"HELLO" THIS IS MRS TAMMY LINDSAY, AND MR DUANE LINDSAY.WE HAD BEEN GETTING SICK AND TIRED OF OUR OLD CAR WE HAD BEFORE, WHICH WAS A 1991 PLYMOUTH SUNDANCE,THE PROBLEMS WITH THE CAR WAS THAT THE WHOLE UNDERNEATH,PARTS HAD BEEN RUSTED OUT AND TOTALLY,DAMAGED TO NO MORE REPAIR THAT COULD BE DONE TO THEM ALL.AND TO REPLACE THOSE PARTS WERE TO EXPENSIVE FOR OUR LIMITED INCOME FOR THE BOTH OF US A MONTH TO HAVE THEM REPAIRED.

SO WE HAD DECIDED TO GO TO 21 HARTFORD TURNPIKE VERNON CT.WHICH IS KEY HYUNDAI OF MANCHESTER.SO WE DROPPED OUR 91 PLYMOUTH SUNDANCE OFF WITH THEM TO TRY TO GET ANOTHER CAR TO FIT WITHIN OUR LIMITED INCOME A MONTH,TO BE ABLE TO MAKE PAYMENTS WITH THEM AND THEY HAD GIVEN US A SALES CONSULENT NAMED CHARLIE WILLIAMS AND HE TOLD US THAT WE SHOULD TRY FOR A BANK LOAN, AFTER HE ASKED IF WE HAD $500 TO PUT DOWN FOR A CAR OLD OR NEW.AND WE TOLD HIM WE DIDN"T HAVE THE $$.

SO THEN HE GAVE ALL OF THE INFO TO THE LADY CREDIT MANAGER.SHE IS THE PERSON WHO HAD PUT IT THROUGH FOR US,AND IT TOOK ALL DAY ON 6/28/05 FOR HER TO DO IT.SHE HAD ME TAMMY LINDSAY SIGN ALL PAPERS FOR THE CAR,AFTER SHE HAD SHOWN US A VIDIO FOR THE CAR BEING A VERY HIGH IMPORTANT PURCHASE 2nd TO BUYING A HOME WHICH WAS #1 PURCHASE FOR CUNSUMERS.

SHE TOLD US ALL OF OUR PAPERS FROM THE KEY HYUNDAI WOULD BE SENT TO OUR ADDRESS.BUT WHEN WE HAD GOTTEN OUR MAIL WE HAD NOT GOTTEN ALL OF OUR PAPERS FROM THEM.THE ONLY ONES WE HAD GOTTEN WAS ABOUT THE GAP COVERAGE AND THE WRAP VEHICLE SERVICE CONTRACT APPLICATION.SO WE WONDERED WHY NOT THE OTHER PAPERS THAT WE HADN"T RECEIVED.WE DIDN"T REALLY LOOK THAT GOOD AT THE 2001 DODGE EITHER BUT WE TRUSTED THE PEOPLE AT THE CAR PLACE THOUGH AND WE REALLY DIDN"T LOOK THAT GOOD AT THE MILES ON IT.WE JUST TOOK A QUICK GLANCE AT THE CAR INSIDE AND OUT.WE WERN"T THINKING AT ALL WHEN THE SALES CONSULTANT HAD BEEN PUSHY QUITE A BIT ON THAT CAR WITH US.

