September as a treat for my mother and myself. Tony talked me into signing a contract for a short 3 month tanning package at $44 a month, which included a bottle of lotion, that I could cancel after a month if I needed to, since I probably wasnt going to be able to afford it the next month. I was very nave and thought it was just a little tanning salon and he seemed really nice, like he was genuinely doing me a favor. I did not get a copy of the contract I signed. I paid $50 dollars on August 1, 2012, instead of the usual two months down because I told him I probably wasnt going to be able to keep it going the
Toward the end of August there was several separate times that my mother and myself went into the tanning salon and told them we wouldnt be tanning the next month and to close the account. Neither Tony nor Jon said that was going to be a problem. My mother even asked when the last day she could tan was, was told mid September, and she replied that couldnt be right we were only tanning for a month. The last time she tried to go tanning, the owner Jon, told her the account was closed until I opted to re-open it and continue paying. Nothing was ever said about a $199 cancellation fee. Everything was
fine through September.
But on October 9, 2012 I saw on my banking statement a charge had went through on October 6, 2012 for $44 dollars from Islands Tanning. I did what any concerned customer would do and called the number that was provided on my banking statement, 503-888-1914. I reached a Jon Guyette, the CEO of the IslandsMedSpa Franchise, and even though it was 4 pm during business hours on a Tuesday, he very unprofessionally told me he could not help me as he was at home doing personal business. He then proceeded to rudely demand where I had gotten the phone number I had reached him at. When I
informed him it was on my banking statement, he told me I was lying. When I continued to try and explain the situation he rudely raised his voice to interrupt me and tell me I had signed a contract. When I continued to try and explain that if he didnt listen to the situation I would take further action against the company he simply stated again that I had signed a contract and
I had to go to the Oregon city location to pick up a copy of my contract the corporate office had to fax them. When I got there, Tony and Jon were both very rude and not at all sensitive to the fact that I was not only irritated but upset at my lack of funds available. Jon lied and said he had told my mother the account was delinquent the last time she had tried to tan,
and that they had tried to run my card on September 1, 2012, but it was declined.
Jon even asked if I would like to tan.
When I confronted Tony about the fraudulent sales and asked him why would I sign a contract for several months when I barley wanted a full month he smugly replied, Yeah, Why would you have? After I left and looked at the copy they gave me I was shocked. It was not an exact copy of the document I signed. It was only one sheet of paper and the words 1 year 6 month 52 lamp 7 min max. Bottle of mojo, had been squeezed in under my email address. And the total sales and balance due had changed from around a hundred dollars to a total of $842 and a balance due of $792. There are also two post-it notes over a large majority of the document. I was told that would be the only copy of the document I would be provided. When I requested a phone numbers for the corporate office, I was given fax numbers only.
The corporate office didnt think my situation even merited a phone call. And the response I got from them was just about the same. I had signed a contract and if I wanted I could cancel for $199. In other words I was stupid and signed a contract without getting a copy and they had me screwed. I called Clackamas Community Credit Union, where I do my banking, and they verified that no attempt to charge my card had been made by Islands Tanning on September 1, 2012 and if it had been, my account would have let the charge go through and I would have been fined a $30 dollar overdraft fee. That didnt happen. That proves he lied about at least one thing and I believe once a liar always a liar.
