Search TipsYou say that these affidavits are often filled with lies and hearsay. So is this the case in the one you received? If you can prove that it is false(and they should have reasonably known it) you would have an instant FDCPA violation suit.
As for your Validation. A debt is generally considered validated in the following conditions.
1. Proof that the collection agency owns or has been assigned the debt. It is a very good chance that the affidavits satisfied this requirement.
2. Account statements from the original creditor. They are generally not required to provide every single statement. So it would be validated unless your dispute the amount from the statements are wrong, or you did not receive the statement for the amount you are disputing.
3. The original signed loan agrement. However, the statements and the affidavit could qualify as validation for this.
