LA Fitness cancels life time membership with Bally's Total Fitness member after 25 years for not honoring childcare services through Kids Club Duluth, Georgia
My name is Mr L. I am a lifetime member of Bally's Total Fitness of 25 years. I was only a member of La Fitness for 2 days and had my membership terminated under bogus allegations. I want to share with you my experience with La Fitness with a letter my attorney wrote for me to one of it's employees. I do realize that a contract can end with justifiable reason from either party but this allegation really disappoints me that a health club would stoop so low and use this excuse to cancel a contract after 25 years.
Mr. L has a lifetime membership with Ballys Total Fitness, which has transferred to LA Fitness. Mr. Ls lifetime membership included childcare services through Kids Club. On February 15, 2012, Mr. L spoke with Gino, general manager of the LA Fitness Kennesaw, GA branch. Gino directed Mr. L to contact Ballys and have them send written documentation to LA Fitness evidencing the included childcare services within his membership. Mr. L called the Ballys numbers provided by Gino and left messages for Ballys representative, Mr. John Sennett, with no return telephone call.
Subsequently, Mr. L called the main telephone number for LA Fitness and spoke with member services representative, Soazig. Soazig provided Mr. L with another telephone number for Ballys and directed him to call Mr. Kelly Videl. Mr. L promptly complied and called Mr. Videl, but again he received no return telephone call.
On Friday, February 24, 2012, Mr. L called Soazig to inform her he had not received a return call from Mr. Videl. She was unavailable so Mr. L spoke with another LA Fitness member service representative, Richard. Mr. L explained to Richard the complications he had encountered with not receiving childcare services under his LA Fitness membership. Richard informed Mr. L he would have a supervisor return his call within fifteen minutes. Mr. L did not receive a return call on Friday.
On Monday, February 27, 2012, Mr. L received a voice mail message from the LA Fitness Vice President of Operations. Mr. L immediately returned the call in anticipation of a resolution to his problem. During the telephone conversation she accused him of harassing LA Fitness employees, and allegedly threatening to take a gun to the club if the matter was not resolved. She further indicated the call came from Mr. Ls telephone number on Friday, February 24, 2012, and informed him his membership was cancelled as a result.
Mr. L vehemently denies harassing LA Fitness employees and making threats of any kind. We recognize the many membership complaints LA Fitness has sustained as a result of the merger with Ballys. However, Mr. L is extremely offended and disappointed that LA Fitness has chosen to create this bogus allegation in an attempt to unjustly cancel his membership. Accordingly, we respectfully request LA Fitness reinstate Mr. Ls membership to include the Kids Club.
Although Mr. L prefers to resolve this matter amicably if possible, I must inform you that unless you comply fully with the above demand within ten days hereof, I shall advise him to pursue all available legal remedies. These remedies may include the filing of a civil suit for damages, and in the event that it becomes necessary to do so, a court having jurisdiction will also be authorized to award Mr. L reasonable attorneys fees and litigation costs. I therefore urge you to respond promptly to this demand.

Update April 4th 2012
I am deeply appalled. A month has past and the VP of Operations for La Fitness has not returned my attorneys phone calls or answered this letter. She has forwarded her business line to a La Fitness club in Illinois. How sad is that? La Fitness has broken a breach of contract and added another victim to the one day class action law suit that will be filed against them for treating their loyal members this way. If you are reading this agree and would like to be part of this suit I urge you to respond.
