Last summer in 2006 we bought a 2000 Dodge Caravan from JD Byryder in Easton Pennsylvania. We have two children so it was kinda hard to fit them in our small pickup truck as well as illeagle for four people. Anyway, I DIDN'T have bad credit but it wasn't great either. I didn't have five grand to put down on a car at a regular dealership (the one I work for) so we went to JD Byryder. Needless to say the over charged us $8,999.00 for the van that was worth only $6,000.00. It had four miss matched tires, a bad serpentine belt, no emblem, what at first sounded like a bad exhaust, broken glove box, bad wheel bearing, air conditioning compressor was shot, wheel alignment and a real loud noise coming from the engine compartment. Like any thrifty shopper I decided to dicker with the sales woman about the price. I explained the vehicle was overpriced to begin with along with all the "conveineintly looked over" flaws. She explained that CNAC and JD Byryder helps consumers with bad credit and thier prices are quite standard for all vehicles. Eager to close the deal I negoitiated a deal to fix the defects and I will sign the papers. Still a little concerned about the noise coming from the front end I asked them to please road test the vehicle while they had it for repairs. They agreed and when the vehicle was returned to me the service department assured me there was nothing wrong so I did one better. I had one of my ASE cert. Tech's look at it. Low and behold the transmission was shot. At that point the vehicle went back to JD Byryder only then to be brought over to a sub contracted trans. repair center (one of the worst in town). Seven times later, one rebuilt trans later and two torque converters later the vehicle is still not repaired. I have replaced 2 front wheel bearings, battery, starter, valve cover gaskets, now struts and brakes again. That's not the half of it. Before starting our payments we have paid CNAC $1400.00 for what they call a down payment, still don't know what it was for considering we still pay 29% intrest on 8,999.00 . We have also over paid on our loan every two weeks times 15 months considering our payment is 154. and we pay 160. Anyway we recently moved to SC and moved back and in the process I was out of work since july and just went back. We have had rent to pay and 2 kids to feed and every day we get phones calls and I am very cooperative and have over and over again explained my situation and I am waiting for my paycheck (my first one since july) in order to pay them. No compassion or understanding. I am workin 2 jobs one 7:30 to 5:00 some times later and the other 7 to 9 at night and I caome home in between to eat and miss the phone call from JD Byryder by minutes but I still call back. In conclusion we have a peice of crap, unreliable, unsafe vehicle and are only just shy of $234.14 behind all compliments of Jd Byryder and CNAC Finance. Where your car is your investment, not our problem.

Check your Lemon Laws

I didn't know if PA has a lemon law like MA does, but a quick google of "lemon law PA" turned up a bunch of info. I found the following here http://www.carlemon.com/lemon/PA_law.html:

"Pennsylvania Lemon Laws and the federal Lemon Law (the Magnuson-Moss Warranty Act) provide for compensation to Pennsylvania consumers of defective automobiles and trucks and other vehicles and products including motorcycles, RV's, boats, computers and other consumer appliances and products. To qualify under the Pennsylvania Lemon Law or the federal Lemon Law, you must generally have a product that suffered multiple repair attempts under the manufacturer's factory warranty. Lemon Law compensation can include a refund, replacement or cash compensation."

Double check the laws for pre-owned/used cars, and also double check the contract you signed with Byrider; MA state law requires a disclosure to be on the warranty info (the paper they had in the window) and it has to be signed at the time of purchase. They may have to reimburse you for repairs, perform the repairs themselves, let YOU choose where the repairs are done, or even give you a refund or a replacement. Be careful with the refund/replace option, since your issues with Byrider do NOT, under CNAC's contract, release you from your payments. You'll have to work that out with CNAC individually.
