Green Tree Servicing LLC green tree is cashing our payment checks but is not crediting our mortage account. They are holding our payments. Rapid City, South Dakota

Five months ago Green Tree servicing purchased our  mortage loan from GMAC.  We've made five payments to green tree. 

March   $900.20 mortage payment  + $1,000.00 Extra Principal payment

April      $900.20 mortage payment + $1,000.00 Extra Principal payment

April      $830.16 Extra Impound Account payment (to keep our mortage payments same as 2012)

May       $969.38  Increased Mortage payment +$1,000.00 Extra Principal payment.

June      $967.05 Mortage payment  + $2,000.00 Extra Principal payment             

July       $967.05 Mortage payment

Green Tree will not credit our account for our May and June Payment.  Green Tree has placed our account in default. 

Our California Credit Union Branch Manager  David Elkins has provided all bank records showing Green tree cashed the checks.

We have also filed a complaint with California Department of Corporations.

Green tree has sent us copies of the May and June checke we sent them, but they will not credit the payments to our account. 

We have sent a complaint to th California Attorney General as well.

In addition  the Extra Impound Account payment we sent in April to keep our mortgage payment at $900.20 green tree imcreased payment.  When we call to have the $830.16 returned to us they refused. 

We then asked them to apply the $830.16 as extra principal.  When they applied the $830.16 as  Extra principal payment,  since they said they could not refund it nor could they apply it to our impond account, they then told us it was a partial principal payment.

We have been talking  to  Green TYree almost daily for a few months now.  They say they are researching. 

We have only been green tree customers since March because we paid GMAC for January and February.

I do not green Tree plans to correct this.  After they learned that we had no interest in refinancing our loan, things seemed to go downhill.
