A prospective buyer, made a purchase in this park, and the facts, will explain how you sell a manufactured home with no title. How sales agreements, application for title, a note for monthly payments, and all disclosures are presented, signed, and delivered with keys, but no title!
A company called MMIS, abbreviated, runs a ad on Craigslist, stating that are offering a mobile home, that has been renovated, with new plumbing, new furnace, all electrical in good operating condition, new flooring, with terms of x amount down, interest free, $300.00 per month.
You set a appointment to see this home, and they state how much they have renovated, and all is in excellent running condition. In the mobile home business they end up calling this lipstick on a pig, you are suckered in, if you believe them and don’t get a inspection. Unfortunately I never got a inspection.
Their contract does state all is warranted in good and working condition.
You close this transaction, after park approval for the space, they guarantee delivery of the title within 2 weeks after closing, from the park itself, from who they claim they bought said mobile home from.
The buyer moves in, and after 3 weeks, a process server is at the door, with eviction notice for a previous tenant. You immediately call the park manager, and she asks you not to read this paper work, but to please bring it to her office, as it was served to the wrong home. Park Manager takes your paper work and hands you a gift card from Home Depot for your trouble.
In the meantime, said mobile home, has severe plumbing problems, washer box was plumbed wrong, so the kitchen has water overflowing from the kitchen sink all over the floor. The shower was backing up, toilet would only flush if it wasn’t feces, and the smell, that I thought was sewer gas, was absolutely repulsive. Water heater was leaking, Not to mention, the garbage disposal (new), didn’t turn on. Several other switches in the kitchen didn’t work either. The swamp cooler that was warranted in good working condition, had no float, the bottom pan had been sealed over a crack, and they even sealed the drain plug, the motor is over 30 years old, and was barely turning, the new water lines installed were leaking.
Call a plumber, call a electrician, call a HVAC company. Get the estimates, see what the price tag is, so this home is habitable.
14 feet of the sewer line under the home, was cracked, sewage was dumping on the ground, under the mobile home, the bottom of the belly of the home was left open, as their new plumbing had been run through the heat ducts, (this is not code), the insulation was left on the dirt underneath.
Plumbing price Tag $1760.00, Electrician, new switches in the kitchen, The Hvac I will save for later.
Of course, you write a email to MMIS, they represent themselves, as I don’t want to hear this, make your payments. Also in the email, from purchaser, Where is the title, you have not filed it. Their explanation, make your payments you don’t get title to the end.
Now the purchaser has paid their down payment, made a payment on this mortgage, and all these issues have to be addressed, as this is not habitable with these living conditions.
Purchaser is now, running up credit cards, make arrangements to pay with a plumber, getting the electrical fixed in the kitchen. Living in a hot mobile home with no swamp cooler.
The purchase was made 8/15/2013, this did not get all completed until December of 2013.
That meant no use of toilet, no shower, no laundry, and imposing on family and friends.
The fall comes, and the new furnace is not heating the home. Why, because MMIS, failed to get a permit, and it wasn’t installed correctly, and the previous plumber, ran plumbing through the heat ducts, and left the end caps off, now your heating the outside. MMIS solution, I will defer a payment to help you out, and we still have no title. Please make next month’s payment.
Now the truth comes out, MMIS, never had a title, there is a actual owner, who now wants x amount of dollars for his said mobile home you purchased from MMIS. Actual owner, places a lien against his own title to insure he gets payment from the purchaser, who bought said home from MMIS.
Purchaser in now in a position to make a decision, for legal advice. Purchaser pursues the title thru Department of motor vehicle (DMV) on abandonment. DMV, certified inspector says no vin # on the said purchased home, That needs a new Vin #, and back taxes need paid. DMV has you file all documents, and makes decision that said home is still the orginal owner who placed a lien on it.
2 weeks later, decision from DMV is overturned and purchaser gets Title.
Now this gets interesting, Holiday Hills park manager is now wanting the title, offering all kinds of options, free rent ( in a new unlived mobile home for 2 months), to $9000.00 off any home they have for sale. To obtaining, a free title to another piece of garbage with frozen pipes. The park manager, also had another answer, that we share the costs to pay off MMSI for a reduced price.
Remember MMSI has no title, but has produced copies of their purchase from the park itself. Interesting part about these purchase documents, they are unsigned by the park, although they do have the parks company name on them, and have presented no proof of payment for the said mobile home.
MMSI, decides no deal, purchaser says no deal. MMSI, retains attorney out of boulder, whose form of collection is intimidation. Amazing enough, MMSI sues the purchaser, because they have no title, never had title, but presented their breech of contract, signed by purchaser. MMSI, is representing themselves in county court. This makes you go hmmm, what happened to their pitbull attorney out of boulder.
Purchaser has contacted, corporate office for an explanation of this sale, as purchaser was given park approval, purchaser has made every payment for the space rent. After 2 weeks, of trying to get a answer, did Holiday Hills sell this home to MMSI with no title, there is a answer. Yes, Holiday Hills Village sold said mobile home without a title.
Moral of this story, purchaser has title, home was misrepresented, and park now has a attorney.
