my home was in foreclosure with emc mortgage corp., due to me being terminated for filing in the state of nj for sexual harassment/sexual discrimination against an employer in 2005. i had been making my repayment of 1929.00 which included arrears. my actual mortgage was around 1400. marsha joubert made contact with me in late oct./nov 2008 on a modification/repayment program, after much discussion, and realizing emc was not going to lower my monthly payments, i reluctantly agreed to the 1929 monthly payment at 6%.
on this date, monday december 22, 2008, i still had not received any paper work from emc. i phoned the company to ask why. an amanda carter (?), informed me my new payment would be between 2029 and 2120 (or thereabouts) due to interest.
i told them what joubert had said and they blew me off. it was then that truitt kimbrell -supervisor-told me, my payment had expired at the end of nov 2008. since then i received my dec statement for 1929 and NO other paper work informing me of this matter. i was the one who made contact with emc, they DID NOT contact me of the expiration date.
i was then told to come current or accept the higher monthly statement or pay in full or they would foreclose!!! this is illegal, fraud, blackmail, bait and switch and a misrepresentation for good faith. kimbrell said that there was NO verbal agreement when joubert called me when i agreed to the previous conditons. yet he was calling me up with a conditional agereement. why is his word better then joubert's when he is her supervisor and agreed to the 1929 in oct/nov?
i need help, on this matter and am beginning to wonder why WE the taxpayers, gave 700 billions to banks if they are not going to help or represent themselves in a truthful and honest manner. the banks are not doing what paulson told them to do if the banks were to borrow the money. the banks took the money and defaulted on an agreement and i am to pay for this? Illegal. if i pulled this stunt, i would have charges filed against me!
