You cannot collect a debt that the statue of limitations has run out on and I think being dead 8 years says the statue of limitations is long over.
The pain of having your son dead is great. Being harrassed by a collection agency to collect a debt from a dead man is beyond reason.

POSTED: Sunday, October 01, 2006First, I'm sorry you have to relive the pain of losing your son. I know how painful that is. And, you have no legal obligation to discuss anything with them or pay your dead son's debt.
Merchants Credit Guide Co are primarily JUNK DEBT BUYERS. They buy mostly VERY old, UNCOLLECTABLE, out of stat debt. If your son has been dead for 8 years, that means this alleged debt is 10-12 years old! They only buy debts that are at least 3-4 years old, after several other agencies have failed collections and given up.
You simply need to send a CEASE COMMUNICATIONS request as per your rights under the FDCPA. Send this by certified mail, return reciept requested. Put the certified# on the letter itself and keep a copy for your records.
They will go away.

POSTED: Saturday, September 30, 2006Secondly, and this may be a stupid question. Have you told Ken Hughes that your son has passed away? Collection agencies do not know that information until they are told. Once they are told this, they are usually going to do a public records search. If nothing comes up in a public record search, they may ask for a copy of the death certificate. Obviously, they are just trying to get proof that they made a bad investment. Unfournately, the accounts do not list whether the person is alive or not (at least in my office).
