You really never know till it happens to you. And when it does happen you feel as if the whole world is aganist you. And to know you might lose everything you have ever worked for. And it will be a sad day not for me but for these companies like Homeq Peoples Choice Home Loans Wachovia Wellsfargo and such.

When we went to Refinance it was to get out of the higher interest rate. Needless to say we are paying more now then we were at the higher rate. When i started looking for a place like all people we get flyers in the mail. Well after looking for a week or so i decided to go through the flyers and came across the one for Peoples Choice Home Loans. well a week before that i had talked to a lady at another broker place. well this was wierd because the day a made a appointment with Peoples Choice.

she called and said she had someone that could help me and to go to this address. well i did. it was Peoples Choice Home Loans. Now that scarey. well i all ready had a meeting there with the manger for the company here in colorado, much to my surprize she was sitting right across from me right by the manger. well needless to say she was dateing him. i found out after all this.

i ask for a 30 year fixed loan and to make sure that they escrowed the Taxs and Insurance in the payments. well we talked for over a hour and i thought it was understood but it was to be 5.99. well need less to say it ened up being 6.59. Well anyway this manger was being real pushy about the loan. i was starting to get mad so i called him and told him not to be or this laon wont happen. i dont like pushy people. well he did stop but to do this loan he sent to guys to our house which i thought kind of funny. they had the paper work for us to sign. well my Husband to sign. The manger told them i was not to sign any of the papers. just my Husband. i had asked why they said because the manger said my scores were low so he put it in my husband name only and my scores were higher than my husbands at the time.

Well little did i know we were about to get screwed and good. well i let them do what they had to and never gave it another thought. When the two guys were leaving i had asked about the Notary. they said that had to get them back to the manger at Peoples Choice. So now there was no Notary to witness the signing of them. ok i know that it not right. there has to be one there thats alot of money being sent to one place and the other.

I really thought I got us a real good loan. right not at all. one of the guys that came to our hous called me about 4 or 5 days later stating that he quit his job there because they were riping people off and did not any part of a company like that. and the other guy quit too and that he was really sorry. he did not want to lose his job at that time because he was just starting out. Now i can understand that but he could of said something.

so i would not of done this to my husband and i. well after i hung up i went and got the paper my husband signed and heres what happened. the 30 year fixed loan at 5.99 turned out to be a 3 year ARM at 6.50 with nothing escrowed. are payment stood at 1719 and 54 cents. Now whats really bad is this loan cost us $30 000 To refinance. all the paper work has diffrent Numbers on all of them. none of the fiugers match. charged us 3.5 orginantion fees . fees i never heard of and when i call to talk to them no one would.

so the manger sent our laon over to HomeQ and now there overcharging us. say were always late by two months. it has been that way sence they have had it and there trying to forclose on us. wont give us what we owe to catch. said they were going to charge us 30 days of lawyer fees on top of what ever else they want. and they took out insurance on our house for $189000 on a $272000 Loan which cost 2900 Hunderd a year .which has added 400 dollars to our house payment. which now is 2166 and something cents a month now our house is worth about $340000 and it is insured as a dwelling that only cost 189000 how can that be? and like i said the loan went from 240000 to 272000.

now to me and still there was no notary in all of this. not only should this company be at fault the Notary should also be. that was lot of money to go out with no witness there. Ive tryed to work with these people and it is like they really dont give a hoot about it. I also found out that these companies are branched off a place called Wachovia and i called Wachovia. they called and i tryed to call they back but i did not get a return call from them. so its only fair to say that these places dont really care what they do to you. they only care about filling there pockets with money that they steal from you.

I have even turned it over to the Attoreny Genarl office but i still do not think that there going to do anything. all i know is that these places need to be stoped before nobody has a home and take you for everything you own. and what makes it real bad is that we have sole coustody of my granddaughter and what do i tell her if they take our home. sorry nobody cares that is why we live in a tent somewhere. You know i should charge them for the stuff that they do to all of us. theres one thing i would like to do. But my foot is not big enough to fit them all. if someone has anyway to help it would be most. My husband and i just didnt riped off they. we were also lied to and cheated. Nothing is ever as it seems. HELP PLEASE

HOME EQ just sold my house, while simultaneously telling the foreclosure prevention company I had contracted with that they were not selling the house, nor foreclosing, etc. turns out, some of the information was in my customer service file, and some in the loss mitigation file. I'd like to have some contact with Rino, who may have info that could assist me in this case. Thanks, Lindsey

3 days you say what 3 days we were not givin 3 days .Well let me see they do what they only Honor What you have signed what the hell are you talking about they do Honor nothing they over charge you they do not honer nothing maybe them selfs you got a lpt of Nerve telling me that crap you must work for them man i feel so sorry for the Ignoramus person in you.

