JD BYRider Ripoff I called to make a payment over the phone about 3 min before they closed so I was told to call back the next day and they would process my payment. Well I called the next day and they refused to take my payment and stated they was repoing my car because I was one day late. Glendale, Arizona

I called CNAC (jd byrider) to make a payment over the phone well it was about 2 min before their closing time, and i was told to call back the next day. well i called back and i was told that they were not going to except my payment because it was a day late. Steve the finance guy told me that i needed to com down and talk to them. Once i got down there he stated that they was not going to take my payment because it was one day late and that they were going to repo my Truck. I just could not believe what they did to me, And the bad thing about it is the whole time throughout the buying process they would not let any of my family in with me, not my sister, not even my husband. Once i got on the internet i was so suprized to see they have ripped off so many people. I have been trying to find lawyers that deal with this situatuion because i want my down payment back.

I am not a lawyer or connected with any law firm and I may be off base. But I scanned the internet for the state of Arizona. This is what I found..

Revised Statute 13-1813. Unlawful failure to return a motor vehicle subject to a security interest; notice; classification

A. A person commits unlawful failure to return a motor vehicle subject to a security interest if all of the following apply:

1. The person fails to make a payment on the lien for more than ninety days.

2. The secured creditor notifies the owner in writing, by certified mail return receipt requested, that the owner is ninety days late in making a payment and is in default. The notice shall include the following:

(a) A statement stating:

"You are now in default on loan agreement #______________. If you fail to return the _____________________ (year of vehicle, make, model) within thirty days you will be subject to criminal prosecution."

(b) The business address and hours of operation for return of the vehicle.

(c) The maximum penalties for unlawful failure to return a motor vehicle subject to a security interest.

3. The owner fails to cure the default within thirty days.

4. With the intent to hinder or prevent the enforcement of the secured creditor's security interest, the owner knowingly fails to do either of the following:

(a) Return the motor vehicle to the secured creditor.

(b) Allow the secured creditor to take possession of the motor vehicle.

B. The original contract creating the security interest in the motor vehicle shall contain the following information:

1. A statement that it is unlawful to fail to return a motor vehicle subject to a security interest within thirty days after receiving notice of default.

2. A statement that notice of default will be mailed to the address on the loan agreement and that it is the responsibility of the owner to keep the listed address current.

3. The maximum penalty for unlawful failure to return a motor vehicle subject to a security interest.

C. It is a defense to prosecution under this section that:

1. The owner was physically incapacitated and unable to request or obtain permission of the secured creditor to retain the motor vehicle.

2. The motor vehicle itself was in a condition, through no intentional fault of the defendant, that it could not be returned to the secured creditor within the specified time.

3. The owner has a security interest pursuant to section 47-2711, subsection C.

D. If a law enforcement agency seizes the vehicle, the secured creditor shall be responsible for all towing, storage and related fees or charges.

E. A vehicle that is not returned pursuant to this section is a stolen vehicle for purposes of section 28-4845.

F. Unlawful failure to return a motor vehicle subject to a property interest is a class 6 felony.

It looks like in AZ (states vary), a vehicle cannot be reposessed after one day late without due process. That is (1) no payments for 90 days, (2) debtor notified in writing, return receipt requested to indicate that the debtor was notified. A verbal statement from the creditor saying they'll reposess the car isn't worth the paper it's written on!, (3) debtor must be given the opportunity to make the debt good, etc, etc.

JB Byrider (and others) make a lot of money by reposessing cars from people who don't know the laws and reselling them, keeping any payments you have made.

Again, I could be wrong on this, but take a look at it anyway. You've got nothing to lose and everything to gain.

Go to small claims court and file suit against CNAC for the refund of your down payment. If they wouldn't accept a payment and voided your contract then you deserve your down payment back. Explain your situation to the judge and back it up with the facts and you should win. Good Luck!
