My husband is currently being harrassed by JBC. He is recieving very harrassing phone calls demanding that he pay $291.99 for a " bad check" he apparently wrote 9 years ago to Good Guys.My husband told them he wasn't paying anything without any proof of the check. They told him it would take six weeks to get a copy of the check and by then he would owe $1,800.00 so he would be better off paying the $291.99.When my husband asked why it took them 9 years to inform us, they said they have been trying to contact us for 9 years.(????????????????????????????????????)

My husband and I have been stressed and fighting over this whole matter since November. I'm glad I took the time to check out this website and will be contacting my lawyer. Thanks to everyone for sharing their stories.

Checks have expiration dates too

I don't know specifcally what kind of check was used for the payment, but ALL checks have expiration dates. Personal checks are commonly good for 6 months estimated, in most States of the Union. California might have other regulations, laws, and expiration dates. This corporation should know about such common policy.

I'm not sure if they did clear the check or they claim it bounced. It doesn't matter. They have to respond within a specific time frame. I do not get the impression that the check bounced. It sounds like they didn't clear it, within the appropriate time frame. There are Statutes of Limitations which might apply to an overdrawn check as well.

Now, those expiration dates may vary, but I have never heard of checks bad or good lasting 9 whole years. There are Statutes of Limitations for both the buyer and the sellar. These laws are set by the Federal Trade Commission among others. The State of California might have more.

Really, I don't see where they have a legal leg to stand on. They have to provide proof of purchase. There has to be a valid record of a given transaction. They also might not have the right to bill you for researching their own archived records. A bank might charge $20 for you to track a payment or place a "Stop Payment" on a specific check, but this is different.

In addition, both you and your husband should check your Credit Reports. It only cost about $9 through Trans Union, and in a situation like this, it might be free of charge. Most qualify under these conditions for one free report a year. If they have placed inaccurate information, and you can prove it, their are consequences. Even if you didn't sue them, there are certain penalties for damaging someones credit. This would be enforced by Federal Law, acccording to the Fair Credit Reporting Act.

Maybe they should pay you the $1,800, and don't forget phone harassment is illegal.

You might also consider keeping most forms of communication with them in writing. It takes longer, and is a hassle, but you need evidence to build your case; should you plan on going to Court.
