Please refer to website for NetPosse for details regarding the report of a stolen horse name "Legs" or "Standing Still."

Kohl sold horse online to a party who had a sale contract and paid but never received horse.  Horse was sold at the same time to someone local who also paid & who got the horse and the registration papers.  This was an apparent fraudulent sale inthe state of CO.

 First, I would like to thank VlButchMisk for giving me an opportunity to provide more education about civil crimes vs criminal theft in the horse world via this post. NetPosse.com is all about education and victim's services.

Second, let me note that the previous person did an outstanding job posting the real facts about this case for NetPosse. She has the facts and so do I. All of her points above are 100% factual and correct.

How am I so sure? I am not going to hide behind any alias. I am the one who saw the emails, talked to all of the parties involved, even the owner who had the horse as it was sold to a new victim. This person came forth after seeing one of our NetPosse Alerts on this case.

I am also the one that was told about the fake transport and the fake people who disappeared and the many things that just were not true. Funny, even though I asked for the law enforcement agency information where the so called transport drivers who disappeared into thin air were reported missing, none was provided and all I got were more excuses.

I could go on and on but there is no reason for this post other than to make sure everyone who does not know our reputation has a chance to learn from this post and hopefully does not fall into the same or similar type of situation.

No charges are brought in cases like this for some of the following reasons. Here are five of the reasons below:

  1. Police fail to decide where the jurisdiction is because the seller and the buyer are in different states. This happens all the time in this sort of case. Nothing unusual here.
  2. Cases like this are civil matters, not a criminal case. When  there is an agreement between two parties in place most of the time it is deemed civil by laws in the United States.
  3. The dishonest parties know this before they even start taking advantage of a victim. They count on the laws of the land to support their wrong doing. They know it is not likely they are going to get prosecuted.
  4. Victims decide not to spend the money to go after people who do this to them. Why? It would cost so much to go after them in civil court even when they are in their own county. When the parties are in separate states it is more costly in time, money and emotions. The toll it takes on a victim is simply not worth the effort or what they'd gain by doing so.
  5. Working with people who do this to victims often, makes it is clear to me that people who commit civil crimes know the laws better than their victims. They use the judicial system to get away with many crimes. The people who perpetuate this kind of crime get away with it for this very reason more often than not.
 
As for the post by the person claiming to know the facts, they don't. As the previous post suggest, I highly suspect this is the very person who I talked with on the phone. If not, the person who wrote the preious post needs to do their own investigation just like we did. Their opinion will change if they review the real evidence.

As a post note to this kind of case we have 12 tips to help you document your transaction and transport of a horse as a buyer or seller:
 
  1. Never buy a horse sight unseen on the internet!
  2. Never release a horse that has not been paid in full, with money clearing the bank, to go to a new owner.
  3. Do a background check on the buyer / seller before entering a transaction.
  4. Legally record all conversations on the phone about the transaction for your records and for court in case there are any disputes. Check the laws in your state on how to make legal recordings. Some states require that the other party know they are being recorded while others require only one party know. Know them before recording.
  5. Make sure you have a signed contract in place for the purchase or sale of any horse.
  6. Make sure you have a  signed and withnessed bill of sell from the seller when you purchase a horse.
  7. As a buyer, make sure you have all documents in hand at the time you receive the horse such as registrations and transfers, medical records, bill of sale, copy of checks used to pay for horse etc.
  8. NEVER pay in cash! Always have traceable records of any transaction of payment.
  9. Make sure if a horse is to be transported to you that YOU arrange the transport and have all points of transportation included in a that signed contract.
  10. Make sure you know who the driver of the transport vehicle is and how to get in touch with them while they are en route with your horse.
  11. Check the transport company to make sure they have a GPS locating device on the truck so you can see the location of your horse in transport at any time.
  12. Make sure you contract states that jurisdiction, in case of any disputes, will be in your county of residence. This helps decides jurisdiction for the courts in a signed contract.

In reference to " Net Posse" rants and further accusations:

I have investigated the supposed " facts" in the case and spoke to two key wittness, one being the first buyer in this case who stated VERY clearly that " net posse" harrassed her and her mother and TOLD them what to say and how to say it so that their " facts " could be published. Furthermore, the horse in question is now in the happy hands of the destined owner and NO ONE is unhappy.

It is comical that not only does " Net Posse" assume my email address is Ms Kohl but that " even though no charges were filed" a crime still occured. REALLY? well the way the LAW works is that a CRIME has to be committed for charges to be filed. My understanding of this entire transaction is that is a host of miscommunication, people jumping to conclusions, and outright dishonesty on BOTH sides.

