In 1999 we took out a consolidation loan with The Money Store. That loan was bought by Home Funding which turned into HomeQ or Wacovia or whatever!! Anyway, the original loan was for $35,000.After about a year and a half I got sick with Lupus and Fibromyalgia and could no longer work. I applied for disability and had to fight for that. After we fell behind on our payments with HomeQ we tried to get cought up but we were overwhelmed with medical bills and so forth.
We were put into foreclosure and forced to file bankrupcy like so many of you who have dealt with HomeQ. We got the shaft from our bankruptcy attorney too!! They actually showed up on my front lawn twice to auction off my house! We were told by our bankruptcy attorney to file chapter 7 to eliminate our debts and this would save our house from foreclosure.It didn't. Then he told us to get a reinstatement amount from them which he couldn't get either. Nobody in that company would give us a definite amount.
We went back and forth for a year trying to get an amount. Finally in May of 2004 an employee named Mandy gave me a figure of $8,767.29 to put us up to date and she said that would include June 2004 payment also and we could make our next payment in July and we would be fine. I sent them the check for $8,767.29 overnight mail so they would get it quick and we could finally put this nightmare behind us... what a joke!! My husband called our July payment in on time over the phone only to be told that they couldn't except it because we were in foreclosure. He told them that we were paid up and explained how we sent them the check for $8,767.29 and we were now making our payment for July 2004.
They told us that they didn't except the check and we would be getting it back. Now this was five weeks later! We got the check back the same day we got our foreclosure papers and now they were telling us that we had to pay them $19,000 for attorney and filing fees!! So we went back to our attorney who told us that now we had to file chapter 13. Then on the day we were to go to court... he never showed up and the judge told us to call him to come down to the courthouse.Our case was continued and after numerous continuations we were given the wrong court date so it was dismissed. We now have another attorney but HomeQ continues the GAME! We went to court again May 4th and everything seemed to be in order and every time they told our attorney that we needed another payment- they got it. So when we went to court we were up to date with our payments to HomeQ and the Trustee. Now they claim we never made our April payment! They have been doing this to us ever since we missed our first payment. Then they tell us that our payments are only going toward the interest and nothing is going on the principle.
Nobody wants to help us because we filed bankruptcy. My nerves are shot and my health is declining daily.SOMEBODY HAS TO STOP THEM... Please! I have lost all faith in our judicial system. It's a joke. Our $35,000 loan is now $54,000 after paying on it since 1999.No lie I have the paperwork to prove everything I've said including the returned check that they staped "for deposit only".

Now that we are done with our chapter 13 and making our payments to HomeQ and the trustee, and after HomeQ claimed we were behind on another 2 payments (first they claimed from 2006,then when they were shown the proof of payments made, they claimed 2004 plus late fees and attorney fees). We are now trying to refinance again with another company and when the loan officer contacted them for a payoff amount, they added another $10,000 to our total claiming they gave us a cash advance of $10,000!! It never happened and is a outright lie. Anything we got from them was included in the original $35,000 loan which they took almost $4,000 right off the top for thier fees. So everyone... I'm still trying to find an attorney and i've written to the National Consumer Advocacy group who also helped everyone from the Ameriquest scam. My next move is to go to the media because nobody seems to want to get involved. Oh yeah, by the way ... I did recieve a letter from HomeQ stating that they should have taken my original check for $8,767.29 and they were sorry for the "oversight". Can you imagine,an "oversight" which accumulated into $65,000 so far!! And our payments are still being applied to the interest only and we haven't received a statement from them since 2003. I'll be in touch to update you on my progress when i stop hitting my head on the wall of justice!!