Let me see they were not even there when the papers were signed and there was no closing for us they had one at Peoples Choice but we were not there so you need to do something other than say read your paper work! You need to go back to work and learn something ok or maybe you should take a break from telling me or anyone else anything If you have not walked in anyone shoes but yuor own you should keep your

Well in every state BY LAW you are given a 3 day recision period to read over the loan documents that you signed. So my advice to you is utilize those 3 days you are given and read before you sign. As far as Homeq Servcing goes they only honor what you agreed to when the documents were signed.

You Have been such a big Help in this and yes it has helped and you are right about the Notary and that is where i should of started in the frist place instead of going Crazy. I wanted to tell you that you are the kindest person i've ever met on the web Your Heart is big and caring And i'm Glad you are doing the work you wanted to, You will be very Successful in what ever you do. You Know in life it is hard to find honest people anymore and you are one of the honest and that is very rare May life alway give you what you need . I was thinking about your case. The Notary would have actually been a title producer as well, which requires a bond for just this purpose. This is an issue of Honesty and Ethics for that person. I left PCHL to become a Settlement Agent. I am a Notary in two states as well. What you should do is contact first the authority which appoints Notaries. Probably the Governors office. The Notary is a public servant who swore an oath to uphold the constitution, etc. Inform yourself on "Notorial Actions", most states require a log book to be kept for four years. My log book for instance must list your name, your address, the type of documents notarized, the form of ID ID number and expiration date used to verify your identity, your Thumb print and your signature. All in original ink. It is a crime for me not to do so. You can also downloan the state notary handbook online I am sure. Next you contact the state land title organization (Private non profit) to which this notary may or may not be a member to find out what agency oversees title producers and settlement agents.

With that in hand you can now contact the state and initiate complaint resolution and look for compensation from the Bond. Bonds are typically 100,000 against dishonest actions only. This would not apply to the errors and ommissions insurance. Make sure you don't waste time on their insurance as it is not applicable. Notaries carry insurance against errors, and are bonded against dishonesty. If you can prove the notary was not present at closing; The mortgage documents are not worth the paper they are on. You could easily find yourself in your home free and clear with NO mortgage.

Going after the mortgage company is incorrect as a typical complaint against a lender is failure to send RESPA documents, discrimination, redlining, etc. So while yes your issue is with the mortgage company with whom these title folks are in league, it is infact the title transaction you should be attacking. I think maybe 1000's of such complaints go unresolved because folks hit a brick wall with the lender having "all their ducks in row" as you said. While never knowing how easily they can resolve this through the fidelity bond surety company.

Hey thank you for the info , But ley me tell you what happened I went to PCHLI here in Colorado. The loan was a 30 year Fixed. I was on the loan then they took me off , Two guys came to our house on a Saturday with some papers to sign and told me that the Manger took me off the loan cause my credit was to low and that was not true mine was higher than my Husbands at the time they did'nt explain nothin so hubby thought it was the same loan Then some how came up with a foney Quit Claim Deed and a Notary signed it

also They had a closing on that monday and never called us to come down to be there Thats when they changed they Loan papers on us I went down to find out what happened and they told me they already had the closing I looked all over for the Manger to kick some butt but I always seem to just miss him then i found out that we had to the 27 to cancle and they told me that there was nothing i could do about it because my 3 days was up and i still had a day to go which they lied to me

Ive tryed for three years now but they have always put me off send me here send me there and And besides that why would i want a 3 year arm when i wanted out of the 2 year arm we were in Then when i started digging around Peoples Choice Home Loans Inc Put us at HomEQ Servicing And that even made everything worst than what it allready is because there no better they have been double Charging us on everything

And they never sent us any papers at all and when the 2 guys were here They said that they needed the papers i had But what they failed to know i was looking at my papers with the loan the way it was to be And i still had some of them out of the envlope and i for hgot i had them But i never got the chance to give them back and now i'm Glad i did'nt give them back now

And our loan went from $ 240.000 to $ 272.000 Now i call that Real steep and then they also pulled papers from other loans to use with our sig on them that i can also Prove Please write back

