I had a credit card with capital one and made payments on time. at some point i ended up out of work and could not make the payments. credit insurance helped for a while but it got to the point where i was stuck. capital one wouldn't work with me and my account ended up at a collection agency. the agency wouldn't work with me either and i couldn't send them money i didn't have so in steps howard lee schiff, who is supposed to be a lawyer.
i ended up at court and was forced to pay $10 a month which i didn't have but the lawyer wouldn't let it go. some companies will agree to forget the debt if you are totally broke. i didn't have a lot of money but i made payments when i could. then i started getting 2 or 3 phone calls a day complaining that i couldn't pay them. phone calls to them got me nowhere.
one day i was getting ready to go grocery shopping and found that schiff had removed all the money from my checking account, leaving me with nothing. i never got a letter stating that they were going to do it and it wasn't until a week later that i got a letter from the bank explaining what had happened.
i went back to court to get the money back that they had taken and met 4 other people in the same situation. it took about a month to get the money back. i also found out totally by accident that there was a lien on my house that they had put on.
a year later they took my money again. for a group that calls themselves lawyers they do a lot of illegal, underhanded, rude, and threatening things. they need to be stopped and a class action needs to be brought against them. too many people have been hurt by them. they need to be out of business and they need to return all the money they stole. i never did get a letter from capital one stating tht my debt was paid and the phone calls continue.

I went on the State of CT Judicial website and did a search for "Capital One". The list of lawsuits this collection agency has filed is ASTOUNDING. Here's the link, you may need to cut and paste:

BTW, this is just the list of cases currently pending in Connecticut courts.
If that link doesn't work, simply go to http://www.jud.ct.gov/jud2.htm and click small claims, and click "search by party name". Type "Capital One" and you'll see.
I wonder if I could use this in court as proof of overzealousness?

Consumers are at a distinct disadvantage when they find themselves facing a law firm such as Howard Lee Schiff. By the way, Howard Lee Schiff, died many years ago.
Understanding what can be done to protect yourself and even possibly have a counterclaim that could potentially be used to offset your debt, are important things to know about.
Also, Howard Lee Schiff has been involved in class-action lawsuits recently for charging interest that they were not entitled to charge. They also were sued for charging interest on costs that were not part of the original judgment.
You mentioned that they continued to harass you on the telephone. Even if you did not answer the telephone and they caused it to ring and ring, this could be a violation of your consumer rights under what is called the Fair Debt Collection Practices Act (FDCPA). There are literally hundreds of things that law firms and collection agencies do wrong, that you can use, that can help you gain leverage either in a negotiation or counterclaim situation.