WE HAD COMPLAINED THE FOLWING DAY ON THE CAR ABOUT THE BACK TAILLIGHT BEING CRACKED AND THE FRONT PART OF THE FRONT BUMPER BEING DAMAGED ,IF THEY COULD TAKE CARE OF THEM BOTH ,AND EVEN PAINT THE TOP OF THE ROOF OF THE CAR WHERE IT WAS SOMEWHAT WHITE .THEY TRIED GETTING OUT OF HELPING US OUT WITH EVERYTHING.UNTIL WE MADE A DEAL WITH THEM OVER AND OVER AGAIN.THE COLOR OF THE CAR IS BLACK.WITH RED LIGHTS IN THE BACK OF THE CAR.THE MILAGE OF THE CAR WAS ABOUT 717,000 SOMETHING,AND WE ONLY WENT ONE DAY OUT AND PUT ABOUT OVER 200 MILES ON THE CAR AND SOME MORE BY NOW.SINCE WE PURCHASED IT. THE PRICE OF THE CAR WAS FOR 12019.00 financed with our bank. AND OUR MONTHLY PAYMENT FOR 236.70 AND THE TERM OF GAP WAS 72MONTHS AND TERM OF LOAN WAS 72 MONTHS.THE CHARGE FOR GAP WAS 599.00,THE CAR WAS A LEMON TO US,AND WE COULDN"T AFFORD THE PAYMENTS WE WOULD LIKE TO GET OUT OF IT ASAP.

OUR BANK IS GOING TO TRY TO GIVE TO US IN THE MAIL THE OTHER PAPERS WE DIDN"T GET BUT MOSTLY THE SIGNED CONTRACT ONE TO THE CAR LOAN PAPER THE CAR DEALERSHIP HAD GIVEN TO OUR BANK WITH OUR INCOME ON IT ,COPIES OF THEM BOTH TO US,BECAUSE WE THINK THEY SENT THE INCOME ONE IN AS A LIE TO WHAT WE ONLY GET A MONTH.MY HUSBAND HAD ONLY SIGNED THE INSURANCE PAPERS SO HE COULD DRIVE THE CAR ALSO.

THE DEALERSHIP HAD ONLY AFTER A WHILE TAKEN CARE OF THE BACK TAILLIGHT AND DID A DETAILING OF THE CAR AND SIMONIZING IN AND OUT OF THE CAR.STILL DID NOT PAINT THE TOP ROOF AND TAKE CARE OF THE FRONT BUMPER AT ALL.WE FOUND OUT FROM ANOTHER PLACE OR SO THAT THERE WAS RUST ON THE CAR IN THE BACK END OF THE CAR .THE FRONT END OF THE CAR A LITTLE PART WAS DENTED ALSO.PLUS THEY GAVE US A PRINTED COPY OF THE THINGS I MENTIONED.BASICLY WHEN WE TRIED TO RETURN THE CAR BACK THEY TOLD US WE COULDN"T THERE WAS NO RETURN POLICY.ON NEW OR USED CARS.THERE WAS NEVER ANY AS IS STICKER ON THE CAR EITHER,OR WARRANTY STICKER EITHER ON IT. Alright, again, caps off, makes it easier to read.

You *might* have a possibility if you are truly and documented learning/mentally disabled. The documentation would be the important part. There have been cases where dealers have taken advantage of other people, such as the man who had Alzheimers and the dealer sold him something like 7 cars in a month. This happened in Oregon, and there was another where a music store manager sold 11 organs to an alheimers patient.

There can be charges of exploitation if it is found that they were truly exploiting them. I don't think your case particularly ranks up there with the above examples, but you might have an option there.

Your disability concerns your learning and memory skills. I get it. That must be WHY YOU CAN'T REMEMBER TO TURN OFF YOUR CAP LOCK. IT MAKES IT VERY DIFFICULT TO READ WHAT YOU ARE WRITING SO MOST PEOPLE JUST STOP AND GO ON TO THE NEXT ONE. Get a clue.

I AM TAMMY LINDSAY WITH DUANE LINDSAY. 7\24\05 WE ARE RESPONDING AGAIN . TO THE COMPLAINT AGAINST KEY HYUNDAI OF MANMCHESTER IN VERNON .

WE ARE BOTH DISABLED AND HAVE ONLY SO MUCH $$$ WE BOTH GET A MONTH ,DUANE"S IS $498.00 TAMMY"S $471.00 A MONTH.WE SHOULDN"T HAVE GOTTEN A LOAN FROM BANK OF AMERICA FOR A LITTLE OVER $12,0000 WE FEEL.WE FEEL THE DEALERSHIP PUSHES TO MUCH ON PEOPLE TO GET TO BUY THE CARS . ALSO.AND THAT ONLY PEOPLE WITH MORE $$$ SHOULD BE ABLE TO GET THE LOANS FROM BANK OF AMERICA.

