Hsbc Orchard Bank Best Buy Mastercard card has been cancelled for months now getting harrassing calls 4 times a day from computer charged me 59 dollar annual fee and are racking up late charges on a card that was cancelled Nevada

My best buy mastercard was cancelled months ago after I paid off balance. Then a month ago I get called all hours or the day from some 800 number who NEVER leaves a message and phone hangs up after I pick up phone. I searched the number on yahoo and found millions of complaints on the number for orchard bank hsbc bank.

I went online to check my old email and found an email entitled late payment etc, I clicked on it and was bought to a link for my old best buy mastercard. I logged in to it to find my statement said I owed 120 dollars!!! Then I saw it was for a 59 dollar yearly fee then months of late fees!!! As I stared at the statement in disbelief that I owed 120 dollars for a card I no longer had and cancelled was quite disturbing. As I looked at the statement one of those customer service windows popped up asking if I wanted to talk to someone so I clicked yes and here is a direct copy of what took place:

you : dont know my account number
you : I dont see it on my account page
Om: I can pull up your account by using your Social Security number.

Om: Thank you, please give me a moment while I access your Account.
Om: Thank you for your patience. I have your Account pulled up now. The current amount due is $45.00, can you pay that today?
you : I cancelled this card months ago since it is ridiculous to pay 59 dollar yearly fee and now I see it wasnt cancelled and now you guys also put late fees on it, I don't even have this card anymore
Om: I am sorry to hear about that. It sounds like it's a really frustrating situation.
Om: I'd be happy to do what I can for you.

you : I didn't know why I was getting 5 calls a day from a 800 number, every time I would pick up it would hang up so I was doing a search online about this number then found out it was you guys and found a site where hundreds of people where complaining about it because they call and call and call and don't leave a message
Om: I am sorry for the inconvenience caused to you.
you : I know its not your fault i am just pissed off now that I see what it was
you : but I am sure you get alot of angry people
Om: I can understand, the $45.00 payment will cover the past due and minimum payment amount, which will prevent an additional late fee from accruing. This will also prevent the Account from going to the next stage of delinquency.

you : the card was cancelled the only money owed is the 59 yearly fee that was added which should have never been added since I cancelled the card dont use the card and dont have the card
Om: Since the card is not yet cancelled, we can work with you, so that we can bring your account current.
Om: I can credit you the late fees as a courtesy, can you pay the remaining amount to catch up on this account.
Om: The following payoff is an approximation, which could be greater than but not less than your actual balance. This amount is only valid for 10 days from today's date. Your payoff amount is $122.79, I can credit $58.00 late fee, can you pay the remaining $64.79?

Om: This will ensure the account has a zero balance and no more charges gets added, we can also send you a new card.
you : I don't want the card that is why I cancelled it when I paid it off
Om: I realise that, but in case of emergency, you can still use the card.
you : I have other cards with no yearly fee that is why I cancelled this card
you : then I find out its not cancelled and I magically have a 120 balance but havent bought anything
you : and on top of it get some automated 800 number calling me 800 times then hanging up when I pick up

Om: Since you are only concerned with annual fee, you can speak to our customer care to see if they can stop the annual fee next year onwards.
Om: Lets get your account current today so that you have one less thing to worry about.
you : I am not worried about it I am pissed of since I somehow owe 120 dollars on a card I don't have and cancelled as I am sure you would be
Om: I understand, that's why we are asking you to just pay $64.79, to catch up on your account.
you : I don't have an account why would I pay 64.79 or 2.99 or 1.50

you : If anything hsbc should pay me 64.79 per time they called me violating fcc regulations and I would have $654,000
you : I realize credit card companies make most of their money on late fees and whatever but the interest they make should be enough
you : but you are persistant I'll give you that
Om: Thank you.
Om: I see you have made payments in the past with us. Are you still banking with associated bank, account ending in 0534?

you : no i have switched to tcf
Om: I will be able to set up the new checking account information for you. May I please have the new routing number and checking account number?
you : why would I give my account numbers when I am not paying anything
Om: I thought that you agreed to pay $64.79.
you : if some stranger came to your house and said hey give me 120 bucks, I didn't give you anything or do anything for you but I did harass the hell out of you would you pay them?

you : I have everything I typed in front of me, I don't remember that and I don't see that
you : besides the fee was 59
you : which is 58 more than it should be
Om: I understand, but that is the best we can do.
you : so let me get this right, you want me to pay 59 dollars for a card I dont have, a card that I paid off, a card that was cancelled
you : doesn't sound like a good deal

Om: Then in that case I would request you to please contact our customer service department at 800-419-4959.
you : thats a good idea first I will call tmobile to get a log of how many times there automated system has called and hung up on me but it was fun talking to you
you : i just won a case against capital one in kenosha county, maybe hsbc will be next

I am still in the process of dealing with these jacka**es, something needs to be done about these scamming credit card companies!!!!!!!!!! this is just the beginning I will keep you all updated

small claims and judgment proof letters may save your credit

I forgot to mention an additional step:

 

if you are on government benefits, you can mail in a judgment proof letter, say you have benefits, and that you will pay at a future date when you can afford to pay.

if your report is ruined by the charges and late fees, contact the credit bureau and explain how the company is advantage of you. the credit bureau may block their negative info. Sometimes when small claims start and letters like judgement proof letters are sent, the credit bureau will not report the bad credit. I have something that has been in collections for years, but I sent a judgment proof letter, plus filed small claims and I still haven't seen it on my credit report as negative.

Solution to annoying collector calls:

First, don't answer the phone and don't listen to their threats that you must pay now or else suffer more financial damages.

Mail by certified mail a cease and desist letter to ask the collectors to stop calling. Just write a letter with your address, the companies address, include your account number, and ask them to cease and desist their calls, and say by law they must stop calling you when you've asked them too.

Lastly, you could file a small claims action to make them reduce the fees and tacked on charges. Once the file is in small claims, many companies will immediately stop all their bull with you and even offer to reduce charges.

Take action, don't be victimized anymore. You probably feel too stressed by now, but it doesn't have to be this way. These companies will take advantage of people if they don't do the above or take actions to stop them. It's not as bad as the collector will make it seem. Don't worry.

I have worked for HSBC as a collector and it was my experience that a lot of time when people say they canceled the card they didn't actually call in and close the card. They just payed it off and throw away the card, cut it up, mailed it back to the company at the payment adress, or called in to cancel it and then was suggested to leave it open for one reason or another and then decided to do so. You are informed when you first open the card of an annual fee. If you don't like it don't open the card its that simple. And they do call on an automated system if someone doesn't answer a about 4 to 5 rings then the rep on the other end of the line will pass the call and move on to the next. So if you just answer the first time you can take care of the calls. FCC doesn't regulate the # of times a credit card company can call to collect its the FDCPA. And HSBC has a company policy to not leave a message. Under the FDCPA again the company and let a third party know what the perpose of the call is. So they don't leave messages because they don't know if a third party my hear it. If one did HSBC could be in a lot of trouble. Even though you didn't buy anything you did have you anual fee which caused the card to carry a blance thus you got late charges because you did pay your min payment. If you did call in and canceld the card and it was HSBC mistake for not taking care of it then yes everything should be removed. And as a note to people reading this... sending a letter or anything other then a payment to the adress that your payment goes to means the company doesn't get it. That adress is just for payment processing you can call or go online to get the corraspondance adress or fax #.
