it cautiously. As it has been since 10/16, I dont see your CC company being able to do much at this date. They will probably tell you that you are filing your disput too late for them to do anythhing.

Good Luck in your fight. You may need to retain a Lawyer and take them to small claims court to see any resolution.