The best thing is to send to both variations. The Senior VP actually also left along with quite a bit of management recently. I would suggest Dan Sussman (dsussman@pchl.com) and Heather Iacovino (hiacovino@pchl.com). Dan is the VP of operations. He had helped to found New Century Mortgage which is in flames right now with prosecutors and SEC investigators. He helped to found PCHL in 1995, and certainly would want no more contreversy. Heather is charge of Nationwide Licensing. Also try the email address Retail All at PCHL.com and Wholesale All spaces not dashes on these. If you are able to get through, your comments will be read by ALL full and part time employees nationwide.

They also list their departments that way. Customer_Service, Marketing, etc all at pchl.com

One of PCHL's major issues LEGALLY is the failure to ever send a good faith and Truth in Lending. It sounds like you are one of the few that they actually bothered to send it to when you applied, it sounds like that is what you found in your drawer. Usually the processors just print them so the system thinks they have been mailed, then they shred it. The issue you have is they made a material change to the loan offer after that was sent. A good company will "Redisclose" loan terms if certain changes to APR or program occur. Infact the system would have indicated this to the processor. It is ethically but not legally required.

Print this and show to your attorney, as I certainly would not want to give legal advice. But I am certain from what you have told me that infact redisclosure is what is missing here. While it may not be a criminal omission on their part, you might be able to make a strong civil case for this. Also, did you have a credit report in your package? If the date of the credit inquiry, and the date of that disclosure are more than 72 hours apart, the proof you need is in your hands.

I Got Me A Lawyer To take My Case .

I did everything i had to do even sent the Attorney General of the United States of America In Washington DC I sent letters out to all that were corcerned with realastate Hud FBI the people in the Gov of Colorado, After that i got everything together like all the paper work taxs Insurance and all that good stuff I had everthing but that Dam 2004 Papers I have looked all over and still nothing could not find them papers any where . well as i sat in my office having a cig I needed something out of the bottom draw and i was a little mad about not finding those papers

well i pull thne dang thing right out of the hings so i got down on my knees to put it back in there and when i looked in the hole there there was some things way back in the back that had fallen down. well guess what i found those dam papers they have been stuck back there sence 2004 And those papers say 30 Fixed. So now the funny thing is i really want to see what they have to say now.

I want to tell you this i know that there a lot of people on this site going through alot with these loans. do me a favor DO NOT GIVE UP on this. write as many letters as you can to everyone. make it something to Notice. send your President a letter. the more letters you send him the more he will notice what is going on. also send the Attorney General of the United States a letter. i did flood the Housing HUd. Your Govenor who ever is in the house. also turn it over to the FBI. they also are investagating alot of this.

they made you and i hurt by doing what they have done on our homes. now its there turn to hurt. Just tell your self Im Mad as Hell and im not going to take this no more and never give up. it take a little time to get it done but it can be done. Oh yea i would like to Decipher that company but they wont let us give out a email Address. that also would be very helpful. Please ripoff Report.com Please let this person have my email Address. i give my permmision to.

Please Rember the letters write them and keep writing them and dont stop till they answer you . If everyone that has a problem with the same company think how many letters that they would get and something then would have to be done. Ive worked on mine sence July of last year through the foreclosure and there lawyers and all that crap. if i can you can and now im taking them to court. This is my response to your message you left .Weather We signed papers or not there has to be a Notary there as a thrid party witness and in our case there was no Notary and there was no closing they had a closing but we were not invited to it and also they did not honor the 3 day Right to Decline and there has been a date set for a hearing in Court with the Secertary Of State and the Notary who had signed the papers stating that she had seen my Husband and i sign them In 2 differnt Counties in the same day .

And also HomeQ Servicing Corperation Has been charging us Double Payments and i can also prove that I all ready have. Not to be mean or nothing My Father was also a Attorney and if there was one thing i had learned from him was never give up when you know that you are right and for you to tell me that i have no case will you only know part of it not the whole thing and it really is a real messed up Refinance and we were riped off and Frauded and I know that you might never take a case like this because you feel it would not be worth your while but there are plenty of others that will take a case like ours and you should be on the watch Because HomeQ is not a very good place to have your Loan Serviced and sence it it is a Parenting company off a big old Bank Called Wachovia and was a over seas Bank and now they have there big old Bank here and the companies that i put in my report are only a few companies runed by this Bank and the real funny thing is all of its investors are all from the other side of the world and it seems that these Investors have more money in our Relastate Over here than the Americans do So i have one more thing to say In the last 2 years we have Made 26 house payments and we have just wired them 12,217.58 cents Because they said we behinde 3 house payments and all that crap and to me i really think that we have we have pated way over the payments and to me as many house payments as we all ready paid i would say that we are way over

But anyway Im no Quiter
I have more than a case in this matter

I was trying to find the Home Q website to pay my bill and came across this board. There seems to be a lot of bad comments about them, but personally I have never had an issue.

