Justin Newman is a programmer for the open source telephone software called Asterisk. He is works out of San Mateo, CA.

Our recruitment team put out an ad on the Asterisk Mailing List for a programmer who will help us develop a PHP front-end that interacts with an Asterisk backend and provide for a Predictive/Voice Broadcasting Dialing system.

He mentioned he's got most of the framework programmed already that he used for a previous project, and so integration of this framework with the PHP frontend would not take too long. We agreed, and signed agreements in April, 2009.

We paid him an upfront for 20-30 hr "blocks" like he said. His MO was to say how many hours it would take him to complete a portion and so if we paid for a little more, it will save us some rush in payment for the next block of hours.

Anyway, the project began.

We also had a previous PHP project that we tried to get him to gut and re-do, but at the end of the "block", he suggested it's easier for him to write a new one than redo the old one. Then upon payment of the next block... he vanished from the block.

Instead of being pushy, we tried to give him his space and let him finish what he needs to finish. But he disappeared due to family emergencies and health emergencies. Then he puts his own "EOD" (End of Day) deadlines that he never meets. He 'begins' working on a particular 'phase', and then 'formally' begins working on that phase. These two synonymous things can take a day or two before he gets to the 'formally-beginning'.

On the 20th of June after an extended absense, he returns by saying he's not calling the shots in life right now and take one of two options. Either ask for a refund for the time not billed, or wait for him (which btw, can take another week or two, plus comes with the provisions of further delays). I asked to talk about this over the phone and he said he wants to talk later. Ofcourse, we never spoke. And then he emails me a week later saying how I need to let him know what options I took. (Without calling me).

Anyway, instead of dragging it all out, I told him to get back to me with how much is being returned, how much work has been done, SHOW how much work has been done. And then I'll let him know what I see it to be. He got back saying, he is trying to see if he can give the work to his other 'technician'. I said no, I just want all the monies returned. 30 hrs of work (2nd "block") was $3750, but we sent in $4000. And unless he shows us hours he worked AND what he produced for those hours, I want everything returned.

A week later he says "WE are reviewing your request".

He never got back. We proceeded with legal, and ended up figuring out that our lawyers are going to cost us way more than what's owed. So we stopped short of going to court.

So today, almost a year or so of a couple emails asking the man to make a refund, we've decided to put this up here.

Hope there are more cases that will come up after this about Justin Newman defrauding people. He made off with a cool $8000-$10000 without really doing much.

I am willing to take this down if Justin Newman returns the monies owed. Because we've been good business people who sent money as asked, even more than what was asked once and we were taken advantage of.
