My son, who is 4 yrs old, Ethan was hurt on April 21,2008 at his pre-school Kids R Kids in Missouri City, and was taken to the hospital for damages near the eye. He was treated and released that same day. That same day, I went to visit the director of that school to ask for their insurance information. She stated, "she would talk to the owner and fax it to me the next day." Of course, I didn't receive it. I called the school on April 23,2008 and spoke with the director and stated further actions will be taken if information is not given. Thirty minutes after our conversation, I got a call back from my wife saying, " Ethan is not allowed here anymore." Ethan was to graduate with his fellow students two weeks from now with all the other 4 yr olds. Now he can't because he has been expelled for no unknown reasons. He has been a good child and everyone loves him there. Other than having issues with the administation of him getting hurt. I have paperwork after paperwork of how good he is as a student. They had the nerve to say my son injuries was just a boo-boo. I am so upset and hurt by this establishment, that I will sue them and let every know what kind of people they are.

I am daycare worker who strives to give the kids a safe, nurturing, and educational environment for children ages 2 and above. In my opinion the Kids R Kids did what they could to aid the cost of the medical bills by replacing with a deduction in daycare cost which could've come out to be equal in value. Now, if the parent refused then it's their loss, not the daycare. Some people cannot be pleased unless it's under their own terms(people who want to sue for every incident in the world), which is unfortunate, for those who cave in. As for your comment that our sole duty is to watch the children I have to correct your words. While it is one of our duties and it's a big one at that, it is also our duty to prepare curriculum, work individually with a child, promote positive social behavior and proper health and moral care for things and themselves. If parents think that a child can NEVER BE INJURED IN DAYCARE then find someone who ONLY attends to your child's needs and noone else. Or send your child to daycare in a bubble wrap. For Goodness sakes! Would you sue yourself if your child injured himself under your watchful eye!! Probably not! Consider the work that we as daycare provider must endure as well. While we love children, and are sorry for accidents that occur, it is hard to do so with parents unwilling to understand the circumstance we work in as well. On a given day we have children of all the same age who can act spontaneously and uxepected with no warning in advance. Most biting in daycares can be prevented. Usually, it begins at home or in a daycare. But if it is not corrected it can be contagious and children learn bad behaviors from their peers as well as from their home envirnment. I think the biggest problem is parents and directors/ centers not communicating their concerns to the extent that they each came to an agreeable resolution.

I completely agree with you. My son is currently in a Kids R Kids daycare in Texas and he received his 5th bite in 2 weeks. I'm very upset as you can imagine.  After bite No. 3, I've started searching for alternative care, the last 2 happened today; he was bitten by 2 different children.  As for your situation, I completely agree with you.  We leave our children at daycare b/c we have to and we leave them with the belief that they are left in good hands.  Childcare is strictly their business, they have no other tasks to manage through out the day except for the care of our children.  They should be responsible for accidents and I would imagine that they are insured to cover accidents of your son's manner.  Accidents are going to happen and they need to prepared to handle them properly and to kick him out at that age, was probably devastating to your son.  For the folks that have comments about suing being uncalled for or disapprove of taking further action, unfortunately, times have changed and everyone "passes the buck" these days.  Innocent people are taken advantage on a daily basis and I hope that you did take further action.

Disappointing

It's posts like the one above that illustrate what's wrong with our society. It doesn't matter that the school did nothing wrong, they should pay (or get sued). I agree that the school is responsible for providing a reasonable level of supervision, but the only way to guarantee that injuries don't happen would be to isolate the kids in padded rooms. I'm sure there would probably be some outrage at that as well.

Kids sometimes injure themselves while playing. It's a fact of life. Holding the school responsible for any and all injuries, regardless of whether they were providing adequate supervision is not fair. In our sue happy society, we've come to believe that everything has to be someone elses fault.

The next time you think about complaining about the high cost of child care, think about the extra costs of insurance premiums and additional staff that will be required to provide a standard of care that guarantees that a child cannot do something to injure themselves.

My nephew broke his wrist on the playground diving from one toy to another. The pre-school paid the bills, without his parents having to say a thing. Its their reponsibility to watch the child. The parents pay them to keep their kids safe, and if they get hurt on their time, and on their property, than guess who foots the bills? You have a clear case against them, so go for it.