Looking at this post though, I am really concerned bt the fact that you didn't read the loan documents when you signed them. While I understand your frustration, I must point out that everyone should remember to read everything that they sign, regardless of how long it takes. If the person wants you to agree to a loan, they can wait on you, regardless of how "busy" they are.

As an attorney, I can almost guarantee that you don't have a solid case. A written document will override any verbal agreements.

I have dealt with situations like this numerous times and the number one suggestion I have is quite simple. Read your contract.

I was trying to find the Home Q website to pay my bill and came across this board. There seems to be a lot of bad comments about them, but personally I have never had an issue.

Thank you for helping but everything i have done seem to go right under. they seem to have there Butts coverd no matter what. I have been to the Att Gen and all they gave us back was the Brookers Fee they charged and now im at the Secretary Of State going after the Notary Because there was no closing. if there was we were not invited to it and when the 2 guys that came to our house had us sign and put our IN on the papers thought that was a closing, i got news for them.

the Secertary Of State siad it looks like a 30 fixed loan to him but we have papers that say 3 year Arm Conventanol loan and the Notary said she had seen us sign the papers on the 23rd in which there was us and 2 guys from the Company. But im not giving up Im going to fight this to the end. Im no Quiter and you can bet im going to bring them down for what they have done to my Husband and i and i will not stop till i do.

I was told by the Secretary Of State to take the papers to The District Att in my County in which i live on the borad line of 2 Countys. so i have to take it to both of them and go from there to see what they think and i hope they see what i see . Because i feeel no one should be Frauded and if we keep letting this happen to us no one will ever have anything .

Just to let you know that alot of these big Companies are owned by companies over seas and Im a American and i will not let them take what i have there even owned by the Country that we are helping which dont surprize me at all . But if i could find the help i need right now i would do it but i really can not afford a Lawyer. HomeQ Servicing took 12,000 200 Hunderd dollars and 58 cents from us and I doing what i can. but i thank you for your support. it makes us feel alot better that we know some one really cares out there.

I got a call this morning from the Attorney Genral Office stating that they see nothing wrong with the refiance that happen with Peoples Choice Home Loan Inn and HomEQ Servicing Corperation what they did was right, You know that it is so easy for people to rip you off legaly that it is a shame when you go to one of the states people to get help and they can not even see what has been done Stating that they had the same paper work as we did that still dont make it legal youy can be so riped off legaly it is not even funny That shows Peoples Choice and HomEqs Servicing that they can go head and still rip you off Now it will cost us this is to stop Foreclouser $ 12,217 58 and remind you were are now three months behind and the Lawyers want $ 3 000 00 of that for doing noyhing at all so now it looks as if some one is making alot of money Being legaly ripedoff is a crime to but you will never find anyone to prove this because it is to hard to prove you as what was said in the start of it all and you still look like your the one who is wrong no matter what you know i would like to stick my foot so far up there ASSES Just to see if it was there Brain i was KICKING So sence the Attorney Genral says they have done no wrong that just gace they the right away to rip us off more How about Not only do we have to make that payment they never Escrowed our in surance and taxs and thats another $4000 00 dollars out of pocket now just to get out of this 3 months of mess it will cost us $ 17 000 00 Dollars to get out of this so we can get riped off some more Legal ripoff and fruad all of this is so bad because they are getting away with it And who the hell cares no one but our selfs this is all i see Refiance $240 000 00 loan cost $272 000 00 and to stop foreclouser $12 217 58 and lawyer fees for doing nothing $ 3 000 00 Insurance and tax's $ 000 00 and there still stating that we are still short $ 2 000 00 short in the account This is all hopless now what do you do i guess nothing So Much for The Attonery Genral he didnt get no tv Special to do this it did benifit him so what the hell is he good for Nothing Nothing Nothing
