   My Husband and I hired the company for loan modification services based on the fact they said they were registered with the CA Dept. of Real Estate and had a no objection letter that allowed them to take money in advance as they are SB 94 compliant. Turns out they are not registered and do not have Attorney representation.


    They took our last $2900 of our retirement money in advance in violation of CA law SB-94. We cancelled as soon as we found out they were operating illegally and before any work was done. They also signed us up before they reviewed any information to see if we qualify. When we cancelled, they said the refund would take 10 days and are now going on well over a month and no response.   


   We are both going blind and are elderly. We cant afford to lose this money. This company scammed us.

Potential way of commencing an action for refund

There is a way to work on getting a refund. Do you have all paperwork and correspondence? The DRE most likely can help you out here. Their agenda seems to be to work on getting consumers a refund whenever applicable/possible (i.e. on the consumer side when applicable). Please contact me so I may give you some suggestions of how to start this process. There are different stages. not sure if they can get you a full or partial refund. There generally are three different steps involved in a Modification. The only way to find out what the DRE can do is to initiate a complaint.