Any nay sayer on here who claims that they wouldn't do anything if their child got hurt is a liar. Little boo boos are fine, but come back here when your kid breaks a bone, or needs stitches.

I have had no problems with Kids R Kids #37 Katy

I started my daughter in Kids R Kids last year. She is 13 months old. I have had no problems with the school or staff. I was pleasantly suprised with the cleanliness and attention given to my daughter. I hate that I have to send her to daycare, but I feel that she is in great hands. We have had a few boo boo reports, but she is a kid. What do you expect? They fall and get injured no matter who is watching them. Parents need to get a life and realize that accidents happen. I do not believe the school is responsible for picking up medical bills due to clumsy kids. Nor would I have my own mother pay her medical bills if she became injured while in her care.

Kids R Kids expelled my 1 year old because they don't know how to handle any challenging situation

My son started at Kids R Kids as a 3 month old and was there until he was basically asked to leave at the ripe old age of 14 months. He had been involved in several biting incidents, some of which caused slight injury to other kids in his class. The parents of the other kids--who hadn't experienced this before or yet got upset-- the school caved to their stupid demands and threats of lawyers-not knowing what else to do--and we left tearfully. I was very upset and my wife was beside herself with tears. We had no other recourse and were stuck taking him to a "Montessori" school run by Indian ladies, some of whom did not speak English, what a mistake!!

But now he has a great school and is very happy and so are we.
At the age of 2 1/2 he is finally gaining knowledge--his speech is improving thanks to ECI and he is getting positive reinforcement and discipline at the same time where he is. Can I say it--Towne Creek School is one of the best in Houston, is privately owned and has been in the town for over 20 years.

Places like Kids R Kids (duh, it's a franchise) employ baby sitters with experience in just that--baby sitting. I suggest finding a pre-preschool--not just a daycare-that has certified teachers that actually have training in Red Cross/First Aid, Conflict Resolution, Continuing Education Seminars for their employee, etc...-the price is more expensive-but your child's well being and future are at risk if they don't end up in the right learning environment.

When all this biting stuff came about we were taking him to the Dr. and were worried that we were doing something wrong and it is really hard on a couple with a new child to try and figure those things out and juggle careers and school. Noone needs the added pressure of their precious child being put aside because the adults in their life (the daycare) don't really have a clue- and in our letigious country, are only afraid of lawsuits and keeping the bottom line in the black. I thought public schools were the country's only problem we had in education --learned that it is not the case at all...

Having worked in a Pre-school for over 15 plus years and 8 of those years as a director it was very wrong of your so called "insurance provider" not to pay for the accident.In all the years I worked at the pre-school I directed I had only one accident that required stitches in a child's head. I would have never even THOUGHT not to have our insurance provider pay for injury. You should be very ashamed of your actions ! Not only was it the right thing to do, but it would have been the MORAL thing to do. Had this been YOUR child what would you have wanted to happen? You are suprised that the parents were UPSET? Come on! I hope other parents read this because if their child is injured we know now that your so called "school" will NOT stand up for them. I just googled your website and found out that this is a chain day care. No wonder they recieved this treatment from you. I bet your workers make minimum wage or slighty higher. I can only wonder what your child to teacher ratio is.......This needs to be a warning to other parents who have their child in your chain..................and I thought Halloween had scarey characters........Sad, very very sad. The saddest part is the child is the one who was hurt.I'm sure as a director you must be so proud to work at a place like this......

Kids R Kids Is Not At Fault! Texas Department of Family and Protective Services wrote this incident as an accident at no fault of Kids R Kids

The injury of the child mentioned above was handled with the utmost importance as is any situation. The child ran into a post by accident while playing on the playground and we were well within our ratio. The family was contacted immediately upon the incident. The Texas Department of Family and Protective Services that oversees licensed child care providers was notified of the incident and explained to the school that we were under proper supervision and ratio and wrote this incident as an accident.

Since the school was not at fault, the insurance provider advised the school not to pay for the doctor visit; however in lieu of payment the family was given opportunity to receive credit for school tuition to help minimize any doctor's bills that may have been incurred due to co-pays. This was not satisfactory to the parents and they started acting in an irate and irrational manner threatening to sue us. Their threatening behavior left us no choice but to dis-enroll the child.