" Net Posse" should be aware that it IS aganist the law to slander and accuse people without facts and according to my investigation, Ms Kohl was spoken to once on the phone, whereas the witness/victims in this situation were HARRASSED ( their words) on a DAILY/HOURLY baisis.

I would be happy to forward my name and the name of the people that know and support Ms Kohl as to the REAL facts at anytime..quite honestly,a hysterical over emotional woman...does not have the right to accuse, lie and misinterput what they believe to be dishonesty. It is people like the "crew" ( one woman) at " net posse" that have spun the horse industry into a downward turn, living and turning over gossip while sitting behind a computer and ruining teenagers dreams of a first horse purchase.

Get your facts straight " Net Posse" or face your own criminal charges, there are alot of people that know the TRUTH, you are not one of them.

Unfortunately, as an uninvolved third party, VlButchMiski, you are completely ignorant of the facts of the case. The president of NetPosse did speak to Ms. Kohl, where the two discussed that the horse had been shipped and that the shipper and his wife had disappeared in transport along with the horse in question and three others. Ms. Kohl even went so far as request that NetPosse hold the alerts on “Legs” and give the couple time to be found. She also told NetPosse that a Missing Persons Report had been filed with police, but, despite contacting numerous law enforcement agencies, that information could never be confirmed.

Furthermore, the second buyer purchased insurance, but Ms. Kohl never provided necessary documentation requested numerous times by the buyer and insurance company. After Legs allegedly disappeared in transport, Ms. Kohl advised the buyer to file a claim for her loss: “I can’t help you. [the shipper] is gone for good.” Therefore, this case was not only investigated by NetPosse, but the insurance company was never able to secure the proper paperwork on the mare from Ms. Kohl either.

The statement that the checks were bad is false as well. These were issued by the buyer’s bank, and could not have been issued without the funds being available. NetPosse has seen proof where this money was paid. NetPosse received the information for the listing on its Web site from the second buyer. After the NetPosse Alerts were issued, NetPosse received a tip from someone witnessing the first sale of Legs prior to the sale of the mare to a second buyer. NetPosse then spoke to the first buyer who confirmed this information and who was also never able to get the proper paperwork from Ms. Kohl.

The facts are facts and were proven by not only NetPosse but also the statements and documentation received from the insurance company and both buyers. Just because Ms. Kohl was never charged with a crime doesn’t make her any less guilty. Not only did she financially devastate this buyer, who was paying stall board while awaiting the horse, but she also emotionally devastated her as she worried nonstop about the fate of a horse, which was never in jeopardy. NetPosse has copies of the emails between Ms. Kohl and the second buyer in which she claimed to be crying as well and was worried sick … more lies and manipulation. Then later Ms. Kohl went so far as to threaten to file harassment against the second buyer who had a right to the funds or her horse … and if nothing else, the truth. Even after the horse had been sold twice, Ms. Kohl continued to allow the online ad to run as active, which indicates that there might have been even more buyers than these two.

So, VIButchMiski, either you need be more aware of the people with whom you associate or Kristina Kohl, you need to quit hiding behind yet another alias (VIButchMiski, Kristina McCall-Mason, Kristina Mason, Kristina Hughey). You cannot make up more lies to try and make NetPosse look bad and yourself better. There is also no misunderstanding of the facts on NetPosse’s end as a thorough investigation was done with numerous parties to confirm the facts as stated. Shame on you. There is no rebuttal that can possibly erase the harm you caused these two buyers and possibly others.

I am a client of the above mentioned person. I find her to be honest and have known her for the past four years. I reviewed all the information regarding the sale of the horse in question. Net Posse assumed all the worst and never contacted, but accused and threatened. Net Posse is anything but impartial. Ms Hughey was never charged with or convicted of any crime as non was found or exsisted. It was a simple mis understanding that was taken to far. They buyer of Standing Still bought the horse with a bad check,  Therefore Ms Hughey, sold the horse to another buyer, , the first buyer still claimed the horse and came to pick the horse up and the horse was already on the way to the second buyers home. Consquently the second buyer could not get along with the horse and the horse went back to the first buyer. Ms Hughey only recieved one payment for the horse, which is why no charges were brought aganist her.

I personally know that Ms Hughey has been drug through the mud and her reputation as a solid and outstanding horse trainer ruined...all from lack of communication and many people jumping to conclusions. Net Posse is one of the worst organizations Ive ever dealt with, they made up their minds before getting all the facts. Ms Hughey has never been anything but honest with me, my family, my friends and I would trust her with any animal or child.
