Mary Jane M Elliott, PC representing as successor to Midland Funding, LLC FAILURE TO RESOLVE LEGAL ACTIONS RESULTING IN DAMAGES TO THE DEFENDANT Novi, Michigan

Mary Jane Elliot, LLC, attorney representing Midland Funding LLC, as successor in interest to Washington Mutual Bank filed a Summons and Complaint in the State of Michigan Berrien County Trial Court against me on March 03, 2011. I was served with a summons on March 30, 2011. I responded, via written notification, to the offices of Ms. Elliot and to the Berrien County Trial Court, stating I shared the same interest in resolving a $5121.79 debt and was willing to work equitably and fairly with the offices of Ms. Elliot and the Berrien County Trial Court. As a result of multiple mitigating factors, including military-service connected disabilities rendering me fully and totally disabled since my honorable separation from the military on April 23, 2008 and multiple life-threatening/dramatically shortened life-expectancy health conditions and a deluge of other overwhelming debt totalling over $50,000, I hired representative counsel to respresent me in order to negotiate my aforementioned debts by the means of a Debt Settlement Program, so that I might responsibly ameliorate the debts accrued resulting from service-connected disabilities. After numerous attempts made by my representing counsel, Ms. Elliot has refused and declined any and all attempts to negotiate this debt in order to resolve this matter, thereby paying, resolving and absolving this debt. On January 23, 2012, Ms. Elliot has chosen, once again, not to negotiate this debt, in order to resolve these legal troubles, therby causing me additional mental anguish, undue stress and trauma, especially near the end of my life, as a result of my multiple health conditions rendering me with a considerably shortened life span. Ms. Elliot is negligent in her inability to resolve this debt through negotiation with my representing counsel and is continuing to cause damages to my family and me through her ineptitude as counsel for the plaintiff in these matters. In addition, after further investigation, it appears Ms. Elliott and her constituents are taking legal actions on a debt litigated under false pretenses through misrepresentation by Midland Funding, LLC. I was afforded this response by the Better Business Bureau:
