HomEq Servicing Wachovia Would Not Except Full Loan Payoff will take, Sheirf Sale instead. Ripoff Sacramento California
I had fallen short on money due to employment status had to file chapter 13 bankruptcy home was forclosed on. Sheirfsale date was set but found buyer for home. Orded short sale packet from HomEq was told it would take 30 days to review and let me know if the offer would be excepted. That offer was denied.Did 3 way call with person wanting to purchase property going through Master Morgage. Offered $80,000.00 they said they would except $87,500.00. Okay got funds to title company Insured Title. They were waiting on the demand letter from HomEq servicing. Letter was faxed but it stated 2 different amounts.There was also 2 leins on the home an Irs lein and a judgment lein that would need to be paid off so the buyer could have a clean title. HomEq added a little blurb that stated no leins or judgements could be paid off.Any changes to this would have to be approved though them. I begged and pleaded for a week tring to get this straightened out even did a 3 way call with my bankrupcy attorney and they person told him they would allow the judgement lein to be paid off if I paid it out of my pocket. Okay but the money dispersment still had to show on the hudd sheet from the title company and HomEq would not approve it. So I got another person tring to help me when I told him the story he asked are you sure that is a short sale. I had requested many times to talk to a supervisor but all I got was voicemail and no return call go figure!I requested a full payoff after that was told it would take 3-5 days to get it or depending on what person you happened to get 5-7 days. One person even told me that the last person I talked to emailed the payoff request to someone's desk who was going to be away for awhile. Got the full payoff was $87,974.49. Got approval from bunkrucy judge to sell house but still no exceptance from HomEq to stop shierfsale.Friday after all of my ducks were in a row money in title company escrow account ready to be sent it is still sitting there at 3:05 pm I got ahold of someone who told me they had been checking their incoming wire account and found no funds. Never recieved okay to wire money so couldn't had to be recieve at HomEq by 3:00 so it was too late. So here is what I will loose....My chapter 13 would have been paid off. My husband would get a normal paycheck again His wages had been garnished for the last 2 years brings home $178.00 would have been $400.00.Would like to have not had a home sold at sheirfsale on my credit history the bankrupcy is bad enough let alone missed work to make all these phone calls mental anguish cased by all the stress one minute they would except next minute this has to be removed. Can't be excepted. No minutes left for the month on my cel phone because of all the calls to HomEq to straighten this out. I have lots of proof and it should be illegal what they did. Master Morgage and Insured title went over and above the call of duty to make this happen.HomEq did not want my house to sell for some reason they are hoping to make alot of money from it oviously. By the way it appraised for 123,000.00. I am looking for legal advise I have documents I will get phone records what ever it takes because this is just wrong doing on HomEq's part. I am sure Master Morgage and Insured title will help in any way possible they also can not beleive the bank would not except the funds.
