When I decided to sell it I did research on it and found out that it was Wetlands worth only $2350 and could not be developed at this time.
I called them but they said that I should have done my research before I bought the property. I stopped paying the mortgage and contacted Better Business and they contacted Land Auction.
They than sent a contract that that they would return 1/2 the money I had paid for the two properties in return for not suing them, having a lawyer look over the contract and not talk about it. I then decided that they were asking to much for retrurning only 1/2 my money.
I called them and requested all my money back to sign the contract and return their Warranty deed. They continued to say that they did nothing wrong and that they would foreclose on me.
They foreclosed in the Circuit Court of the First Judicial Circuit in Escambia County, Florida Civil Action Case No. 2007-CA-2707 with this Communication This from a Debt Collector from Golson Law Firm.
They served me in New York at Apt 9 instead of apt 10 by mail. I would not have gotten it if the mailman had not known the correct apt. The Civil Action also has Apt 9 on it for February 12th with the atty's appearing by telephone..
I called the Clerk of the Judge to see if I could be on the call and she told me tnat they had only one line that I would have to call the atty and see if they could conference call with me. When I did the response was that it was a debt collection agency so I hung up.
I have tried to find out what I should do to file pro se. I have asked questions at several forums but as yet have had no response. I also saw coursed on winning in court but I could not find any information on them at the better business bureau. I now do my research before buying anything.
I received a Summary Final Judgment of Foreclosure on the 9th even before the hearing with a return recept requested which I did not sign. The notice was signed by someone else, don't know who.
I tried to hire a lawyer in New York and left copies of my paper but to date they have not called as to whether or not they would represent me. I sent them this information on January 25th or later and waited until February 7th to see if they would call that's when I started to panic as to what I should do.
I called the Enginerring dept and told them of my dilemma and they referred it to their legal department. I also called the Attorney General of Florida and sent in my complaint.
I am still waiting for what I should do pro se to dismiss this case and suing them for fraud.
