My husband and I bought a car from JD Byrider on February 1, 2013. Part of the purchase price included a 24 month/24,000 mile warranty. The car started stalling out one week after we had it and we took it in to have the oil changed and have it checked out because of the stalling it was doing. The mechanic put it on the computer and found out a sensor in the gas tank was not working properly and that even though the car has a full tank of gas the sensor is saying it is empty thus causing it to stall out. He told us he would order the part and call us in a few days to schedule an appointment to replace this sensor. He never called. We called numerous times and were told by Jeff the manager that he would take care of it and call us back the next day.

Well the next day came and went as did many more days and Jeff never called back. I contacted their corporate office and they told me that they could not control what was going on because this branch was a franchise that is individually owned. Needless to say I was almost killed in the car when right after leaving the gas station and filling the gas tank up the car stalled out and a large farm tractor almost hit me. I then called JD Byrider and told them to come and get the car because they would not honor the warranty and fix the car and I was almost killed in it. They did come and get it but now they are trying to call it a repossession and charge us outrageous fees for this. Do not buy a vehicle from them because they do not stand behind their automobiles and they do not honor their warranties.

Repairs of the vehicle have nothing to do with the financing

 If you turn your vehicle into the lender it is a repossession. The lender does have obligations to meet when you sign the contract, mainly to fund your loan if your application checks out. The lender funded the loan, according to you.

Then you had vehicle issues that were not taken care of by the auto dealer. You have remedies in your contract, but not paying on your loan is not one of the remedies available because the financing of your loan has nothing to do with repair work on the vehicle. Those are two different issues. You can't withhold payment for the loan to punish the dealer for not repairing your vehicle.

By the way, the warranty on these vehicles is worthless. They are meant to push you into signing the contract which you did do so now you are stuck with the repayment of the loan.

Since you just now had the repo, do what you can to fix the situation or the repo will end up on your credit and make it much more difficult to get a auto loan from anyone.

I don't work for the dealership or the financing company, but I know how financing works. If you read your contract carefully you will see that loaning the money to you to purchase the vehicle is a totally different thing than repairing your vehicle.

I hate to tell you this that the 24 months 24 thousand mile warranty does not cover any electric items including sensors. It is only mechanical items. ...

 You do not know what you are talking about. I am done with the contract because they voided it when they chose to break the contract. There has always got to be someone who has to put their two cents worth in when they do not know what they are talking about and you have no right to talk about my credit because you know nothing about me. Keep your nasty comments to yourself.

Why would you even think you came just call them to get the car and just like magic, you're done with it?  Lets assume everything you say is true.  Having mechanical issues does NOT remove you from the responsibility of living up to the contract YOU signed!  What you did is agree to a voluntary repo.  What is next is in all probability they will sue you for the rest of the contracted amount. Then what?  Your already subprime credit will now be even worse.  Start reading those bus schedules!
