I entered into a Mortgage Loan Modification agreement with Great Western Financial Services owned by Mr Randall M Awad on 10/08.  During the loan process he stated that the loan would have a better chance of approval if I was behind in payments. He than requested that he would need $3500.00 to begin this process. Intially he started the negotiation but suddenly stop processing my loan, which I was left to negotiate with the loan company and the 2nd mortgage was never informed and went into collections.  Attempts to contact him were met with negative results and since then I have learned that Great Western Financial has been closed.  Mr Awad has opened another business under the name of R & R Holding Inc.  He refused to refund any or all monies for failure to perform and has refused any further contact.  I have reported Mr Awad and his company to California Attorney Generals Office and California Department of Real Estate.  Further research indicates that he has committed the same fraud to other clients.  The documents below are my correspondance to Great Western Financial and  Mr Randall M Awad and the California Attorney Generals Office.

In review of the fact that you did not perform in accordance with your promises and agreement and consider it appropriate by not responding to my concerns we are requesting return of the money tender namely $3200.00.

Your non-performance concerning the 1st Mortgage, the final decision is still pending. The non-performance by yourself, your parent Company Great Western Financial Service concern of the 2nd, did not perform as promised. 2nd Mortgage under Citi Mortgage was turned over to collections due to the fact that Great Western Financial Services never responded to their request from your office for confirmation of representation and no arrangements were made to negotiate.

Failure to respond within 10 days will result in taking appropriate action to include but not limited to the Better Business Bureau and California Department of Real Estate and possible lien of personal property. In consultation with other clients whereby you did not performed is another to pursue a class action lawsuit.

It is recommended that you take this notification as having validity, failure to do will give us purpose to insure you comply.

CONSUMER COMPLAINT

TO WHOM IT MAY CONCERN:

I am making this complaint against GREAT WESTERN FINANCIAL SERVICES C/O Randall Magdy Awad, et al broker # 01376932.

I am sending copies of my e-mails exchanged between me and representatives of Great Western Financial Services, copies of the contract with Great Western Financial Services, copies of loan documents, letter to Randall Magby Awad and proof of receipt of letter.

1). On October 21, 2008 I signed a contract for Loan Negotiation/ Loan Modification with Great Western Financial Services. During this period I had not missed nor had I ever been late with payments on my first with Countrywide Home Mortgage nor my second with Citi Mortgage. During a phone conversation with Mo Amir he stated that if you were behind you would have better opportunity of getting approval. In the e-mail dtd Nov 6, 2008 explanation of what they would do in their negotiations. In that e-mail he states that they try to assist people with ok situation attain low payments, lower interest, possible principle reduction and anything that applies to my concerns. Payment came in the form of card debit.

2). As indicated in e-mail dtd Dec 18, 2008, I asked that the final payment not be taken until all negotiations to first and second were complete. All monies were taken which concerned me.

3). I was concern because nothing that Randy or Moe (Randys second man in-charge) was occurring as they stated and as indicated in e-mail dtd Dec 24, 2008. Countrywide Mortgage sent a entirely different offer. Citi Mortgage had not been contacted as of this time. This off again on again offers continued and attempts to contact Mo Amir or Randy Awad were to no avail.

4). In e-mail dtd August 14, 2009 indicates finally a loan modification from Countrywide/ BofA. My payment was reduced approx $180.00 dollars for a trial bases. I am left negotiating with BofA on the final terms and still not completed

5). Nothing was ever done with the second mortgage as stated in the contract, which is now in collections. In a our final phone conversation my wife and I with Randy we were astounded by his advice concerning the second. His advice was to let the second go they cant come after you , change your phone number or dont answer their calls. He also stated that in three years it will drop off and if they continue calling tell them that you are filing Bankruptcy and that will automatically stop them . From that day forward we have made attempts to contact by mail at his business which closed and moved , by phone and no such number, and finally the letter dtd Dec 23, 2009 in certified receipt mail to last known home address which he did receive. As proof I am sending a copy of the return card.

6). I am sending this package in hopes that we may get some relief by refund for

non-performance and breach of contract causing damage to my credit profile.

a. I was left to negotiate my first mortgage with BofA which is still not complete and now currently making trial payments.

b. It was not timely. The whole process took longer than the contract stated 120 days. From first signed contract on Oct 21, 2008 to Sept 1, 2009.

c. Second mortgage never negotiated nor does it appear was contacted as stated in e-mails. Was left unresolved and in collections.

d. Also not timely due to non-negotiations and they exceeded the 120 days contract time.