THE DEALERSHIPS ALL SHOULD BE HONEST WITH THE CUSTOMERS,WITH EVERYTHING ALL THE TIME.

WHEN THEY TELL THE CUSTOMERS THAT THEY WILL GET ALL OF THE PAPERS INB THE MAIL PO BOX ADDRESS THEN THEY SHOULD GET ALL OF THE PAPERS SENT TO THEM.WE DIDN"T GET ALL OF THE PAPERS FROM THE DEALERSHIP WE BELEIVE.BECAUSE SOON WHEN WE PROBABLY WILL GET OUR REST OF OUR PAPERS IN THE MAIL WILL THEN PROOVE PROBABLY THAT THEY HAD LIED ABOUT OUR INCOME ,BUT OUR BANK HAS YET TO SEND IT TO US FOR THE PROOF.

THE CAR WAS SOPPOSED TO BE ALL TAKEN CARE OF BEFORE WE HAD PURCHASED IT WE THOUGHT ANYWAYS EVEN THOUGH WE HAD NOT REALLY HAD CHECKED OUT OUR CAR THAT WELL AT FIRST.AND WE KNOW THAT THE LEMON LAW CAN NOT WORK FOR US THOUGH .THE CAR DEALERSHIP TOLD US THAT WE WOULD HAVE TO PAY OURSELVES OUT $1,000 FOR THE ROOF TO BE PAINTED BUT THE REST WOLUD HAVE TO BE PAINTED ALSO.AND THAT THE FRONT BUMPER WOULD HAVE TO,COST US OUT AT $750.00. MY DISABILITY IS LEARNING AND MEMORY.MY HUSBAND"S IS FOR NOT BEING ABLE TO READ. I HELP HIM OUT.

THEY ALSO HAVE A NO RETURN POLICY AND YET WE DID NOT SEE IT POSTED ANYWHERE THOUGH. AND WE HAD NO WARRANTY POSTED ON OUR USED CAR WE HAD PURCHASED WHICH WAS THE 2001 DODGE STRATUSS. THANKS.

What, exactly, is the problem?

Before I start, please, turn off the caps lock. Makes a difficult message to read even more difficult.

Now, I am making a few assumptions here, but your old car was pretty much dead, so you went to this Hyundai dealership to purchase a new or used car.

You finally decided on a car, a 2001 Dodge.

The dealership suggested going to your bank as they were unable to acquire financing for you.

You did that, signed all the papers at the bank, and were told that your monthly payment would be $236.70.

After purchase, you discovered a front end dent, as well as a cracked rear taillight and some paint problem on the roof. The dealership repaired the taillight, but not the front end dent or the paint on the roof. Later you found some rust.

Now, you want to return the car because either it is a lemon or you can't afford the payments, or both.

First. You admit that you didn't look at the car too hard before purchase. That is your first mistake. You should have noted any items that required attention before purchasing the car and made the dealer put in writing that they would solve these problems. Talking to your original salesman, if those problems were noted at the time and he agreed to have them fixed, should be your first step.

Second. You have no basis for a lemon law complaint. The lemon law is for problems that have been attempted to be fixed multiple times and have failed. You also have no hope of "returning" the car. So, those ideas need to go right now. Your option is basically a voluntary reposession of the car by the bank, and if that happens, kiss any chance of financing another car goodbye for many years. You could also attempt to sell the car for what you paid for it, but if you do not disclose the damage that you know about, you're doing the same thing as the dealer, assuming they knew about it.


I completely disagree that you are being ripped off by the bank or dealership. The only possible ripoff is the dealer not standing behind their used car, but technically, if you didn't bring the relatively minor damage to their attention, it still comes back to you.
